I WHEREAS there has been presented to the City Commission of the City of Bozeman, a written and verbal request petitioning the said City Commission to extend the boundaries of the City of Bozeman so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman and having presented to the City of Bozeman proposed plats and certificate of survey of said land; and WHEREAS, the proper legal description of said contiguous tracts located in the County of Gallatin State of Montana, is as follows: ~BIT "A" Beginning at the section corner common to Section 1, 2. 11. 12. of Township 2 South. Range 5 East, M.P.M.. thence North 1052' West along the line common to said Sections 1 and 2. a distance of thirty (30) feet to a point on the northerly right of way line of the county road known as Durston Road; thence South 88009'23" West along said North right of way line being parallel to and thirty (30) feet distant northerla from the south section line of Section one (1). a distance of two thousand seven hun red three and forty-two hundredths (2.703.42) feet to a point on the north right of way line. which lies north thirty (30) feet of the one quarter corner common to Sections two (2) and eleven (11); thence South 89046' West continuing along the north right of way line of said Durston Road a distance of six hundred fifty-two and six tenths (652.6) fee t; thence at right angles to the left a distance of thirty (30) fee t to the section line common to Sections two (2) and eleven (11) being the northwest corner line of Tract 2 of Smith's Subdivision as platted and of record in the County Clerks Office. Gallatin County; thence South 0049' along the west line of said Tract 2 a distance of one thousand three hundred thirty-four and sixty-one hundredths (1.334.61) feet to the Southwest corner of said Tract 2 being a point on the east-west one six- teenth (/16) li.ne of the northwest one quarter of NW~ of said Section eleven (11); thence South 89043' West along said one sixteenth line a distance of six hundred sixty-five and eighty hundredths (665.80) feet; thence 0043' West along the north south one sixteenth line of said Northwest one quarter of NW~ of said Section Eleven I (11) a distance of one housand three hundred thirty-five and twenty-five hundredths 0,335.25) feet to the east-west one quarter line of said Section eleven (11); thense South 0(>47'30" West along the north-south one sixteenth line of the Southwest one quarter of said Section eleven (11) a distance of two thousand five hundred fifty- five and eight hundredths (2.555.08) feet to a point of intersection with the north- erly right of way line of U.S. Highway #191 as now constructed; thence along the north right of way line of U.S. 191. being along a 3004' 49" curve to the left. 1860 feet in radius with a central angle of 46052'30" an arc distance of one thousand one hundred ninety-seven and thirty one hundredths (1.197.31) feet to the point of tan- gency, being a point at right angles to centerline Station 287 + 40; thence North 42021'30" East a distance of two thousand four hundred thirty-seven and seventy hundreths (2.437.70) feet to a point of intersection with the north-south one sixteenth line of the southeast one quarter of said Section eleven (11) being also U.S. 191 203 (7) Station 358 + 55.7 thence North 1006 '42" West along said north-south one sixteenth line, being the present c~ty limits line a distance of two hundred seven- teen and twenty-one hundredths (217.21) feet to the one sixteenth corner marking the northeast corner of the west one half of the southeast one quarter (NE corner W~ SE~) of said Section eleven (11); thence North 0009'53" east a distance of two thousand six hundred seventy and eighty-four hundredths (2,670.84) feet the point of inter- section with the north line of said Section eleven (11), being the northeast corner of the west one half of the northeast one-quarter (NEcorner of the W~, NE~) of said Section eleven (11); thence North 88009'23" East along the north line of said Section eleven (11) a distance of one thousand three hundred fifty-three and forty-two hun- dredths (1.353.42) feet to the true point of beginning. Containing within the above exterior boundaries 243 Beres more or less to be known as Far West Annexation. thereand of WHEREAS. it will be for the best interests of the City of Bozeman and the inhabitants/of/the contiguous tracts hereinbefore described to extend the boundaries of the City of Bozeman so as to include the said contiguous tracts hereinbefore described within the corporate limits of the said I City of Bozeman. NOW,THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN Section 1. That pursuant to the provisions of Section 11-403, Revised Codes of Montana, 1947, it is hereby declared to be to the best interest of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so as to include the contiguous tracts hereinbefore described with- in the boundaries and corporate limits of the City of Bozeman. HARDING, I Clerk of the City Commission ~OTICE IN RE COMMISSION RESOLUTION NO. 1527 OF THE CITY OF BOZEMAN STATING THE INTENTION OF THE CITY COMMISSION TO EXTEND THE BOUNDARIES OF SAID CITY OF BOZEMAN TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND ADJOINING SAID CITY. NOTICE IS HEREBY GIVEN that on the 26th day of July, 1972, at a regular meeting of the City Commission of the City of Bozeman, the said Commission duly and regularly passed and adopted Comm- ission Resolution No. 1527, entitlted: "A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, EXTENDING THE BOUNDARIES OF SAID CITY OF BOZEMAN SO AS TO EM- BRACE AND INCLUDE CERTAIN TRACTS OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED WITHIN THE CORPORATE LIMI T8 THEREOF." NOTICE IS HEREBY FURTHER GIVEN That Wednesday, the 23rd day of August. 1972, at one o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated as the time and place for hearing objections to the action proposed to be taken in said Resolution No. 1527, whereby it is proposed to embrace the hereinafter described contingent territories within the corporate limits of the City of Bozeman, Montana. Expressions of approval or disapproval by resident freeholders of the territories proposed to be embraced must be made in writing and filed with the Clerk of the I Ci.ty Commission of the City of Bozeman not later than twenty (20) days after the date of the first publication of this Notice. A description of the boundaries of the territories proposed be embraced by said Commission No. 1527 is as follows: Same as EXHIBIT "A" on page 348 This Notice is given pursuant to the provisions of Section 11-403, Revised Codes of Montana, 1947.
