THE REVISED CODES OF MONTANA, 1947.
~~EREAS, there has been filed with the Clerk of the Commission of the City of Bozeman, Montana,
a petition in du.e form of certain property owners on Main Street and a portion of the intersecting
streets abutting between South Eighth Avenue and the Westerly City limits, asking that a special
ir:,provement lighting district be created for I:;he purpose of operating and maintaining a light-
ing system to light the hereinbefore streets and avenues in the City of Bozeman, Gallatin
County, Montana.
WHERBAS, at a regular meeting of the City Commission of the City of Bozeman held the 18th day
of September, 1968, the aforesaid petition was respectively considered and granted;
NOW, THb'REFORE, BE: IT RESOLVED BY THE CITY CONiMIS8ION OF THE CITY OF BOZEJI,ffiN:
Section 1
Deolaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create a special
improvement distric-t; to be known and designated as Special Improvement Lighting District No. L~79
of the City of Bozeman for the purpose of operating and maintaining a lighting system to light
I Main Street and a portion of the intersecting streets abutting between South Eighth Avenue and
the westerly city limits.
Seotion 2
Boundaries
The boundaries of said Special Improvement Li~hting District are described as follows:
Beginning at the point of inter~cction of the centerlines of South Eighth
Avenue and West Main Street (U.S. 191) ; thence westerly along the centerline
of West Main Street (U.S. 191) a distance of fortY-four feet (1-14'); thence
northerly a distance of forty-five feet (45') to a point on the northerly
right of way of West Main Street (U.S. 191) said point also being ten feet
(10') easterly from the southwest corner of Lot 11, Block 2, Springbrook
Addition to the City of Bozeman; thence continuing northerly, parallel to
and ten feet (10') distant easterly from the west lot line of said Lot 11
to a point on the north lot line of said Lot 11 said point also being one
hundred seventy-five feet (175') northerly from the centerline of West
Main street (U.S. 191); thence westerly parallel to and one hundred seventy-
five feet (175') distant northerly from said centerline to the easterly
one sixteenth (1/16) line of Section 11, Township 2 South, Range 5 East,
M.M.; thence southerly along said one-sixteenth (1/16) line to a point, said
point also beinr one hundred seventy-five feet (175') perpendicular distance
from the centerline of West Main Street, (U.S. 191); thence easterly
parallel to and one hundred seventy-five1(175') distant southerly from said
centerline to the centerline of South Eighth Avenue; thence northerly
along the centerline of South Eighth Avenue a distance of one hundred
seventy-fi ve feet (175') to a point on the centerline of West Vain Street
(U.S. 191) said point being the point of beginning.
I Containing within the above described exterior boundaries the following lots, blocks
and trects of land, to-wit:
West 10 feet of Lot 11, Lots 12 - 18, Block 2, Springbrook Addition.
Lots 7 - 18, Block 3, Springbrook Addition.
Lots 7 - 13, Block 4, Springbrook Addition.

Character of Improvements
The Charl'.\cter of the improvements to be installed and paid for by the Montana Power Company
is the erection and installation of 38 - 400 Watt (20,000 lumen) Mercury-Vapor color corrected
luminaires, I.E.S. Type III mounted on 30 foot high steel poles on Pain street and 12 - 175
watt
(7,000 lumen) 1,~ercury-Vapor color corrected luminaires I.E.S. Type III mounted on 30 foot high
steel poles on t'he interse~ting side streets. Power is to ba supplied in series by a
single I
uninsuleted overhead wire end the installation shell be equipped wit'h all necessary appliances
includinp: automatic circuit breakers for the safe and proper operation of the system.
Section 4
Estimate of Cost of Ne.intenance and
Electrical current and Methoa of Assessment
An estimate of the cost of maintaining such lir-:hting system and supplying currentthereforo
is six and 38/100 Bollars (~6.38) per unit month for the 20,000 lumen fixtures and 'Chree end
70/100 Dollars (~3.70) per unit month for the 7,000 lumen fixtures, or
a total Sum of Three
Thousand Four Hundred Forty-two and 08/100 DollArs (~3,IJ~2.08) per year of which total seventy-
five percent (75%), or Two Thousand Five Hundred Eighty-one and 56/100 Dollars (~2,58l.56) is to
be assessed against the property within the district on a front foot besis and twenty-five peroent
(25%) or Eip;ht Hundred Sixty and 52/100 Dollers (~860 .52) is to be paid by the Cit~' of Bozeman.
The estimated rate of assessment per year per front foot of t'he property wH',hin the distriot is

