BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:

Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create a special
improvement di.strict to be knmvn and designated as Special Improvement Lighting District No. 491
of the City of Bozeman for the purpose of operating and maintaining a lighting system to light
Main Street (U.S. Highway 10) between the centerline of Buttonwood Avenue and Highway Station
21+50.8 being the end of Main Street highway construction and beginning of Interstate 90.
Section 2
Boundaries
The boundaries of said Special Improvement Lighting District are described as follows:
Beginning at a point on the centerline of South Buttonwood Avenue ex-
tended northerly, said point lying 100 feet northerly of
the center-
line of East Main Street (being the centerl:Lne
of U.S. Highway No.
10); thence easterly parallel to and 100 feet distant northerly from
the centerline of said East Main Street thru a portion of Lot 13,
Block 30, Northern Pacific Addition,
across vacated North Cypress
Avenue, thru Lots 13 to 24 inclusive of Block 29. across vacated

Section 3
Character of Improvements
The character of improvements to be installed and paid for by the State Higlwlay CommissIon
of the State of Montana is the erection and installation of ten (10)

to be supplied thru under-
ground conduits and the installations shall he equipped with all necessary appliances for safe
and proper operation of the system.
Section !+
Estimate of Cost of Maintenance and Electrical Current and Hethod of Assessment.
An estimate of the cost of maintaining such lighting system and supplying current therefor
is seven and 51/100 Dollars ($7.51) per unit month for the 1,000 Watt
(5L~.000 lumen) fixtures
or a total Sum of Seventy-five and 10/100ths Dollars ($75.10) per month
and $901.20 per year of
which total seventy-five percent (75%), or Six Hundred Seventy-five and 90/100
Dollars ($675.90)
plus an administration cost of $8.80 per year or a total sum of $684.70 is to be assessed again-
st the property within the district based on a front foot frontage on the improvement and
twenty-
five percent (25%) or $225.30 is
to be paid by the City of Bozeman.
Section 5
Actual Front Foot of District
The actual frontage of the property within said proposed Special Improvement Lighting District
No. 491 is 4168.95 linear feet, which is the frontage figure on which all protests will be received,
I considered and determined and on which the assessment of costs will be based.
The estimated rate
of asseSSment per year per front foot of the property within the district is $0.1642379975 cents
per front foot.
Section 6
Payment
The proposed Special Improvement Lighting District \"ill be established for the purpose of
paying the operating and maintenance cost of such lights only, which said operation and maintenance
i-Jill include the furnishing of electric current, all lamps as needed
and the maintenance of poles,

cables and other incidental items. The entire cost of construction and installation shall be
borne by the Montana State Hie;hway Commission.
Section 7
Protests and Notice
That the regular session of the City Commission of the City of Bozeman. to be held at the
Commission Chamber. City Hall Building. Bozeman. Montana. on Hednesday. the 15th day of January

1969. at the hour of one o'clock p.m. of said day. are the time and place when and where the City
Commission will hear and pass upon all protests duly and regularly made and HIed against the
creation of said proposed Special Improvement Lighting District No. 491. the improvement proposed
to be made pursuant thereto and the cxtent and character thereof. or either thereof; and the Clerk
of the City Commission be. and she is hereby directed to give notice in the manner and for the
time as by la,,, required. of the adoption of this ResoluUon of Intention.

NOTICE IS HEREBY GIVEN that on the 18th day of December. 1968. at a regular meeting of the I

was passed and adopted.
That vJcdnesday. the 15th day of January 1969. at one o'clock p.m. at the Commission Room
of the City Hall. Bozeman. Montana. is designated by said Resolution No. 1396 as the time and
place for hearing objections to the action proposed to be taken by said resolution. and when and
where any and all persons whose property is \oJithin said proposed Special Improvement Lighting Dis-
trict No. [j91 may appear and sho", cause. if any they have. against said proposed improvement.
Objections must be made in \oJriting and filed \vith the Clerk of the City Commission not later than
fifteen (15) days after the date of thc first publication of this notice.
That the general character of the improvement to be made in said Special Improvement Lighting
District No. l;-91 and paid for by the State Highway Commission of the State of Hontana is the erection I
and installation of ten (10) 1.000 Hatt (Slf.Om lumen) Mercury-Vapor color corrected luminaires mounted
on Aluminum Alloy 6063-T6 poles ~vith 12 foot brackets (mounting height of luminaire to be 45 feeO
Power for the ten (10) 1.000 Hatt (54.000 lumen) luninaires is to be supplied thru underground con-
duits and the installations shall be equipped with all necessary appliances for safe and proper
operation of the system.
An estimate of the cost of maintaining such lighting system and supplying current therefor is

$7.51 per unit month for the 1,000 Watt (54,000 lumen)
fixtures or a total sum of $75.10 per month
and $901.20 per year of which total 75%, or $675.90 Plus an administration cost of $8.80 per
year

front foot frontage on the improvement and 25% or $225.30 is to be paiel by the City of Bozeman.

For a description of the boundaries of said Special Improvement Lighting District No. 491
reference is hereby made to Resolution No. 1396 of the Commission of the City of Bozeman declarinr,
the intention to create said District, which is on file in the office of the undersigned Clerk of
said Commission in the City Hall of said City of Bozeman, State of Montana,
and open for inspect-
ion to all interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montanat
19!f 7.
