A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A -) ) SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 479 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAIN- TAINING A STREET LIGHTING SYSTEM TO LIGRl'MAIN STREET (U. S. HIGHWAY 191) AND A PORTION OF THE INTERSECTING STREETS ABUTTING BETWEEN SOUTH EIGHTH AVENUE AND THE WESTERLY CITY LIMITS BEING THE EASTERLY ONE-SIXTEENTH LINE I OF SECTION 12, TOWNSHIP 2 SOUTH, RANGE 6 EAST, M.M. ----...- WHEREAS, at a regular session of the Commission of the City of Bozeman. State of Montana. held on the 18th day of September. 1968. the said Commission duly passed Commission Resolution No. 1387 declaring it to be the intention of the said Commission to create a special improvement district to be known and designated as Special Improvement District No. 479 of the said City for the purpose of operating and maintaining a street lighting system to light main street (U.S. High- way No. 191) and a portion of the intersecting streets abutting between South Eighth Avenue and the westerly city limits being the easterly one-sixteenth line of Section 12. Township 2 South. Range 6 East. M.M., said lighting system to be installed and paid for by The Montana Power Company, all under the authority of and in conformity with Sections ll~224S and 11-2257 inclusive. of the Revised Codes of Montana, 1947. which said Resolution of Intention is of record and on file in the office of the Clerk of said City Commission and open to the inspection of the public, and is here~ by referred to for further particulars; and WHEREAS, due proof has been made that service of notice of the adoption of said Resolution No. 1387 was duly made and given as by law provided; and WHEREAS. at the time and place fixed in said Resolution No. 1387 for the making and filing of I protests against the creation of said proposed Special Improvement Lighting District No. 479, to- wit at the hour of 1:00 o'clock p.m. on Wednesday, the 9th day of October. 1968, being a regular meeting time of said City Commission, at the Commission Chamber in the City Hall Building of the City of Bozeman, there were not sufficient protests made or filed against the creation of said Special Improvement Lighting District No. 479. NOW, THEREFORE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 That there be. and there is hereby created a special improvement district of the City of Bozeman to be known and designated as Special Improvement Lighting District No. 479, for the purpose of installing and maintaining a lighting system to light Main Street (U. S. Highway No. 191) and a portion of the intersecting streets abutting between South Eighth Avenue and the westerly city limits being the easterly one-sixteenth line of Section 12, Township 2 South. Range 6 East, M.M., said lighting system to be installed and paid for by the Montana Power Company, all under the authority of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the Re- vised Codes of Montana, 1947, pursuant to and in conformity with Commission Resolution No. 1387 of -- the Commission of the City of Bozeman, passed and adopted on the 18th day of September, 1968, which said Commission Resolution No. 1387 declares it to be the intention of said City Commission - to create said Special Improvement Lighting District No. 479 for the purposes aforesaid, and which said Commission Resolution No. 1387 is of record and on file in the office of the Clerk of said City Commission in the City Hall Building, Bozeman, and is open to the inspection of the public, and is hereby referred to for further particulars. COMMISSION RESOLUTION NO. 1392 18 , Section 2 That said Commission Resolution No. 1387 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 479, the estimated cost of said improvements and the method of assessing the same against the prop- erty of said district. I Section 3 The character of the improvement to be installed and paid for by The Montana Power Company is the erection and installation of 38- 400 Watt (20,000 lumen) Mercury-Vapor color corrected luminaires, I.E.S. Type III mounted on 30 foot high steel poles on Main Street and 12- 175 Watt (7,000 lumen) Mercury-Vapor color corrected luminaires I.E.S. Type III mounted on 30 foot high steel poles on the intersecting side streets. Power is to be supplied in series by a single uninsulated overhead wire and the installation shall be equipped with all necessary appliances including automatic circuit breakers for the safe and proper operation of the system. Sec tion 4. The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only, which said operation and maint- enance will include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables, and other incidental items. The entire installation cost of such lights will be borne by The Montana Power Company. The portion of the cost of maintenance and electrical current payable by the City of Bozeman will be paid directly by the City of Bozeman and the portion to be assessed against the property within the district will be assessed and paid annually I as provided by law.
