A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE

BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO EMBRACE AND INCLUDE

CERTAIN TRACTS OF LAND CONTINGUOUS TO THE SAID CITY OF BOZEMAN AND --
HEREIN MORE PARTICULARLY DESCRIBED, WITHIN THE CORPORATE LIMITS
THEREOF.
I WHEREAS, there has been presented to the city Commission of the City of Bozeman a written and
verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman
so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman; and
WHEREAS, the proper legal description of said contiguous tracts is as follows:
The following tracts of land lying in the West one-half of the North-
east one-quarter (W~NE\) of Section 1, Township 2 South. Range 5 East.
Montana Meridian, Gallatin county. Montana, and described as follows,
to-wit:
Beginning at a point on the westerly right-of-way line of Interstate
Highway 1-90-6 (13) 296,
Line "E" which point is North 88000'00" West,
a distance of 1422.39 feet, on and along the South line of the North-
east one-quarter of Section 1.
said line being also the North City
limit line of the City of Bozeman, Montana;
thence North 01016'30"
East on and along the westerly right:-of-way of line "E".
Interstate
Highway 1-90-6 (13) 296.
a distance of 325 feet to a point marked by
a 1/2 inch pipe set in concrete with a brass cap;
thence continuing
North 01016'30" East. on and along said right-of-way, a distance of
148.05 feet to a concrete post and brass cap;
thence on and along the
right-of-way line of the New Baxter Lane, on a circular curve to the
right having a radius of 120.3 feet and through a central angle of
73~03 ' along the arc. a distance
of 153.38 feet to a point marked by
a 5/8 inch rebar; thence
North 01016'30H East, on and along said New
Baxter Lane right-of-way a distance of 38.80 feet to a point marked
by a 5/8 inch rebar; thence
North 01017'04" East on and along the
westerly right-of-way line of said New Baxter Lane a distance of
I 190.6 feet; thence on and along a
circular curve to the left of 12012'
having a radius of 409.7 feet and through a central angle of 52026'30"
along an arc a distance of 375.0 feet;
thence North 51009'26" West
on and along the right-of-way of the New Baxter Lane a distance of
202.6 feet to a right-of-way monument marked Highway P.T. station
35+98.6 of said New Baxter Lane;
thence south 38050'34" West a
distance of 525 feet;
thence South 51006' East a distance of 356.98
feet to a 5/8" x 24" rebar and survey cap;
thence South 88000' East
a distance of 107.6 feet to a 5/8 inch rebar;
thence South 01016'30"
West a distance of 300.84 feet to a 1/2 inch pipe set in concrete
with a brass cap; thence
South 88000' East a distance of 75.0 feet
to a 4 inch concrete post with a brass cap;
thence south 01016'30"
West parallel to the westerly right-of-way line of said Interstate
90 a distance of 325 feet to a point on the south line of the North--
east one-quarter (NE\) of said Section 1;
thence South 88000' East
on and along the east-west one-quarter line of said Section I, being
the northerly city limit line of the City of Bozeman, Montana, a
distance of 260 feet to the point of beginning.
Containing within the above described exterior boundaries 10.119 acres.
Included within the above described boundaries are tracts know as
the Holiday Inn property,
Phillips Petroleum Service Station Humble
Oil Company Service Station and Carl Tange,
Jr. tract.
WHEREAS, the City Commission of the said City of Bozeman has, by its Resolution No.
1426,
regularly passed and adopted on the 21st day of January, 1970, declared it
to be for the best
interests of the said City of Bozeman and the inhabitants thereof and of the inhabitants of the
contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be ex-
I tended so as to include said contiguous tracts;
and
WHEREAS, the Clerk of the City Commission has, pursuant to the provisions of Section 11-403.
Revised Codes of Montana, 1947, given the required notice to property owners and caused to be
;ublished the required public notice of such proposed extension of the boundaries of said City of
Bozeman; and
WHEREAS, twenty (20) days have expired since the date of the first publication of said notice;
and

territory,
NOW. THEREFORE. be it resolved by the Commission of the City of Bozeman:
Section 1. That pursuant to the authority vested in the City Commission of the City of

Bozeman by Section 11-403. Revised Codes of Montana. 1947,
it is hereby declared that the boundar-
ies of the said City of Bozeman shall be extended so as to embrace and include within the boundar-
ies and corporate limits of the said City of Bozeman the tracts contiguous
thereto and hereinbefore
described.
Section 2. That this Resolution shall be, and
the same is hereby declared to be effective
immediately upon its adoption and approval.
PASSED AND ADOPTED by the Commission of the City of Bozeman at a regular session held on the
18th day of February. 1970.
