and thereafter, after due a.nd legal proceedings had, the Commission of The City of Bozeman did on
the 11th day of May, 1966, duly pass Commission Resolution No. 1266, entitled:

which Commission Resolution Nos. 1262 and 1266, passed as aforesaid, are hereby referred to and
mede a part of this resolution for further particuhtrs in respect to the boundaries of said
district, the character of improvement to be constructed therein, the estimated cost of said
improvements and the method of assessing the cost af:,Binst the property within said di.strict; and
I Vffi/i:H.EAS. said improvements as contemplated in shid Commission Resolution Nos. 1262 and 1266
have been constructed end completed in accordance with the terms and conditions of Comission
Resolution Nos. 1262 and 1266, and the total cost of said improvements so const.ructed is tl1e sum
of THIHTY-TlffiEE TBOUSAND AND NOjlOOths ($33,000.00) dollars.
NOW, Tm:REF'ORE, pursuant to -the provisions of Sections 1l-?201 to 11-2273 and 11-3301, R.C.M.,
19h7 and amendments thereto.
BE IT RESOLVED nm IT IS HERF:BY ORDE'mm BY THE Cmnv'ISSION OF THE CITY OF BOZF:f\.ffAN,
STATE OF MONTANA:
Section 1. That to defrav the cost and expense of constructing and makine; the improvements
in said Special Improvement No. h86, there be, and thereis nereb~r levied and assessed a tax amount in!:
to the sum of TFIR'rY-THREF: THOn<:;!,t.m AND twj166ths ($33,000.00) Dollars, upon all the property in
said Special Improvement. Dist.rict No. L\.86, and the estimated assessment of 33,000.00 reported on
'None, hereby abated, and that. a particular description of each lot and parcel of land with the
name of the owner and tl1e sum assessed ap:ainst him or it for such improvements and the amount
of each partial payment to be made and the day when the seme shall be delinquent is set forth in
detail in the assessment list hereto attached, marked Schedule "A", and made a part hereof; that
I t.he several sums set opposite the names of the owners and the described lots and parcels of land
be, and the seme are hereb:" respectively levied and assessed upon and against said described lots
and parcels of land to defray the cost and expense of constructing and making the improvements
within said District; that the several IUnl$ so assessed be collected from the respective owners of
said lots and parcels of land described in said assessment list, Schedule "A", a.s required by
law; that the payment of said sums shall be made in 20 installments and the payment of said install-
ment shall extend over a period of 19 years; thet the payment of the respective annual installment

shall be made on or before the 30th day of November of each year until payment of 811 install.

collection thereof shall be made in the manner and in eccordance with the law governin.g the
collection of special improvement taxes; that failure to pay such assessments when the same
become due and payable shall make such persons and said lots and parcels of land liable to
the penalties provided by law relative to delinquent tax~s.

Section 2. That the rer;ula.r session of the Corranission of The City of Bozeman to be held
in the Commission Chamber in the City Hall of said City on the 9th day of October, 1968~ at
1:00 o'clock p.m., be, and the same is hereby designated as the time and place at which ob,jections
to the final adoption of this Resoluti.on wi.ll be heard by said Commission.
Section 3. Thet the Clerk of the Commission of The City of Bozeman be, and she is hereby
ordered and directed to pnblish in the Bozeman Daily Chronicle, a da:i.ly newspaper printed and
published in the said City of Bozeman, a notice signed by the Clerk of the Commission and stating
that a Hesolution levying and assessing a specia.l assessment of taxes to defray the cost end
expense of conshructing and making the improvements in the said Special Improvement District No.
Lt86 is on file in the office of the Clerk of the Commission subject to inspection for a. period of
five (5) days; that said Notice shall state the time and place at which objections will be heard
by the Commission to the final adoption of this Resolution; that it shall be published at least
five (5) days before the day set by the Commission for the hearing of objections and the final
adoption of this Resolution.
Provisionally passed and adopted by the Commission of The City o~ Bozeman at a regular
session thereof held on the 2nd Day of October, 1968.

NOTICE IS m:R.EBY GIVEN, that at a regular session of t.re Commission of The City of Bozema.n
held on the 2nd da.y of October, 1968~ Commission Resolution No. 1390 was provisionally passed

and adopted; thet sf'-id Commission Resolution levies and assesses a special assessment of taxes
upon all the property in Special Improvement District No. 470, in seid City, to defray the cost
and expense of constructing and makinp; the improvements within said District, to-wit:
Beginning at the Northwest corner of Section 12~ being the corner common to
Sections 11 and 12 of Township 2 South, Range 5East, M.P.M., thence South
88.09'23" West along the northerly line of said Section 11 a distance of
1353.42 feet; thence South 0.09'53" West a Distanoe of 2670.81-1- feet to the
southwest corner of the SE-~;-NE% of said Section 11; thence North 88.17'23"
East along the southerly line of s e.id SE.:!--N~- also being the centerline of

West Babcook Street a distance of 1135.86 feet to the one-quarter corner
common to Sections 11 Elnd 12; thence North 88.1..\.3'LI4" East along the southerly

Fifteenth Avenue to the northorly line of the said Section 12, being the
centerline of Durston Road; thence westerly along the northerly line of

That, said Commission Resolution No. 1390 is now on file in the office of the Clerk of the
Commission, subject to inspection for a period of five (5) days by any persons interested. That
Wednesday tne 9th day of October, 1968, at 1:00 o'clock p.m., of said day at the recular session
of the said Commission of The City of Bozeman, at the Commission Room, in the City Hall Building
of said City, has been designated as the time and place where the said Commission will hear and
pass upon any and all objections that may be made to the final passage and adoption of said
Resolution No. 1390, and the levying of said assessment, and that said Resolution will be
finally pass ad and a.dopted at said regular seas ion.
All p~rsons interested are referred to Commission Resolution No. 1262, declaring it to be
the intention of the Conunission to Create Spf'ICia1 Improvement District No. h70, and Commission
Resolution No. 1266 creating Special Improvement District No. 470, for constructing and making
the improvements therein.
