A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE "~'~
INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE
KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 497 FOR THE PURPOSE OF CONSTRUCTING AND ~
INSTALLING A WATER MAIN AND CONSTRUCTION AND RECONSTRUCTION OF WATER SERVICE AND
APPURTENANCES THERETO ON THAT PORTION OF SOUTH ELEVENTH AVENUE BETWEEN WEST MAIN
STREET AND WEST CURTISS STREET.
WHEREAS t there has been filed with the Clerk of the City Commission of the City of Bozeman,
I Montana, a petition in due form of certain owners of p~operties situated within the boundaries
of Special Improvement District No. 497 as hereinafter more specifically described, asking that
a special improvement district be created for the purpose of constructing and installing water-
mains to provide water to lots within the district.
WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on
the 15th day of July, 1970, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create a special
improvement district to be known and designated as-Special Improvement District No. 497 of the
City of Bozeman for the purpose of constructing and installing watermains, said project to in-
clude all appurtenant work for the construction and installation of watermains to provide water
for all lots within the district.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 497 are described as follows:
Beginning at a point, said point being the intersection of South Eleventh Avenue
and West Curtiss Street in the City of Bozeman, Montana, thence westerly on
a line
parallel to and thirty (30) feet distant southerly from the southerly property line
of lot 3, Block 1, West Side Addition to the City of Bozeman, a distance of 161 feet;
thence northerly a distance of 30 feet to the southwest corner of Lot 3 of said
I Block; thence northerly a distance of 91.50 feet to the northwest corner of Lot l-;'of
said Block 1; thence westerly a distance of 14 feet to the northeast corner of Lot 6
of Block 1; thence westerly a distance of 23 feet to a point on the north line of
Lot 6 of said Block 1; thence northerly a distance of 660 feet to a point, said
point being 198 feet west of the center of Section 12, Township 2 South, Range 5
Eas t; thence north a distance of 30 feet to a point.
Thence northerly parallel to and
198 feet from the north quarter line of Section 12 to a point on the southerly
right-of-way line of West Main (U.S. 191), said point being 198 feet west of said
quarter line; thence northerly a distance of 55 feet to a point on the centerline
of West Main (U.S. 191) thence easterly a distance of 261 feet more or less to a
point on the centerline of West Main; thence southerly a distance of 45 feet to the
northeast lot corner of Lot 11, Block H of Story's Addition, thence southerly
on the
easterly lot line of Lots 11 and 16 of said Block H to the southeast corner of Lot
16 of said Block R; thence southeasterly a distance of 84.40 feet more or less to
the northeast corner of Lot 6 Block 6 of the West Park Addition; thence
southerly
on the east lot line of Lot 6 of said Block 6 to the southeast corner of Lot 6 of said
Block 6; thence southerly across the east-west alley of Block 6 to the northeast
corner of Lot 9 Q~ said Block 6; thence southerly on the easterly alley line of
Block 6 to the southeast lot cormer of Lot 14 of said Block 6; thence southerly
across West Olive Street to the northeast corner of Lot 24 of Block 7 of said sub-
division; thence southerly on the westerly alley line of Block 7 to the southeast
corner of Lot 13 of said Block 7; thence southerly a distance of 30 feet to a point
on the centerline of West Curtiss Street; thence westerly on the centerline of
West
Curtiss Street to the point of beginning.
Contained within the above described exterior boundaries the following lots, Blocks
and tracts of land to-wit:
Lots 13 thru 24 inclusive of Block 7; Lots 6 thru 14 inclusive of Block 6, all in
West Park Addition; Lots 11 thru 16 inclusive of Block H of Story's Addition;
portion of 8E~ of NW~, Section 12, T28, R5E; portion of swt of Section 12, T2S, RSE;
Lot 1 thru 3 inclusive of Block 1 of West Side Addittan..

Sec tion 3:'
Character of Improvements
The character of the improvements to be made is the construction of a water main project,
including excavation and backfill and necessary appurtenances thereto, to
be installed on that
portion of South Eleventh Avenue, between West Ma!n Street (U.S. 191) and
West Curtiss Street.

Estimate of Cost
The total estimated costs of the improvements within the district, including materials,
construction, engineering, legal, administrative and contingency costs is $16,500.00.
Section 5
Method of Assessment
I
The cost of such improvement is to be assessed against the entire district, with each lot or
parcel of land assessed for that portion of the whole cost which its frontage bears to the frontage
of the entire district exclusive of streets, avenues, alleys and public places. The total frontage
in the district is 1571.76 linear feet. The estimated rate of assessment is $10.4977859 linear
foot of frontage.
Section 6
Payments
The payments for said improvements shall be made in twenty (20) annual installments extending
over a period of nineteen (19) years, but this shall not be construed to prevent payment in full
at any regular payment date by any property owner who desires to do so. It is proposed to pay
the entire cost and expense of the construction and installation of said improvements with cash
to be obtained from the sale of bonds of said Special Improvement District No. 497, as authorized
by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00
where necessary, to be issued and chargeable against a fund to be known and designated as Special
Improvement District No. 497 Fund of the City of Bozeman. The bonds will be redeemable at the
option of the City, singly or in multiples, and in the order of their registration, whenever funds
are available for the purpose in said Special Improvement District No. 497. Said bonds shall draw
a simple interest from the date of their registration until called for payment, at a rate not to
exceed six percent (6%) per annum, which interest shall be chargeable as part of the cost of
construction and installation of said improvements. The bonds will be issued and sold in accor-
dance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 19lf7, I
and all other applicable provisions of Title 11 of the Revised Codes of Montana,
1947, relating
to special improvement districts in cities and towns, and any amendments thereof or thereto.
Section 7
Protests and Notice
That the regular session of the City Commission of the City of Bozeman, to be held at the
Commission Chamber, City Hall BUilding, Bozeman, Montana, on Wednesday, the 5th day of August,
1970, at the hour of one o'clock p.m. of said day, is the time and place, when and where the City
Commission will hear and pass upon all protests duly and regularly made and filed against the
creation of said proposed Special Improvement District 497, the improvements proposed to be made
pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the
City Commission be, and she is hereby directed to give notice in the manner and for the time as by
law required, of the adoption of this Resolution of Intention.

the City Hall, Bozeman, Montana, is designated by Resolution No.
1433 as the time when and the
place where the Commission of the City of Bozeman will hear and pass upon all protests that may

after date of the first publication of this notice.

to all interested parties and the public generally.
This notice is given persuant to the provisions of Section 11-2204, Revised Codes of Montana,
1947.
