I WHENEAS, tnere nas been filed witn tne Clerk of tne City Conunission of tne City of Bozeman, Montao.a, a petit~on ~u due form of certain owners of properties situated on Eleventn Avenue beginning at tne nortuerl) Hue of West Curtiss Street and extending nortnerl,)' for a distance of 1,372.H feet, asking tuat a special improvement district be created for tne purpose of cOil.structing and installing an aspnaltic-concrete pavement project to include intrega.L concrete curDS and gutters aud other work ~ncidenta.L thereto; and WHEREAS, at a regular meeting of tne City Comm1ss~on of tne City of Bozeman held on tne 2nd day of Feoruar), 1972, tne aforesaid petitiou was respective.Ly considered aud granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF HOZEMAN: Sectiou 1 Declarat1.on of luteut~ou That it is hereby declared to be the intention of tbe city of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 507 for the purpose of constructing and installing an asphaltic-concrete pavement project on Eleventh Avenue beginning at the northerly line of West Curtiss Street and extending northerly for a distance of 1,372.8 feet. Said pavement project to include construction and installation of intregal concrete I curbs and gutters and other work incidental thereto. Section 2 Boundaries That the boundaries of said Special Improvement District No. 507 are described as follows: Beginning at a point being the intersection of center lines of South Eleventh Avenue and West Curtiss Street in the City of Bozeman, Montana, thence westerly on a line parallel to and 30 feet distant southerly from the southerly property line of Lot 3, Block 1, West Side Addition to the City of Bozeman, a distance of 161 feet; thence northerly a distance of 30 feet to the Southwest corner of Lot 3 of said Block; thence northerly a distance of 91.50 feet to the northwest corner of Lot 1 of said Block 1; thence westerly a distance of 14 feet to the northeast corner of Lot 6 of Block 1; thence westerly a distance of 23 feet to a point on the north line of Lot 6 of said Block 1; thence northerly a distance of 660 feet to a point, said point being 198 feet west of the center of Section 12, Township 2 South, Range 5 East; thence north a distance of 30 feet to a point. Thence northerly parallel to and 198 feet westerly from the North Quarter line of Section 12, a distance of 1040 feet to a point on the westerly extension of the southerly right of way line of West Mendenhall 8treet, said point being 198 feet west of said quarter line. Thence easterly along said extension of the southerly line of West Mendenhall Street a distance of 409.33 feet to the Northeast corner of Lot 19 of Block 4 of Springhrook Addition. Thence southerly along the westerly alley line of the north-south alley of said Block 4 a distance of 150 feet to the Southeast corner of said Lot 14. Thence south- westerly a distance of 22.36 feet more or less to the Northeast I corner of Lot 11 of said Block 4; thence southerly a distance of 130 feet along the easterly lot line of said Lot 11 to the Southeast corner, thence southwesterly a distance of 145 feet more or less to the northeast lot corner of Lot 10, Block H of Story's Addition. Contained within the above described exterior boundaries the following lots, block and tracts of land, to-wit: I Lots 13 thru 24 inclusive of Block 7, Lots 6 thru 14 inclusive of Block 6, all in West Park Addition; Lots 1 thru 3 inclusive of West Side Addition; Lots 10 thru 17 inclusive of Block H of Story's Addition; Lots 11 thru 19 inclusive of Block 4 of Springbrook Addition; Tract 168' x 504.60' lying in the NE~NE~SW~ of Section 12, Township 2 South, Range 5 East; Tract lo~' x 125.4' lying in the NEtNEtSWt, Section 12, Township 2 South, Range 5 East; Tract 19~' x 234' more or less, lying in the SEtSEtNWt, Section 12, Township 2 South, Range 5 East; Tract 198' in width lying west from north-south quarter line of Section 12, Township 2 South, Range 5 East, between the north right of way line of West Main Street and the westerly extension of the South right of way line of West Mendenhall Street, also known as School District #7 property. EXCEPTING from participation of any Special Improvement District costs, Lots 11 to 19 inclusive, of Block 4, Springbrook Addition and a tract of land known as School District #7 property being a tract of land lying Detween the north-south quarter line of Section 12 and a line parallel to and 19~' westerly therefrom and between tne north line of West Main Street and the southerly line of West Mendennall extended westerly. I Section 3 Character of Improvements Construction and