THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DE-

AND/OR REPAIRING
~'i' MISCELLANEOUS SIDEWALKS AND CURBS DURING
THE YEAR 1971
WHEREAS, the Commission of the City of Bozeman, pursuant to the provisions of Chapter 9.36 of
I
the Bozeman Municipal Code and of Section 11-2226, Political Code, R.C.M., 1947, provide for the
construction of sidewalks and curbs in the City of Bozeman during the year 1971, without the form-
ation of Special Improvement District;
WHEREAS, proceedings were had for the construction and installation and/or repair of Miscell-
aneous Sidewalks and Curbs in the City of Bozeman for the year 1971, and
WHEREAS, miscellaneous Sidewalks and Curbs were constructed and installed and/or repaired
bordering on various properties in the City of Bozeman, pursuant to Chapter 9.36 of the Bozeman
Municipal Code and the provisions of Section 11-2226, Political Code, R.C.M., 1947, which are here-
by referred to and made a part of this Resolution, and
WHEREAS, the miscellaneous Sidewalks and Curbs have been constructed and completed and/or
repaired in accordance with the terms and conditions of said proceedings, and the City Engineer
has duly certified to the Commission a Schedule showing the sidewalks and curbs which have been
constructed and installed and/or repaired, and the properties which are subject to assessment there-
under and the total cost of said construction and installation and/or repairing is the Sumi' of
Eighteen Thousand Five Hundred Sixty-Five & 29/100ths ($18565.29) dollars, which schedule, marked
Schedule "A" is hereto attached and made a part hereof.
NOW, THEREFORE, pursuant to the provisions of Chapter 9.36 of the Bozeman Municipal Code and
Section 11-2226, Political Code, R.C.M., 1947, as aforesaid

BE IT RESOLVED AND IT IS HEREVY ORDERED
BY'THE COMMISSION OF THE
CITY OF BOZEMAN, MONTANA:
See tion 1: That to defray the cost of constructing and installing and/or repairing Miscell-

aneous Sidewalks and Curbs as set forth in Schedule "A" hereto attached and made a part hereof,
there
is hereby levied and assessed a tax amount to the sum of Eighteen Thousand Five Hundred Sixty-Five
& 29/l00ths (18,565.29) dollars.
Section 2: That a particular description of each lot and parcel of land with the name of the
owner and the sum assessed against him or it for such construction and installation and/or repair
and the amount of each payment to be made and the day when the same shall become delinquent is set
forth in the assessment list hereto attached marked Schedule "A" and made a part hereof; tha t the
several sums set opposite the name of the owner and the description of the lots and parcels of land
be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to
defray the cost and expense of constructing and installing and/or repairing said Sidewalks and Curbs;

that the several sums so assessed by collected from the respective owners of said lots and parcels
of land described in said assessment list as required by law; that the payment of said sums shall
be made in five (5) installments; that the payment of said installments shall be made on or before
the 30th day of November of each year until payment of all installments together with the interest
thereon, shall be made; that said sums shall be paid and the collection thereof shall be made in the
manner and in accordance with the law governing the collection of Special Improvement Taxes; that
failure to pay such assessments when the same shall become due and payable shall make such persons
and said lots and parcels of land liable to the penalties provided by law relative to delinquent
taxes.
Section 3: That the regular session of the Commission of the City of Bozeman to be held in the
Commission Chamber in the City Hall of said City on the 20th day of October 1971, at 1:15 olclock I
p.m., be, and the same is hereby designated as the time and place at which objections to the final
adoption of this resolution will be heard by said Commission.
Sec tion 4: That the Clerk of the Commission of the City of Bozeman, be, and she is hereby
ordered and directed to publish in the Bozeman Daily Chronicle, a daily newspaper printed and published
in the said City of Bozeman a notice signed by the Clerk of the Commission and stating that a Re-
solution levying and assessing a special assessment of taxes to defray the cost and expenses of
constructing and installing and/or repairing sidewalks and curbs in the City of Bozeman for the year
1971 is on file in the crfice of the Clerk of the Commission subject to inspection for a period of

five (5) days; that said Notice shall state the time and place at which objections will be heard
by the Commission to the final adoption of this Resolution; that it shall be published at least
five (5) days before the date set by the Commission for the hearing of objections and the final

adoption of this Resolution.

HEARING, FINAL ADOPTION COMMISSION RESOLUTION NO. 1489, LEVYING
I ASSESSMENT TAXES, CONSTRUCTION AND INSTALLATION AND/OR REPAIR
MISCELLANEOUS SIDEWALKS AND CURBS IN THE CITY OF BOZEMAN DURING
THE YEAR 1971.
NOTICE IS HEREBY GIVEN, that during a regular session of the Commission of the City of Bozeman
held on Wednesday, the 13th day of October 1971 Commission Resolution No. 1489 was provisionally
passed and adopted; that said Commission Resolution levies and assesses a special assessment of
taxes upon certain lots and parcels of land in front, or on the side of which sidewalks and curbs
have been constructed and/or repaired pursuant to the provisions of Chapter 9.36 of the Bozeman
Municipal Code and of Section 11-2226, Political Code, R.C.M., 1947, to defray the cost and
expense
of constructing and installing and/or repairing said Sidewalks and Curbs.
That said Commission Resolution is now on file in the office of the Clerk of the Commission,
subject to inspection for a period of five (5) days by any persons interested. That Wednesday,
the 20th day of October 1971, at 1:15 o'clock p.m. of said day, at a regular meeting of the Comm-
ission of the City of Bozeman, at the Commission Chamber, City Hall Building of said City, has
been designated as the time and place when and where the said Commission will hear and pass upon
any and all objections that may be made to the final passage and adoption of said Resolution No.
1489 and the levying of said assessment, and that said Resolution will be finally passed and adopted
at said regular session.
All persons interested are referred to said Chapter 9.36 of the Bozeman Municipal Code, and
the Commissioners' proceedings for the construction and/or repair of Miscellaneous Sidewalks and
Curbs, in front of or on the side of Lots and parcels of land within the City of Bozeman for the
I year 1971, without the formation of Special Improvement District.
