COMMISSION RESOLUTION NO. 3840 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ESTABLISHING THE COMPOSITION OF THE IMPACT FEE ADVISORY COMMITTEE REQUIRED BY STATUTE. WHEREAS, the City of Bozeman, in 1996, adopted Ordinance No. 1414 establishing impact fees; and WHEREAS, the City of Bozeman desires to update its fee studies and ordinances establishing the dollar values of individual fees; and WHEREAS, the Montana State Legislature did, in the 2005 session, adopt a law establishing requirements for adopting or amending impact fees; and WHEREAS, State Law requires an impact fee advisory committee to review and monitor the process of calculating, assessing, and spending impact fees. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that: Section 1 An Impact Fee Advisory Committee is created for the purpose of advising the City Commission regarding the process of calculating, assessing and spending impact fees. Section 2 The Impact Fee Advisory Committee shall consist of nine members to be appointed by the City Commission. The members shall be: the City Engineer; the City Finance Director; a certified public accountant who shall hold no other public office or employment; a builder; a land developer; two citizens of Bozeman not employed in the development industry; and two other members as selected by the City Commission. Upon the creation of the Committee, the members shall be appointed for the following terms: public officers and employees during the terms of their office, four members that hold no public office or employment for a term of two years, three members that hold no public office or employment for a term of three years. The terms shall expire on the first day of January of the second and third year, respectively, following appointment. Thereafter, as terms expire, each new appointment shall be for a term of two years. A majority of members must be residents of the City of Bozeman. Members shall serve without compensation for their time and services. Meetings of the board shall be conducted in accordance with all applicable rules and regulations of the City and any adopted bylaws ofthe committee. Section 3 The City shall provide, and the members shall attend, training in the necessary subject matter which will in the judgment of the City enable informed participation by members of the Committee. Such ---.-----.-..-...... ....--..-.-. ..-..---.-.-.--------.- ... ..--...--..----.-.--.--.--..-.-..----- training shall be provided on an annual basis and shall be provided prior to the Impact Fee Advisory Committee, or any individual member thereof, making any recommendation to the City Commission. Section 4 The Impact Fee Advisory Committee shall perform its functions coterminously with the City's use of impact fees.