Actua.l Front Footage of District

The actual frontage of the property within said proposed Special Improvement LiGhting
District T'Jo~ )179 is 9h31+.19 linear feet, which is the frontage fi[';ure on which all protests will
be received, considered and determined.
Section 6
Payment
The proposed Special Improvement Lighting Distriot will be established for the purpose orpaying
the operatin~ and maintenanoe cost of suoh lights only, which said operation and maintenanoe will

include the furn:i.sh:inp' of' elentric current, all lamps as needed and the maintenance of poles, cables
and other incidental items. The entire cost of installation of such lights will be borne by the
Montana Power Company.
Section 7
I Protests and Notice
That the rep;ular session of the city Commission of the City of Bozeman to be held at the Com-
mission Chamber, City Rall Building, Bozeman, Montana, on 'Nednesday, the 9th day of October, 1968,
at the hour of one o'clock p.m. of said day, are the time and place when and where the City
Commission will hear and pe.RS upon all protests dul;/ and regularly made and filed against the
creation of said proposed Special Improvement Lighting District; No. h79, the improvement proposed
to be made pursuant thereto and the extent and character thereof, or either thereof, and the Clerk
of the City Commission be, and she is hereb~r directed to give notice in the maJ>ner and for the
time as by 18w required, of the adoption of this Resolution of Intention.
Adopted by the Commission of the City of Bozeman, Montana, at a regular and stated session of
said Commission held on the 18th day of September, 1968.

That Wednesd.ay, the 9th dRY of October, 1968, at one o'clook p.m. at the Commission Room of
the City Hell, Bozeman, Montana, is desip;nal;ed b~l said Resolution No. 1387 as the time and place
for hearing objections to the action proposed to be taken by said resolution, and when and where
any and all persons whose property is within sbid proposed Special Improvement Lighting Distriot
No. 479 may appear and show oause, if a.ny they have, against said proposed improvement. Objections
I must be made in writing and filed with the Clerk of the City Commission not later than fifteen
(15) days after the date of the first publication of this notice.
That the general character of the improvement to be made in said Special Improvement Ligh ting
District No. L~79 is the erection and installation of 38 - 400 Watt (20,000 lumen) Mercury-Vapor
color oorrected luminaires, I.E.S. Type III mounted on 30 foot high steel poles On Main Street
and 12 - 175 Watt (7,000 lumen) Mercury-Vapor color corrected luminaires LE.S. Type III mounted
on 30 foot high steel poles on the intersectinE side streets. Power is to be supplied in series

estimated rate of assessment per year per front foot of the property within the district is
278303526 cents per front foot.
The proposed Special Improvement Lighting Distriot will be established for the purpose of
paying the operating and maintenance cost of such lights onl>', which said operation and main-
tenanoe .il1 inolude the furnishing of electric current, all lamps as needed and the maintenance
of poles, cables, and other incidental items. The entire cost of the installation of such
lights
will be borne by the Hontane. Power Company.
For a description of the boundaries of sf'id Special Improvement District No. J--\.79 referenoe
is hereby made to Resolution No. 1387 of the Commission of the City of Bozeman declaring; the
intention to create said District, which is on file in the office of the undersigned Clerk of said
Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection
to all interested parties and ~he public generally.
This notice is given pursuant to the provisions of section 11-2204, Revised Codes of Montana., I
19!~ 7 .