reconstruction of an aspnaltic-concrete pavement on Eleventh Avenue beginning at the northerly line of West Curtiss Street and extending northerly a distance of 1,372.8 feet, including excavation, gravel backfill base course, aspnaltic-concrete plant mix base course, asphaltic-concrete plant mix surface course, cOucrete intregal type curb and gutters, medians and necessary incidentals to sucn pavemeut construction, installation and readjustment of storm drainage facilites and appurtenances, installation and readjustment of traffic control signs and signals and appurtenances thereto. Installation and construction of concrete sidewalks and adjustment of city owned and other utilities and any appurtenances tnereto. Section 4 Estimate of Cost That the estimated cost to the city of Bozeman wi 11 be one-naif of t...e state of Montana's Share of the contract cost of curbs and gutters lying wituin tne city limits and the limits of the construction plus seventeen and one-half percent (17%%) of said amount of preliminary and construction engineering. It is planned to construct 2,700.5 linear feet of curb and gutter at an estimated cost of ~4.00 per linear foot. The state of Montana's share of tne estimated cost ~~ I 33.9% of the total cost of the project and the city of Bozeman's partic~pat~on w~ll De 0.5 x 33.90% x 117.50% x 2700.5 feet x ~4.00 per foot . ~2,l51.35 plus any and all city administration, legal and other costs estimated to be ~o~3.l5, or an estimated total cost of ~3,034.50. Tne city of Bozeman will aDsorb the cost and pay for the curb and gutter to be constructed on tne north side of Main Street in the estimated amount of ~534.50, witn funds from the Gas Tas monies COMMISSION RESOLUTION NO. 150b ... u_.__..__. .....--- - ..- 287 as tnis portion of curb and gutter is a replacement item, therefore tae estimated amount of money to be assessed to the district will be $3,u34.5U less ~534.50, or $2,500.00 which will be the total amount of Special Improvement bonds to be sold. Sectiou 6 Payment sa That the payments for said improvements shall be made in five(5) annual installments extending over a period of four (4) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 507, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement I District No. 506 Fund of the city of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for that purpose in said Special Improvement District No. 507. Said bonds will draw a simple interest from the date of their registration until called for payment, at a rate not to exceed six percent (6%) per annum, which interest shall be chargeable as a part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improfement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the23~d day of February, 1972, at the hour of one fifteen o'clock p.m. of said day, is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 507, the improvements proposed to I be made pursuant thereto and the extent and character thereof, or either thereof, and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. COMMISSION RESOLUTION NO. 1506 OF THE CITY OF BOZEMAN DECLARING THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS "SPECIAL IMPROVEMENT DISTRICT NO. 507". NOTICE IS HEREBY GIVEN that on the 2nd day of February, 1972, at a regular session of the Commission of the City of Bozeman, Commission Resolution No. 1506 entitled: I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT NO. 507 FOR THE PURPOSE OF CONSTRUCTION OF AN ASPHALTIC PAVEMENT INCLUDING CONSTRUCTION OF INTREGAL CONCRETE CURB AND GUTTERS ON ELEVENTH AVENUE BEGINNING AT THE NORTHERLY LINE OF WEST CURTISS STREET AND EXTENDING NORTHERLY FOR A DISTANCE OF 1,372,8 FEET. was passed and adopted. That Wednesday, the 23rd day of February, 1972, at one fifteen o'clock p.m. at the Com- mission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1506 as the time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the construction of a pavement project with intregal concrete curbs and gutters, together with necessary appurtenances thereto on Eleventh Avenue beginning at the northerly line of West Curtiss Street and extending northerly for a distance of 1,372.8 feet. The estimated cost of said improvements within the district, including engineering, legal and I contingency, to be assessed against said district is the sum of $2,500.00. For a description of the boundaries of said Special Improvement District No. 507 reference is hereby made to Resolution No. 1506 of the Commission of the City of Bozeman declaring the intention to create said district, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public generally.
