WHEREAS, there has been filed with the Clerk of the Clty ComTilission
of the City of Bozeman, I
Montana, 8. petition in due form of certain owners of properties situated on a portion of South
Sixteenth Avenue asking that a special improvement district be created for
the purpose of constru-
cting and installing an asphalt-concrete type pavement to include all work incidental thereto;
and
\vHEREAS, at a regular meeting of the City Con\Ti~ission of the City of Bozeman held on
the 13 th
day of J,,1nuary, 1971, the aforesaid petition was respectively considered
and granted;
NOH, THEREFORE, BE IT RESOLVED BY THE
CITY COMMISSION OF THE CITY OF BOZE~~N:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the city of Bozeman to create v special im-
provement district to he knm'ln and designated as Special Improvement District No.
501 for the pur-
pose of constructing and installing an asphaltic-concrete pavement project on a portion of South
Sixteenth Avenue.

Boundaries
That the boundaries of said Special Imp
rovement District No. 501 are described as follows:
Beginning at a point on the south line
of the southwest quarter
of Section 12, Township 2 South, Range
5 East, said point being
147.04 feet west of the southeast corner
of the SW\SW~ of Section
12, Township 2 South, Range 5 East, which
is the true point of

thence westerly along the south line of the SW\ of
said section 12,
a distance of 320.0 feet, thence in a northerly

direction, a distance of 30.0 feet,
to the southwest corner of
Lot 1 of Apollo Subdivision;
thence continuing northerly along
the westerly lot lines of Lots 1
thru 4 of said Subdivision a
distance of 350.98 feet,
to the northwest corner of Lot 4 of
said Apollo Subdivision~
thence easterly along the northerly lot
lines of Lots 4 and 5,
a distance of 320.0 feet, to the northeast
lot corner of Lot 5 of said Subdivision;
thence southerly along
the easterly lot lines of Lots 5 thru 8,
a distance of 351.17

Containing within the above described exterior
boundary lines

to the City of Bozeman,
Hontana.
Section 3
Character of Improvements
Construction of a paving project with intregal concrete curbs and gutters and necessary work
pertaining thereto on that portion of South Sixteenth Avenue lying \l7ithin the Apollo Subdivision,
said pavement project to include construction of an asphaltic-concrete type surface course, all
necessary excavation, f,ravel backfilland other appurtenant work thereto,
construction of concrete
curbs and p;utters and other appurtenant work thereto.
Section 4
Estimate of Cost
The preli.minary estimate of cost is $22,500.00 i.ncluding all street excavation,
all materials,
i.nstallation costs, engineering costs and incidentals.

Section 5
Method of Assessment
The cost of such improvements is to be assessed against
the entire district, each lot or par-
cel of land within such district will be assessed for that part of the whole cost which its area
bears to the area of the entire district, exclusive of streets,
avenues, alleys and public places,
and furt~er each square foot of land within the district lying within 25 feet of the line of the
street on which the improvements herein provided for are made,
shall bear double the amount of the
costs of such improvements per square foot of such land that each square
foot of any other land

within the djstrict shall be~r.
The total actual square feet of assessable area within the district is
108.833.25 square feet
which is the area on which all protests will be receiverl. considered and determined.

Section 6
Payments
That the payments for said improvements shall be made in twenty (20)
annual installments extend-
I ing over a period of nineteen (19) years. hut this shall not be construed
to prevent payment in full
at any regular payment date by any property owner who desires to do so.
It is proposed to pay the
entire cost and expense of the construction and installation of said improvements
with cash to be
obtained from the sale of bonds of said Special Improvement District No.
501. as authorized by law.
Such bonds will be in denominations of $100.00 each. and fractions or multiplies of $100.00 where
necessary. to be issued and chargeable against a fund
to be known and designated as Special Improve-
ment District No. 50] Fund of the City of Bozeman.
The bonds will be redeemable at the option of
the City, singly or in multiples. and in the
order of their registration. whenever funds are avail-
able for that purpose in said Special Improvement District No. 501.
Said bonds will draw a simple
interest from the datE' of their registration until called for payment. at a rate not to exceed six
percent (6%) per annum. which interest shall be chargeable as a part of the cost of construction
and installation of said improvements. The bonds will be issued and sold
in accordance with the
provisions of Section 11-2232 and Section 11-2271. Revised Codes of Montanat
1947. and all other
applicable provisions of Title 11 of the Revised Codes of Montana.

provement districts in cities and towns. and any amendments thereof or
thereto.
Section 7
Protests and Notice
That the regular session of the City Commission of the City of Bozeman to be held at the
Commission Chamber. City Hall Building. Bozeman. Montana. on Wednesday.
the 3rd day of February.
1971. at the hour of one o'clock p.m. of said day.

in writing and delivered to the Clerk of
the City Commission within fifteen (15) days after date
of the first publication of this notice.
The General character of the improvements proposed
to be made is the construction of a pave-

ction on a portion of South Sixteenth Avenue.

The estimated cost of said improvements
within the district including engineering, materials
construction, legal, administration and
contingency costs is $22,1500.00.
For a description of the boundaries of said Special Improvement District No.
501 reference is
hereby made to Resolution No. ll,52 of the Commission of tbe City of Bozeman
declaring the intention
to create said district, which is on file in the office of the undersigned Clerk of said Commission
in the City Hall of said City of Bozeman, State of Montana, and
open for inspection to 0311 in-
terested parties and the public generally.
This notice is given pursuant to
the provisions of Section ll-220L1<, Revised Codes of Montana,
