IW3TflLLING AND/OR REPAIRING MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YE1\R 1968. WHEREAS, the Commission of Tne City of Bozeman, pursuant to tne provisions of Chapter 9.36 of I the Bozeman Munic:i.pal Code and of Section 11-2226, Politioal Code, R.C.M.~ 191.t7, provide for the construotion of sidewalks and curbs in tre City of Bozeman during the year 1968, without the formation of Special Improvement District; WHEREAS, proceedine:s were had for the construotion and :1.nstallation a.nd/or repair of Miscel- laneous Sidewalks and r:urbs in the City of Bozeman for the year 1968, and WBF;REPS, miscellaneous Sidewalks and Curbs were cons~ructed and installed and/or repaired bordering on various properties in the City of Bozeman, pursuant to Chapter 9.36 of the Bozeman Hunicipal Code and the provisions of Section 11-2226, Politioal Code, R.C.M.~ 191-1-7, which are hereby referred to and made a part of this Resolution, and \l'fI1:EREAS, tne Miscellemeous Sidewalks end Curbs have been constructed and completed andJor repaired in accordance with the terms and conditions of said proceedings, and the City Engineer has duly certified to the Commission 8 Schedule showing the sidewalks and curbs which have been constructed and installed and/or repaired, and the properties which are subject to assessment there- under and the total cost of said construction and installation and/or repairing is the sum of ~ Hundred Thirty-Three & 95/100ths ($lt33 .95) Dollars, which Soneduls, marked Sohedule nAif is hereto attached and made a part hereof. That to defra.y the cost of constructing and installing and/or repairing Miscel- laneous Sinewa.lks and Curbs as set forth in Schedule "A" hereto attr.ched and made a part hereof, there is hereby levied and assessed a.tax amount of F'our Hundred Tnirty-Three and 95/100ths ()~L~33.95) dollars. Section 2. That a particular description of each lot and parcel of land with the name of the owner and t.ne sum assessed ap;ainst him or it; for such construction and installation and/or repair and the amount of each payment to be made and the day when the same shall become delinquent is set forth in the assessment list horeto attached marked Scnedule "A" and made a part hereof; that the several sums set opposite tne name of the owner and the description of the lots and parcels of land be, and the same are hereby respectively levied And assessed upon said lots and parcels of land to defray the cost and expense of constructing; and instn111n:,; and/or repairing Sidewalks and Curbs; that the several sums so assessed be collected from the respective oWners of said lots and parcels - of lend described in said assessment list as required by law; tnet the payment of SHid sums shall be made in five installments; that the p",-yment of said installments shell be made on or before the 30th day of November of each year until pa;rment of all installments together with the interest - thereon, snaIl be made; that seid sums shall be paid and t.he collection thereof shall be made in the manner find in accord(\Dce with the law governing the collection of Special Improvement Taxes; that failure to pay such assessment when tne same sh811 become due and payable shall make such persons and said lots and parcels of land liable to I:;he penalties provided by law relati va to delinquent taxes. Section 4. That the Clerk of the Commission of the Cit.y of Bozeman, be and she is hereby I. ordered and directed to publish in the Bozeman Dail. y Chronicle, a daily newspaper printed and published in the said City of Bozeman, a notice sl!';ned by the Clerk of the Commission and stating the:t Ii Resolution levying and assessing a special assessment of taxes to defrey the cost ana expenses of constructing and installin<r and/or repairing Sidewalks find Curbs in the City of Bozeman for tne year 1968 is on file in the office of the Clerk of the Commission subject to inspeotion for a period of five (5) days; that said Notice shall state the time and place at which objections will be henrd by the Commission to the finel adoption of this :lesolution; that it shall be published at least five (5) days before the date set by the Commission for the hearing of ob,4ections and the final adoption of this Resolution.
