TIlE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF. WHEREAS, THERE HAS BEEN PRESENTED TO THE CITY COMMISSION OF THE CITY OF BOZEMAN A WRITTEN I and verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman and having presentedbo the City of Bozeman proposed plats and certificate of survey of said land; and WHEREAS, the proper legal description of said continguous tracts located in the County of Gallatin, State of Montana, is as follows: The following tracts of land lying in the West one-half of the Northeast one-quarter (W~NE~) of Section I, Township 2 South, Range 5 East, Montana Meridian, Gallatin County, Montana, and described as follows, to-wit: Beginning at a point on the westerly right-of-way line of Interstate High- way 1-90-6 (13) 296, line "E" which point is North 88000'00" West, a dist- ance of 1422.39 feet, on and along the South line of the Northeast one- quarter of Section I, said line being also the North City limit line of the City of Bozeman, Montana; thence North 01016'30" East on and along the westerly right-of-way of line "E", Interstate Highway 1-90-6 (13) 296, a distance of 325 feet to a point marked by a 1/2 inch pipe set in concrete with a brass cap; thence continuing North 01016'30" East, on and along said right-of-way, a distance of 148.05 feet to a concrete post and brass cap; thence on and along the right-of-way line of the New Baxter Lane, on a circular curve to the right having a radius of 120.3 feet and through a central angle of 73003' along the arc, a distance of 153.38 feet to a I point marked by a 5/8 inch rebar; then';"North 01016'30" East, on and along said New Baxter Lane right-of-way a distance of 38.80 feet to a point marked by a 5/8 inch rebar; thence North 01017'04" East on and along the westerly right-of-way line of said New Baster Land a distance of 190.6 feet; thence on and along a circular curve to the left of 12012' having a radius of 409.7 feet and through a central angle of 52026'30" along an arc a dis- tance of 375.0 feet; thence North 51009'26" West on and along the right-of- way of the New Baxter Lane a distance of 202.6 feet to a right-of-way monument marked Highway P.T. Station 35+98.6 of said New Baxter Lane; thence South 38050'34" West a distance of 525 feet; thence South 51006' East a distance of 356.98 feet to a 5/8" x 24" rebar and survey cap; thence South 88000' East a distance of 107.6 feet to a 5/8 inch rebar; thence South 010 16'30" West a distance of 300.84 feet to a 1/2 inch pipe set in concrete with a brass cap; thence South 88000' East a distance of 75.0 feet to a 4 inch concrete post with a b.ass cap; thence South 01016'30" West parallel to the westerly right-ef-way line of said Interstate 90 a distance of 325 feet to a point on the south line of the Northeast one-quarter (NE~) of said Sectionl; thence South 88000' East on and along the east-west one- quarter line of said Sectionl, being the northerly city limit line of the City of Bozeman, Montana, a distance of 260 feet to the point of beginning. Containing within the above described exterior boundaries 10.119 acres. Included within the above described boundaries are tracts known as the Holiday Inn property, Phillips Petroleum Service Station, Humble Oil Company Service Station and Carl Tange, Jr. tract. WHEREAS, it will be for the best interest of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described to extend the boundaries of the City of Bozeman so as to include the said contiguous tracts hereinbefore described within I the corporate limits of the said City of Bozeman. NOT, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1. That pursuant to the provisions of Section 11-463, Revised Codes of Montana, 1947, it is hereby declared to be to the best interest of the City of Bozeman and the inhabitants there- of and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so aso to include the contiguous tracts hereinbefore described COMMISSION RESOLUTION NO. 1426 ~~- 109 within the boundaries and corporate limits of the City of Bozeman, Montana PASSED AND ADOPTED By the Commission of the City of held on the 21st day of January, 1970. ATTEST: I ssion NOTICE IN RE COMMISSION RESOLUTION NO. 1426 OF THE CITY OF BOZEMAN STATING THE INTENTION OF THE CITY COMMISSION TO EXTEND THE BOUNDARIES OF SAID CITY OF BOZEMAN TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND ADJOINING SAID CITY. NOTICE IS HEREBY GIVEN that on the 21st day of January, 1970, at a regular meeting of the City Commission of the City of Bozeman, the said Commission duly and regularly passed and adopted Commission Resolution No. 1426 en ti tled : "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITII IN THE CORPORATE LIMITS THEREOF." NOTICE IS HEREBY FURTHER GIVEN THAT Wednesday, the 18th day of February, 1970, at one o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated as the time and place for hearing objections to the action proposed to be taken in said Resolution No. 1426, whereby it is proposed to embrace the hereinafter described contingent territories within the corporate limits of the City of Bozeman, Montana. Expressions of approval ot disapproval by resident freeholders I of the territories proposed to be embraced must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than twenty (20) days after the date of the first publication of this Notice.
