HomeMy WebLinkAboutResolution 1399 Creates SID No. 492 36 COMHISS ION HESOLUTION NO. 1399 A RESOLUTION OF THE CITY COHMISSTON OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 492 FOR THE PURPOSE OF THE CONSTRUCTION AND INSTALLATION OF AN EIGHT (8) INCH Sl-'\NITARY SEWER IN THE ALLEY OF BLOCK 12, SPRINGBROOK ADDITION TO THE CITY OF BOZEMNN TO SERVE LOTS NINE (9) T~RU SIXTEEN (16) INCLUS IVE . WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, I Hontana, a petition in due form of certain owners of Lots 9 through 16, Block 12, Springbrook Addition to the City of Bozeman, Montana, asking that a special improvement district be created for the purpose of constructing and installing an eight (8) inch sanitary sewer to provide sanitary sewers to Lots 9 through 16, Block 12, Springbrook Addition to the City of Bozeman, Montana; HHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on the 22nd day of January, 1969, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. ll92 of the City of Bozeman for the purpose of constructing and installing an eight (8) inch sanitary sewer in the alley of Block 12, Springbrook Addition to the City of Bozeman to serve Lots Nine (9) thru Sixteen (16) inclusive. Section 2 Boundaries The boundaries of said Special Improvement District No. 492 are described as follows: Beginn'ng at the SD'l(-"iHcst.erly ('()reler of '11'_;c" 12, Spr;~gbr00~ Addition to the City of Bozeman, Montana. thence northerly along the westerly line of said Block 12 to the northwesterly corner of said Block 12; thence continuing northerly along said westerly line of Block 12 extended across West Beall Street to the southerly line of Block 4 of the Brunton-Palffy Re-arrangement of Durston Subdivision to Bozeman, Hontana; thence easterly along said southerly I line of BIoek 4 and said line extended to the easterly line of the n;:,rth-south alley of said Block 4, being also the southwesterly corner of Lot 5 of said Block 4; thence southerly across Beall Street to the northwesterly corner of lot 1 of Dlock 12 of said Springbrook Addition; thence continuing southerly along the easterly line of the north-south alley of said Block 12 and said line extended to a point of intersection \v1th the centerline of \\lest Lamme Street; thenee westerly along the centerline of said \.Jest Lamme Street to a point of intersection with the easterly line of Eleventh Avenue North; thence northerly to the point of beginning. Containing within the above described exterior boundaries the following lots, to-wit: Lots 9, 10, 11, 12, 13, 14, 15 and 16, all in Block 12, Springbrook Addition. Section 3 Character of Improvements The Character of improvements to be made is the installation and construction of an eight (8) inch sanitary sewer including trench excavation and backfill installation of seHer pipe, necessary \vyes and tees, service stubs, pipe bedding material and other appurtenant work thereto. Section If Estimate of Cost The total estimated cost of rhe improvements within the district including engineering, legal and contingency is $2,500.00. Section 5 Method of Assessment The cost of such improvements is to be assessed against the entire district, each lot, tract or I parcel of land within such district will be assessed for the part of the whole cost which its area bears to the area of the entire district exclusive of streets, avenues, alleys and public places. The total actual assessable area within the entire district is 20.000 square feet and is the area on which all protests will be received, consi.dered and determined. It is also the figure on which all assessments wi 11 be figured. Section 6 Payments The payments for said improvements shall be made in eight annual instalhnents extending over a COMMISSION RESOLUTION NO. 1399 ,-- ,- .--..-- .~,._._. 37 period of seven years, but this shall not bc construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of sa~d Special Improvement District No. l.92, as authorized by law. Such bonds \vill be in denominations of. $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 492 Fund of the City of Bozeman. The bond s I will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are availahle for the purpose in said Special Improvement District No. 492. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a ratc not to exceed six percent (6%) per annum, vJhich interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, I 947 , and all other applicable provisionsof Title 11 of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns and any amendments thereof or thereto. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Hontana, on Thursday, the 13th day of February, 1969, at the hour of one o'clock p.m. of said day, is the time and place, when and \oJhere the City Commi.ssion will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District 492, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention.
