SUBJECT: Resolution 4504 adopting the previously approved P13025 Oak Meadows
growth policy amendment, a resolution amending Figure 3-1 of the
Bozeman Community Plan to change the Future Land Use Map
designation from Residential to Community Commercial Mixed Use for 3.877 acres of property.

SUGGESTED MOTION: “The City Commission having previously heard and considered
public testimony, the materials presented in the application, and the review criteria for amendment of the growth policy, and having directed the preparation of a resolution to
implement the previously approved application P13025 I move to adopt Commission Resolution
4504.”
BACKGROUND: On July 24, 2013, the City received an application to amend Figure 3-1, the future land use map, in the Bozeman Community Plan for property located south of Oak Street
between 12th and 14th Avenues. The original application requested a land use designation of
Regional Commercial on 5.74-acres. Based on Staff and Planning Board comments the
applicant modified the request reducing the affected area to 3.523-acres and requesting a land
use designation of Community Commercial Mixed Use prior to the public hearing on January 13, 2014.
The City Commission conducted a public hearing on January 13, 2014, to consider the
application. After consideration of the matter the City Commission unanimously approved
application P13025 subject to two contingencies and directed Staff to draft an implementing
resolution.
The attached resolution 4504 implements the January 13, 2014 initial approval of the application.
UNRESOLVED ISSUE(S): None.

FISCAL EFFECTS: No immediate fiscal impacts are expected from this action. Future development will generate both costs and revenues dependent on the nature of the development.

COMMISSION RESOLUTION NO. 4504
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING FIGURE 3-1 OF THE BOZEMAN COMMUNITY PLAN TO CHANGE THE FUTURE LAND USE MAP DESIGNATION FROM RESIDENTIAL TO COMMUNITY COMMERCIAL MIXED USE FOR 3.877 ACRES OF PROPERTY
ALONG THE SOUTH SIDE OF OAK STREET IN THE OAK MEADOWS
SUBDIVISION.
WHEREAS, the City of Bozeman has had a comprehensive plan (growth policy) since
1958; and
WHEREAS, the City of Bozeman adopted its current growth policy known as the
Bozeman Community Plan (BCP) through Resolution 4163 on June 1, 2009; and
WHEREAS, Section 17.4 of the BCP establishes criteria for the amending the BCP; and
WHEREAS, an application has been received by RES-MT Oak Meadows, LLC to
amend Figure 3-1 the BCP (future land use map) to change the land use designation of 3.877
acres along the south side of Oak Street in the Oak Meadows Subdivision from residential to
community commercial mixed use; and
WHEREAS, the City of Bozeman Planning Board conducted a public hearing on the
application on November 5, 2013 and passed a favorable recommendation on the amendment;
and
WHEREAS, in accordance with 76-1-602, Mont. Codes Ann., and upon notice to the
public on January 13, 2014 the City Commission conducted a public hearing prior to taking
action to adopt or revise the BCP; and
WHEREAS, after the public hearing the City Commission considered the application,
received public testimony, and the criteria for amendment and being fully informed on the matter
adopted Resolution 4503, a resolution of intent to amend the Bozeman Community Plan as
herein stated.

NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of
Bozeman, Montana, that:
Section 1
Figure 3-1 of the Bozeman Community Plan is hereby amended to change the future land use
designation from Residential to Community Commercial Mixed Use on a portion of land located
south of Oak Street between 12th and 14th Avenues and more particularly described as:
Description of Primary Growth Policy Amendment Tract
A tract of land, said tract being Lot 1 and Open Space 1 in Block 5, and Lot 1 and
Open Space 2 in Block 4, and a portion of Park 1 of the Plat of Oak Meadows
Subdivision, filed in Book J of Plats, Page 459 of Gallatin County Records, and
portions of North 14th Avenue and North 12th Avenue, as platted in said
subdivision, said tract being located in the Southwest Quarter of Section 1,
Township 2 South, Range 5 East, Principal Meridian Montana, City of Bozeman,
Gallatin County, Montana.
The described tract has an area of 3.877 Acres. (Exhibit A)

PASSED AND APPROVED by the City Commission of the City of Bozeman,
Montana, at a regular session thereof held on the 27th day of January, 2014.
