WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman a
petition by the owners of properties abutting on a portion of the alley situate in Block "C" of
the original townsite of Bozeman, Montana, requesting that a portion of said alley be vacated; and,
WHEREAS, it appears to the City Commission to be in the best interest of the City of Bozeman
and the inhabitants therein that a portion of said alley be vacated.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
It is hereby declared to be the intention of the Commission of the City of Bozeman to vacate
a portion of the alley situate in Block "c" of the original townsite of Bozeman, Montana, running
north and south, more particularly described as follows:
Beginning at a point on the south line of said Block C of Original
Townsite of Bozeman, Montana, said point being twenty-one and five-
tenths (21.5) feet westerly of the southeast corner of lot 30 of
said Bock C; thence northerly parallel to and twenty-one and five-
tenths (21.5) feet distant westerly from the east line of said Lot
30, a distance of one-hundred forty-one and five-tenths (141.5) feet
to a point on the southerly line of the present east-west alley,
thence westerly along said southerly alley line a distance of twenty
(20) feet; thence southerly parallel to and eighteen and five-tenths
(18.5) feet distand easterly from the westerly line of lot 31 of said
Block C a distance of one hundred forty-one and five-tenths (141.5)
feet to the southerly line of said Block C; thence easterly along
said south line of Block C a distance of twenty (20) feet to the
point of beginning.
I Reserving unto the City of Bozeman an easement for existing sanitary
sewer mains and appurtenances and any other existing utilities, and
access to the above described property to maintain said sanitary sewer
services and other utilities.
Section 2
Notice
That the City Manager of the City of Bozeman is hereby directed to cause notice of the adoption
of this resolution of intention to be served in the same manner that service of summons is required
on all persons whose property abuts upon that portion of said alleys situate in Block "c" of the
Original Townsite of Bozeman, Montana, running north and south, which will be affected by the pro-
posed vacation and by publication once in a daily newspaper in general circulation in the City of
Bozeman, Montana.
Section 3
Time for Objections
That the regular session of the City Commission of the City of Bozeman, Montana, to be held
at the Commission Chamber in the City Hall Building, Bozeman, Montana, on Wednesday, the 7th day
of June, 1972, at the hour of one-fifteen o'clock p.m. of said day, is the time and place when and
where the City Commission will hear and pass upon all objections to the vacating of said alley.
ADOPTED BY the Commission of the City of Bozeman at a regular session thereof held on the
26th day of April, 1972.

COMMISSION RESOLUTION NO. 1510 OF THE CITY OF BOZEMAN STATING
THE INTENTION OF THE CITY COMMISSION TO VACATE A PORTION OF AN
ALLEY IN BLOCK "c" OF THE ORIGINAL TOWNSITE OF BOZEMAN, MONT-
ANA, RUNNING NORTH AND SOUTH, BEING A PORTION OF AN ALLEY
DEEDED TO THE CITY OF BOZEMAN BY THE SECURITY BUILDING INC. AS
FILED AND RECORDED IN BOOK 129, PAGE 350, COUNTY CLERK AND I

NOTICE IS HEREBY GIVEN THAT on the 26th day of April, 1972, at the regular meeting of the City Comm-
ission of the City of Bozeman, Montana, the said Commission duly and regularly passed and adopted
Commission Resolution No. 1510 entitled:

" NOTICE IS HEREBY FUTHER GIVEN that Wednesday, the 7th day of June, 1972, at one fifteen o'clock
p.m. at the Commission Room in the City Hall Building, Bozeman, Montana, is designated as the time
and place to hear objections to the vacating of the alley as more fully described in said resolution
of intention no. 1510 and is the time and place any person whose property abuts upon that portion
of said alley being vacated may appear and object to the proposed vacation.
