The property is generally south of Oak Street between 12th and 14th Avenues, File Z13175. MEETING DATE: January 13, 2014 AGENDA ITEM TYPE: Action RECOMMENDATION: The City Commission continue the review of the Oak Meadows Zone Map Amendment to February 3, 2014. SUGGESTED MOTION: I move to continue the Oak Meadows Zone Map Amendment application, File Z13175, to February 3, 2014. BACKGROUND: The property owner, RES-MT Oak Meadows, LLC, 709NW, 107th Avenue, 4th Floor, Miami, FL 33172, represented by PC Associates, LLC, 26D Shawnee Way, Bozeman, MT 59715, has made application to amend the City of Bozeman Zone Map from R-4 (Residential High Density District) to B-2 (Community Business District) on approximately 3.523-acres. The request is in conjunction with the Oak Meadows Growth Policy Amendment (P13025). At the Applicant’s request on December 9, 2013 the Oak Meadows Zone Map Amendment public hearing was continued to February 3, 2014. Subsequently, based on recommendation from the City Attorney to more accurately follow state statue regarding the relationship between an amendment to the Community Plan and a subsequent zone map amendment, the Oak Meadows Zone Map Amendment must be continued to February 3. Doing so will allow the Commission, if it approves the resolution of intent for the amendment to the Community Plan, to adopt a final resolution to amend Figure 3.1 of the Bozeman Community Plan prior to conducting the public hearing on the zone map amendment. Should the Commission vote favorably on the amendment to the Community Plan, the Applicant will be required to prepare materials to satisfy the contingencies outlined in the staff report for the application to amend the Community Plan (file P13025) prior to Commission adoption of the of the final resolution approving the Oak Meadows Growth Policy Amendment. If these materials are not provided in sufficient time the Oak Meadows ZMA public hearing will be continued to a later date to allow the preparation of the implementing documents. A staff report for the project will be forwarded to your attention prior to the February 3, 2014 public hearing. Staff will be present on January 13, 2014 hearing to respectfully request that the 88 agenda item be continued to the February 3 hearing date to maintain the public notice requirements.
