COlJNTY OF GALIJ'TIN, STi,TE OF MONTANA, TO DEFRAY THE COST OF CONStRUCTING AND .,- INSTP,LLING AND/OR REPAIRING MISCELLANEOUS SIDEWALKS AND CURBS DURING THE YEAR 1968. WH~~EAS. the Commission of The City of Bozeman, pursuant to the provisions of Chapter 9.36 of I thl'.) Bozeman Tv1unicipal Code and of Section 11-2226, ~olitjcal Code, R.C.~,1., 19h7, provide for the construction of sidewalks and curbs in the City of Bozemen durinlj the year 1968, wi!~hout the f'ormat;j.on Speci€\l Improvement District; WlfEREAS, proceAdinp;s were had for the construction and installation and/or repair of Mis- cellaneous Sidewalks and Curbs in the City of Bozer.wn for the year 1968, and ~1:EREAS, miscellaneous Sidewalks and Curbs were constructed and installed and/or repaired bordering on various properties in tne City of Bozeman, pursuant to Chapter 9.36 ofbhe Bozeman T\iunicipal Code and the provisions of Section 11-2226, Political Code, R.e.M., 1947, which are hereby referred to end made a part of this Resolution, and VmER['~I\S, the Miscellaneous Sidewalks and Curbs have been constructed and completed and/or repaired in accordance with the terms and conditions of said proceedings, and the City Ene;ineer has duly certified to the Commission a Sohedule showing the sidewalks and curbs which have been constructed and installed and/or repaired, and the properties which are subjec.t to aSs essment thereunder and the total cost of said construction and installation and/or repairing is the sum of Sixty-Nine Hundred Fifty-Six and 2O/100ths Dollars,(ti6,956.20) 1IVhich Schedule, marked Schedule "A" is hereto attached and made a part hereof. That to defray the cost of constructing and installinE; and/or repairing Hiscellaneous 'jidewnlks and Cud)!:. as set forth in301H!dule "A", hereto e.ttaohed and made a part hereof, there is herebv levied and essessed a tax amounting to the sum of Sixty-Nine Hundred Fifty-Six and 20/100 Dollars ($6,956.20). Section 2. That a particular description of each lot and parcel of land with the name of the owner 8.nd the sum assessed Ai';ainst him or it for such construction and installation end/or repair and the amount of' each payment to be made and the day when the same shall become delinquent is set forth in\:;he assessment list hereto attached marked Schedule "All and me.de a part hereof; that the several sums set opposite the name of the owner and the description of the lots and parcels of land be, and tne same are nereby respectively levied and assessed upon said lots and parcels of land to cefra;! the cost and expense of constructing and installing and/or repairing said Sidewalks and Curbs; t.hat the several sumS so assessed be collected from the respective owners of said lots "-,-nd parcels of lend described in snid assessment list as required I by law; that the payment of said sums shall be made in five installments; that the payment of said installments shall be made on or before the 30th day of November of ee.ch year until payment of all installments tOGether with the interest thereon, shall be made; thE\t said sums shall be paid snd the collection thereof shall be made in the manner nnd in accordance with the law governing; the collection of Special Improvement Taxes; thst failure to pay such assessments when the same shall become due and payahle shall make such persons and said lots end parcels of land liable to the penalties pro'Vided by law relative to delinquent taxes. That the regular session of the Commission of the City of Bozeman to be held in the Commission Chamber in the City Hall of sHid City on the 2nd day of October, 1968, at 1 :00 0' clock p.m., be, and the same is hereb~r des iEnated as the time and place at which ob,jections to the final adoption of this resolution will be heard by said Commission. Section LI. That the Clerk of the Commission of the City of Bozeman, be and she is hereby ordered and directed to publish in the Bozeman Daily Chronicle. a daily newspaper printed a.nd I published in the said Cit;' of Bozeman. a notice signed by the Clerk of the Commission and stating that a Resolution levying and assessinr: a special assessment of taxes to defray the cost and expenses of oonstructinr; and installing and/or repairinr;, Sidewalks and Curbs in the City of Bozeman for the year 1968 is on file in the office of t.he Clerk of the Commission subject to inspection for a period of five (5) days; that said Notice shall state the time and place at which objections will be heard by the Commission to the final adoption of this Resolution; that it shall be published at least five (5) days before the date set by the Commission for the hearing of ob- jections end the final adoption of -t;his Resolution. NOTICE IS HEREBY GIVEN, that during a regular sess ion of the Commission of the City of Bozerm. n held on Wednesday, the 25th day of September, 1968, Commission Resolution No. 1388 Was provisionally passed and adopted; that said Commission Resolution levies and assesses a special assessment of taxes upon certain lots and parcels of land in front, or on the side of which sidewalks a.nd ourbs have been construoted and/or repaired pursuant to the provisions of Chapter 9.36 of the Bozeman Municipal Code and of Section 11-2226, Political Code, R.C.N., 19L~7 ,to defray the cost and expense of constructin{\ and installing and/or repairing said Sidewalks and Curbs. I That said Commission Resolution is now on file in she office of the Clerk of the Conunission, subject to inspection for a period of five (5) days by Bny persons interested.
