(,.90 FOR THE PURPOSE OF OPERATING AND MAIN- TAINING A STREET LIGHTING SYSTEM TO LIGHT MAIN STREET (U.S. HIGH- WAY 10) AND A PORTION OF THE INTERSECTING STREETS ABUTTING BETwEEN TIm \vEST LINE OF \\TALLACE AVENUE AND THE CENTERLINE OF BUTTom'JOOD A VENUE. I BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to Create a special improvement district to be known and designated as Special Improvement Lighting District No. 490 of the City of Bozeman for the purpose of operating and maintaining a lighting system to light Hain Street (U.S.Highvwy 10) and a portion of the intersecting streets abutting between the vlest Line of Wallace Avenue and the Centerline of Buttonwood Avenue. ~ Section 2 Boundaries. The boundaries of said Special Improvement Lighting District are described as follows: Beginning at the southeasterly corner of Lot 1 of Block E, Rouse's Addition to Bozeman, Hontana; thence northerly along the easterly line of said Lot 1 a distance of 100 feet; thence easterly parallel to and 100 feet distant northerly from the northerly streot line of Main Street being also the northerly line of U.S. Highway No. 10, across North Wallace Avenue, thru Lots 1 to 14 inclusive of Block D of Rouse's Addition, aC1.~OSS Nortb Ida Avenue, thru an unnumbered tract lying east of Ida Avenue, and thru Block 12 of McAdow's Addition of Block 31, Northern Pacific Addition across North I Broadway Avenue, along the north line of Lot 9 and thru a portion of Lot 13 of Block 30 of Northern Pacific Addition to a point of intersection with the centerline of South Buttonwood Avenue e~tcnded northe rly; thence souther!: along said extended centerline of Sou th Buttonwood Avenue, across East Main Street and along the centerline of South Duttonwood Avenue to a point on said centerline 100 feet southerly of the southerly street or right of way line of Main Street being U.S. Highway No. 10; thence westerly parallel to and 100 feet distant southerly from the southerly street line of said Main Street being the southerly line of said U.S. Highway No. 10, across t\w \vcsterly one-.ha1f of ButtoTI\vood Avenue, ac I'OS S the westerly portion of Lindley Park, across various unplatted tracts, vacated Ida Avenue and thru lots 1 to 14 inclusive of Block C, Rouse's Addition; thence across sot1th\~allace Avenue to the easterly line of Block B of said Rouse's Addition; thence northerly along the easterly line of said Block B, being also the westerly line of South Wallace Avenue and across Main Street to the Southeast corner of Lot 1, Block E, Rouse's Addition being the point of beginning. Containing within the above described exterior boundaries the fo11O\>]- ing lots, blocks, tracts and parcels of land, to -wi t : Portions of Lots 1 thru 14, inclusive of Block D of Rouse's Addition. ~ortion of an unplatted tract of land lying westerly of and between Ida Avenue and Block 12 of NcAdmv' s Add Hion. Portion of Block 12, McAdow's Addition. All of Lots 9, 10, 11, 12 and a portion of Lot 13 of Block 30, Northern Pacific Addition. Portion of Lindley Park Portion of unplatted tracts of land south of Main Street lying between vacated Ida Avenue and Lindley Park. Portion of vaea ted Ida Avenue and Mihv8ukee Railroad right of way. Portion of lots 1 thru 14 inclusive of Block C, Rouse's Addition. Section 3 Character of Improvements. The character of improvements to be installed and paid for by the State Highway Commission of the State of 1'1ontana, is the erection and installation of six (6) 400 Watt (20,000 lumen) COMl'lISS ION RESOLUTION NO. 139.5 - - 25 Mercury-Vapor color corrected luminaires, mounted on Aluminum Alloy 6063-T6 poles with 15 foot brackets (mounting height of luminaire to be 40 feet) and the erecetion and installatin of two (2) 175 Watt (7000 lumen) Mercury-Vapor color corrected luminaires r.E.S. Type III mounted on 30 foot high steel poles on the intersecting side streets to be installed and paid for by the Mont- ana Power Company. Power for the six (6) 400 Watt (20,000 lU1:llcn) luminaires is to be supplied I thru underground conduits and pm.;rer for the two (2) 175 Watt (7000 lumen) luminaires is to be supplied by single overhead wiring in series. All installation shall be equipped with all necessary appliances for safe and proper operation of the system. Section !4. Estimate of Cost of Maintenance and Electrical Current. and Method of Assessment. An estimate of the cost of maintaining such lighting system and supplying current therefor is $3.53 per unit month for the 400 Watt (20,000 lumen) fixtures and $3.70 per unit month for the 175 Watt (7000 lumen) fixtures on the intersecting streets or a total sum of $28.58 per month or $342.96 per year of which total scventyfive percent (75%) of $257.22 plus $7.04 administration costs or a Sum of $264.26 is to be assessed against the property within the district on a front foot basis and tHenty-five (25%) or $85.74 is to be paid by the City of Bozeman. The estimated rate of asseSsment per year per front foot of the property Hithin the district is $0.15748510103 cents per front foot. Section 5 Actual Front Foot of District The actual frontage of the property within said proposed Special Improvement Lighting District I No. !f90 is 1678 linear feet, which is the frontage figure on which all protests will be received, cons fdered and de te rmi ned . It is also the figure on which all assessments will be figured. Section 6 Payment The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only, which said operation and mainten- ance will include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables and other incidental items. The entire cost of construction of such lights shall be paid by the Hontana State Highway Commission and Montana Power Company. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on W~dnesday, the 15th day of January, 1969, at the hour of one o'clock p.m. of said day, are the time and place when and where the City Commission wil1 hear and pass upon all protcsts duly and regularly made and filed agains t the creation of said proposed Special Improvement Lighting District No. 490, the improvement proposed to be made pursuant there to and the extent and character thereof, or either thereof; and the Clerk I of the City Commission be, and she is hereby directed to give notice in the manner and for the time as hy laH required, of the adoption of this Resolution of Intention. NOTICE IS HEREBY GIVEN That on the 18th day of December, 1968, at a regular meeting of the Commission of the City of Bozeman, Commission Resolution No. 1395 entitled: I A RESOLUTION OF TIlE COMMISSION OF TIlE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE SAID COMMISSION TO CREATE A SPECIAL IMPRO~~MENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT LIGHTING DISTRICT NO. 490 FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT MAIN STREET (U.S. HIGlfJAY 10) AND A PORTION OF THE INTERSECTING STREETS ABUTTING BETWEEN THE WEST LINE OF WALLACE AVENUE AND THE CENTERLINE OF BUTTOmvOOD AVENUE. was passed and adopted. That Wednesday, the 15th day of January 1969, at one o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by said Resolution No. 1395 as the time and place for hearing objections to the action proposed to be taken by said resolution, and when and where any and all persons whose property is within said proposed Special Improvement Lighting District No. 490 may appear and show cause, if any they have, against said proposed improvement. Object- ions mllst be made in writing and filed with the Clerk of the City Commission not later than fi fteen (15) days after the date of the first publication of this notice.
