State of Hontana. held on the 18th day of December, 1968. the said Commission duly passed Commission Resolution No. 1395 declaring it to be the intent1.on of the said Commission to create a special improvement district to be knmvn and designated as Special Improvement District No. l}90 of the said City for the purpose of operating and maintaining a street lighting system to light Main Street (U.S.Highway 10) and a portion of the intersecting streets abutting between the West line of Wallace Avenue and the Cen- terline of Buttonwood Avenue, said lighting system to be installed and paid for by the State High- \vay Commission of the State of Montana and the M.ontana Power Company, all under the authority of and in conformity with Sections 11-22lf5 and 11-2257. inclusive, of the Revised Codes of M.ontana. 1947, which said Resolution of Intention is of record and on file in the office of the Clerk of said City Commission and open to the inspection of the public. and is hereby referred to for further particulars; and WHEREAS, due proof has been made that service of notice of the adoption of said Resolution No. 13QS was duly made and given as by law provided; and. HHEP-.EAS, at the time and place fixed in said Resolution No. 1395 for the making and filing of protests against the creation of said proposed Special Improvement Lighting District No. 490, to I Hit. at the hour of 1:00 o'clock p.m. on Wednesday, the 15th day of January, 1969. being a regular meeting time of said City Commission, at the Commission Chamber in the City Hall Building of the City of BozeTI'an. there were not sufficient protests made or filed against the creation of said Special Improvement Lighting District No. 490. NO\<J. THEREFORE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 T;wt ther.c~ he. and there is hereby created a special improvement district of the City of Bozeman to be known and designated as Special Improvement Lighting District No. 1+90. for the purpose of installing and maintaining a lighting system to Ught Main Street (D.S.Highway 10) and a portion of the intersecting streets abutting between the West line of Wallace Avenue and the Centerline of Buttonwood j\venue, sairl. light1.ng system to be installed and paid for by the State Highway Commission of the State of Montana and the M.ontana Power Company. all under the authority of and in conformity with Sections 11-2245 to 11-2257, inclusive. of the Revised Codes of M.ontana, 1947. pursuant to and in conformi ty 1",lth Commission Resolution No. 1395 of the Commission of the City of Bozeman, passed and adopted on the 18th day of December. 1968. which said Con~ission Resolution No. 1395 declares it to be the intention of said City Commission to create said Spec:i.al Improvement Lighting District I No. 490 for the purposes aforesaid, and \vhich said Commission Resolution No. 1395 is of record and on file in the office of the Clerk of said City Commission in the City Hall building, Bozeman. and is open to the inspection of the public, and is hereby referred to for further particulars. Section 2 That said Commission Resolution No. 1395 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 490, the COMHISSION RESOLUTION NO. 1397 - --'- .--.--.- d"..._ ..-- - .--- - - ~ ..-. -- ~.._- ~- 33 estimated cost of said improvements and the method of assessing the same against the property of said District. Section ') .) The character of improvements to be installed and paid for by the State Highway Commission of the State of Montana, is the erection and installation of six (6) t.OO Watt (20,000 lumen) ,. I Hercury-Vapor color corrected luminaires, mounted on Aluminum Alloy 6063-T6 poles with 15 foot brackets (moun I:i nr; heigh t 0 f ltud naire to be 40 fee t) and the erection and installation of two (2) 175 Watt (7,000 lumen) Nercury-Vapor color corrected luminaire;; I.E.S. Type III mounted on 30 foot high steel poles on the intersecting side streets to be installed and paid for by the Montana Power Company. Power for the six (6) 400 Watt (20,000 lumen) luminaires is to be supplied thru lmde rground conduits and power for the two (2) 175 Watt 0,000 lumen) luminaires is to be supplied by single overhead wiring in series. All installations shall be equipped with all necessary appliances for safe and proper operation of the system. Section 4 The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and nlaintenance cost of such lights only, which said operation and maintenance v! i 11 i 11 cl ud e t~1C furnishinp; of cJcctric CUYTent, all lamps as needed and the maintenance of poles, cables, and ather incidental items.
