"'''- COMMISSION RESOLUTION NO. 1475 "'~~ ,~ ~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS- TRICT NO. 503 FOR THE PURPOSE OF INSTALLING AN EIGHT INCH WATER MAIN ON WEST TAMARACK STREET BETWEEN FIFTH AND SEVENTH AVENUES, AN EIGHT INCH WATERMAIN ON FIFTH AVENUE NORTH BETWEEN WEST TAMARACK STREET I AND VACATED WEST JUNIPER STREET; A SIX INCH WATERMAIN ON AN EASEMENT ON VACATED WEST JUNIPER STREET TO CONNECT WITH THE PRESENT SIX INCH MAIN ON SAID VACATED WEST JUNIPER STREET. THE CONSTRUCTION AND IN- STALLATION OF SAID WATERMAIN TO INCLUDE TRENCH EXCAVATION AND BACK- FILL, INSTALLATION OF CAST IRON PIPE, NECESSARY WYES, TEES, CROSSES, VALVES, HYDRANTS, PIPE BEDDING MATERIAL AND OTHER APPURTENANT FITT- INGS AND WORK THERETO. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated within the boundaries of Special Improvement District No. 503 as hereinafter more specifically described, asking that a spec- ial improvement district be created for the purpose of constructing and installing watermains to provide water to lots within the district. WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 14th day of July, 1971, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Sec tion 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special im- provement district to be known and designated as Special Improvement District No. 503 of the City of Bozeman for the purpose of constructing and installing watermains, said project to include all appurtenant work for the construction and installation of watermains to provide water for all lots within the district. I Sec tion 2 Boundaries The boundaries of the said Special Improvement District No. 503 are described as follows: Beginning at the southwest corner of Lot Two (2) of Block Two (2), North Seventh Addition to Bozeman, Montana; thence easterly along the southerly line of said Lot Two (2) to the southeast corner of said Lot Two (2); thence continuing easterly on said southerly line of Lot Two (2) extended to the centerline of the north-south alley of said Block Two (2); thence southerly along said centerline to a point of intersection with the centerline of the east-west alley; thence easterly along the centerline of said east-west alley line of said Block Two (2) and said centerline extended to a point of intersection with the centerline of North Fifth Avenue; thence northerly along the centerline of North Firth Avenue a distance of 150 feet; thence easterly at right angles to the centerline of North Fifth Avenue a distance of 170 feet to a point 140 feet easterly of the easterly line of North Fifth Avenue; thence north- erly parallel to and 140 feet distant from the said easterly line of said North Fifth Avenue a distance of 420 feet; thence westerly at tight angles a distance of 200 feet to the southeasterly corner of Block Four (4) of said North Seventh Addition; thence westerly along the southerly line of said Block Four (4) as platted and said line extended a distance of 557 feet to the centerline of North Seventh Avenue; thence southerly along said centerline of North Seventh Avenue a distance of 540 feet; thence easterly at right angles a distance of 50 feet to the southwesterly corner of Lot Two (2) of Block Two (2) of North Seventh Addition, being the point of beginning. I Containing within the above described exterior boundaries the fol- lowing assessable lots, blocks and tracts of land, to wit; Lot I, 2, II, 12, 13, 14 and 15 of Block 2, North Seventh Addition; Lots 1 through 15 inclusive of Block 3, North Seventh Addition; the vacated east-west alley of Block 3; the vacated north-south alley of Block 3, North Seventh Addition; the southerly thirty feet of the vacated portion of Juniper Street lying between Block 3 and Block 4, North Seventh Addition; a tract of land in the NW~SE~SE\ of Section 1, T2S, R5E, M.P.M., measuring 140 feet by 420 feet. Sec tion 3. Character of Improvements. The character of improvements to be made is the installation and construction of an eight (8) COMMISSION RESOLUTION NO. 1475 u_"...u_.u...._.. ~ 2'10 inch cast iron watermain, including trenching and backfill, installation of cast iron pipe, necessary tees, valves, crosses, hydrants, bedding material and other appurtenant fittings and work thereto as shown by cost schedule 1 on file in the office of the City Engineer, Bozeman, Montana. The install- ation and construction of a six (6) inch cast iron watermain, including trenching and backfill, in- stallation of cast iron pipe, necessary tees, valves, crosses, hydrants, bedding material and other appurtenant fittings and work thereto as shown by cost schedule 2 on file in the office of the City Engineer, Bozeman, Montana. I Section 4 Estimate of Cost The total estimated cost of the improvements within the district, including engineering, legal and contingency as shown by schedule I as aforesaid, is $20,650.00, and schedule 2 as aforesaid, is $3,350.00, or a total cost of $24,000.00. Section 5 Method of Assessment The cost of such improvements is to be assessed against the entire district, each lot, tract or parcel of land within said district will be assessed for that part of the whole cost of Schedule I which its area bears to the area of the entire district exclusive of streets, avenues, alleys and public places. The entire cost of schedule 2 is to be borne by Lots 1 through 15 inclusive of Block 3, the areas of the vacated alleys of said Block 3 and the southerly 30 feet or southerly one- half of that vacated portion of Juniper Street. The total actual assessable area within such district is 290,550 square feet, which is the area on which all protests will be received, considered and determined. Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained I from the sale of bonds of said Special Improvement District No. 503, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 503 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the pur- pose in said Special Improvement District No. 503. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6'70) per annum, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Comm- " ission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 4th day of August, 1971, at .. the hour of one-fifteen o'clock p.m. of said day, is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District 503, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of I the adoption of this Resolution of Intention. That Wednesday. the 4th day of August, 1971, at one-fifteen o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1475 as the time when and the place where the Commission of theCity of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delived to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the installation and constru- ction of an eight inch cast iron watermain, including trenching and backfill, installation of cast iron pipe, necessary tees, valves, crosses, hydrants, bedding material and other appurtenant fittings and work thereto as shown by cost schedule 1 on file in the office of the City Engineer, Bozeman, I Montana.
