HomeMy WebLinkAboutResolution 1493 Special Improvement District 505, Water 254 COMMISSION RESOLUTION NO. 14'::13 ~? 0" A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, ~ MONrANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA TO CREATE A SPECIAL IMPROVEMENT DISTRICT ~ TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NUMBER 505 FOR THE PURPOSE OF INSTALLING A SIX (6) INCH WATERMAIN ON SOUTH TWENTIETH (20th) AVENUE BETWEEN WEST BABCOCK STREET AND WEST COLLEGE STREET FOR THE PURPOSE OF PROVIDING ADJOINING I PROPERTY DOMESTIC WATER SERVICE AND FIRE PROTECTION, THE INSTALLATION AND CONSTRUCTION OF SAID WATERMAIN TO INCLUDE TRENCH EXCAVATION AND BACKFILL; INSTALLATION OF CAST IRON PIPE, NECESSARY TEES, VALVES, HYDRANTS, PIPE BEDDING MATERIAL AND OTHER APPURTENANT FITTINGS AND WORK THERETO. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated within the boundaries of Special Improvement District No. 505 as hereinafter more specifically described, asking that a special improvement distrcit be created for the purpose of constructing and installing watermains to provide water to lots within the district. WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on the 20th day of October, 1971, the aforesaid petition was repective1y considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 505 of the City of Bozeman for the purpose of constructing and installing watermains, said project to include all appurtenant work for the construction and installation of I watermains to provide water for all lots within the district. Section 2 Boundaries The boundaries of said Special Improvement District No. 505 are described as follows: Beginning at a point on the centerline of West Babcock Street, said point lying two hundred thirty (230) feet westerly of the east one quarter of Section Eleven, Township 2 South, Range 5 East; said point also being the northeast corner of lot ten (10) of Block One; thence southerly along the easterly lot lines of lots 6,7,8, 9 and 10 of Block 1; lots 9,10,11,12,13,14,15 and 16 of Block 2; lots 9,10,11,12,13, 14,15 and 16 of Block 3; and 10t2 of Block 4, to the southeast corner of lot 2 of said Block 4, all in Kirk Subdivision of Bozeman, Montana; thence continuing southerly parallel to and one hundred forty five (145) feet distant easterly of the east line of South Twentieth Avenue thru Assessors Tract W of the Southeast Quarter of the Southeast Quarter of Section 11, Township 2 South, Range 4 East to the Northeast corner of Tract 2 of Mountain Vista Suburb; thence continuing southerly along the easterly line of said Tract 2 to the southeast corner of said Tract 2; thence southerly across the Farmers Canal right of way and along the easterly line of Tract 2-A as platted in the said Mountain Vista Suburb to a point on the south line of said Section 11; thence westerly along the southerly line of said Section 11, a distance of three hundred fifty (350) feet; thence northerly along the westerly lines of Tract 3-A and Tract 3 of the Mountain Vista Suburb as platted to the northwest corner of said Tract 3; thence continuing northerly parallel to and one hundred thirty seven and five tenths (137.5) feet distant westerly of the westerly line of South Twentieth Avenue thru an unplatted tract of land lying in the Southeast Quarter of the Southeast Quarter of Section 11, known as the First Presbyterian I Church Tract, a distance of two hundred sixty four (264) feet to the northerly line of said tract being also the south line of Kirk Subdivision Number 4 of the City of Bozeman, Montana; thence North 89054'30" East along said south line of said Kirk Subdivision No. 4 a distance of seventeen and five tenths (17.5) feet to the southwest corner of lot 10 of Block 2 of said Kirk Subdivision No. 4; thence northerly along the west lot lines of lots 1 thru 10 inclusive of Block Two and lots 1 thru 13 inclusive of Block One of said Kirk Subdivision No. 4 a distance of one thousand nine hundred ninety-five and seventy two hundreths (1995 .72) feet to the northwest corner of lot 1 of Block 1 of said Kirk Subdivision; thence continuing northerly on said westerly lot line extended, a distance of thirty feet to the northerly line of said Kirk Subdivision No.4, being the centerline of West Babcock Street and also the east-west one quarter line of said Section 11; thence North 89024' East along said COMMISSION RESOLUTION NO. 1493 ono n...___.,.__..____._ _. n... 255 line a distance of three hundred twenty five (325) feet to the true point of beginning. Containing within the above described exterior boundaries the following lots. blocks {, , and tracts of land. to-wit: All of lots 1 thru 13 inclusive of Block 1 and all of lots 1 thru 10 inclusive of Block 2 of Kirk Subdivision No. 4' the easterly 137.5 feet of the First Presbyterian , Church Tract lying southerly of Kirk Subdivision No. 4 and between such subdivision I and Mountain Vista Suburb; all of Tract 3, Mountain Vista Suburb including the easterly fifteen (15) feet; all of Tract 2 of said Mountain Vista Suburb; the westerly one hundred thirty (130) feet of Assessors Tract W of the Southeast Quarter of the Southeast Quarter of Section 11; all of Lots 2 and 3 of Block 4, all of lots 9 thru 16 inclusive of Block 2 and all of lots 6 thru 10 inclusive of Block 1, all in Kirk Subdivision. Section 3 Character of Improvements The character of improvements to be made is the installation and construction of a six (6) inch cast iron watermain including trenching and backfill, installation of cast iron pipe, necessary tees, valves, hydrants, bedding material and other appurtenant fittings and work thereto to provide domestic water service and dire protection to adjoining property. Section 4 Estimate of Cost The total estimated cost of the improvements within the district, including construction, engineering, legal and contingency is $30,000.00. Section 5 I Method of Assessment The cost of such improvement is to be assessed against the entire district, each lot, tract or parcel of land within said district as its linear front footage adjoining the improvement bears to the total assessable linear front footage along Twentieth Avenue within the district. The total assessable front footage within the district is 4,915.81 linear feet which is the linear foot frontage on which all protests will be received. con sidered and determined. Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 505, as authorized by law. Such bonds will be in I denominations of $100.00 each, and fraction or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 505 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration whenever funds are available for the purpose in said Special Improvement District No. 505. Said bonds shall draw a simple interest from the date of their registration COMMISSION RESOLUTION NO. 1493 ..- - 256 until called for payment, at a rate not to exceed seven (7%) percenlter annum, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the ~evised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or I thereto. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 10th day of November, 1971, at the hour of one fifteen o'clock p.m. of said day, is the time and piace, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement Distrci 50S, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. That Wednesday, the 10th day of November, 19/1, at one fifteen o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1493 as the time when and the place where the Commission of the City of Bozeman will COMMISSION RESOLUTION NO. 1493 - . .--.-.....- --.-- 257 hear and pass upon all protest that may be made against the making of such improvements or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the installation I of a six inch watermain on South 20th Avenue between West Babcock Street and West College Street for the purpose of providing adjoining property domestic water service and fire protection. The preliminary estimate of cost is $30,000.00 as shown by said Commission Resolution No. 1493, including construction,engineering, legal and contingency expenses. For a description of the boundaries of said Special Improvement District No. 505 reference is hereby made to Resolution No. 1493 of the Commission of the C1ty of Bozeman declaring the intention to create said district, which is on file in the office of the undersigned Clerk of said Commission in the C1ty Hall of said City of Bozeman, State of MOntana, and open for inspection to all interested parties and the public generally. This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana, 1947.
