A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, . ,(
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A ,_

NORTHERN PACIFIC ADDITION TO BOZEMAN, MONTANA.

i.JHEREAS, there has been filed wi th the Clerk of the Ci ty Commiss ion of the Ci ty of Bozeman,
Montana, a petition by the owners of properties abutting on that portion of Aspen Street above
described, requesting that a portion of said Aspen Street be vacated; and
WHEREAS, it appears to the City Commissj.on to be in the best interest of the City of Bozeman
and the inhabitants therein that a portion of said Aspen Street as above described.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
It is hereby declared to be the intention of the Commission of the City of Bozeman to vacate
that portion of Aspen Street lying between lots twenty-five (25) through thirty-two (32) inclusive
of Block one hundred nine (109) and lots one (1) through eight (B) inclusive of Block one hundred
eight (lOB), Northern Pacific Addition to Bozeman, Montana, and more particularly described as
fa llows :
Bf><>:inning at the northwest corner of Lot 1 of Block one hundred eight (108)
of said Northern Pacific Addition; thence easterly along the south line
of Apsen Street being the northerly line of said Block lOB, a distance
of two hundred (200) feet to the northeast corner of lot eight (8) of
said Block lOB; thence northerly across said aspen street to the south-
east corner of lot twenty-five (25) of Block 109 of said Northern Pacific
Addition; thence westerly along the north line of Aspen Street being the
southerly line of said Block 109 a distance of 200 feet to the southwest
corner of lot thirty-two (32) of said Block 109; thence southerly across
Aspen Street to the northwest corner of Lot one (1) of Block lOB, being
I the point of beginning.
Containing within the above described exterior boundaries 24,000 square
feet or .551 acres.
Reserving unto the City of Bozeman an easement for existing sanitary
sewer main and appurtenances and access to the above described property
to maintain said sanitary sewer services.
The vacation of a portion of said Aspen Street rescinds a Use Permit
Agreement granted the Montana Power Company by the City of Bozeman
Commission action of June 19, 196B.
Section 2
Notice
That the City Manager of the City of Bozeman is hereby directed to cause notice of the adoption
of this resolution of intention to be served in the Same manner that service of summons is required
on all persons whose property abuts upon that portion of Aspen Street lying between Lots 25 through
32 inclusive, of Block 109, and Lots 1 through 8 inclusive of Block 108, Northern Pacific Addition
to Bozeman, Montana. which will be affected by the proposed vacation and by publication once in a
daily newspaper in general circulation in the City of Bozeman, Montana.
Section 3
Time for Objections
That the regular session of the City Commission of the City of Bozeman, Montana, to be held
at the Commission Chamber in the City Hall Building, Bozeman, Montana, on Wednesday the 1st day of
December, 1971, at the hour of one fifteen o'clock p.m. of said day, is the time and place when
and where the City Commission will hear and pass upon

COMMISSION RESOLUTION NO. lLf95 OF THE CITY OF BOZEMAN STATING
THE INTENTION OF THE CITY COMMISSION TO VACATE A PORTION OF
ASPEN STREET.
NOTICE IS HEREBY GIVEN that on the 3rd day of November, 1971, at the regular meeting of
the City Commission of the City of Bozeman, Montana, the said Commission duly and regularly I
passed and adopted Commission Resolution No. 1495 entitled:
A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE A
PORTION OF ASPEN STREET LYING BETWEEN LOTS 25 THROUGH 32 INCLUS-
Ivg, OF BLOCK 109, AND LOTS 1 THROUGH 8 INCLUSIVE OF BLOCK 108,
N,ORTHERN PACIFIC ADDITION TO BOZEMAN, MONTANA.
NOTICE IS HEREBY FURTHER GIVEN that Wednesday, the 1st day of December, 1971, at one fifteen
o'clock p.m. at the Commission Room in the City Hall Building, Bozeman, Montana, is designated as
the time and place to hear objections to the vacating of the portion of Aspen Street lying between
Lots 25 through 32 inclusive, of Block 109, and Lots 1 through 8 inclusive of Block 108, Northern
Pacific Addition to Bozeman, Montana, and is the time and place any person whose property abuts
upon portions of the street proposed to be vacated may appear and object to the proposed vacation.
This notice is gi.ven pursuant to Section 11-3310, Revised Codes of Montana, 1947.
