'. . ,,~ 111)0 j. b"'.I\""r~ COMMISSION RESOLUTION NO. 1522 ~I-'J.-I -1') .....w...--' -". t\!.~. ..,.-.~ .....-v""..~ A IlliSOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICULARLY DESCRIBED TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO I AS TO INCLUDE THE SAID CONTIGUOUS TRACT WITHIN THE CORPORATE LIMITS THEREOF. WHERAS, there has been presented to the City Commission of the City of Bozeman a written and verbal request petitioning the said City Commission to extend the bound- aries of the City of Bozeman so as to include certain tracts of land with- in the boundaries of the City of Bozeman and having presented to the City of Bozeman proposed plats and certificates of survey of said land; and WHEREAS. the proper legal description of said contiguous tracts located in the county of Gallatin, state of Montana, is as follows: A portion of the East one half of the Northeast one quarter of Section Twenty-four (24), Township Two (2) South, Range Five (5) East, M.P.M.. and more particularly described as fdlows: Beginning at the section corner common to Sections Thirteen (13) and Twenty-four (24) of Township Two (2) South. Range Five (5) East and Sections Eighteen (18) and Nineteen (19) of Township Two (2) South, Range Six (6) East; thence South 0013' West along the range line a dis- tance of one hundred sixty-four and ninety-seven-hundredths (164.97) I feet to the true point of beginning; thence South 89004'00" West a distance of two hundred sixty-four and seven-hundredths (264.07) feet; thence North 00013'00" East a distance of one hundred sixty-four and ninety-seven-hundredths (164.97) feet to a point on the northerly line of Section Twenty-four (24), Township Two (2) South, Range Five (5) Eas t; thence South 89004' West along said North line of Section Twenty- four (24) a distance of five hundred and seventy-two and forty-four- hundredths (572.44) feet to a point of intersection with the easterly right of way line of the Gallatin Valley Railroad now known as the Chicago, Milwaukee, St. Paul & Pacific Railway Company; thence conti- nuing South 89004' West along said northerly section of Section Twenty- four (24) to the point of intersection with the westerly right of way line of said railway line; thence South 30025' West along the said westerly right of way line a distance of five hundred thirty-five and eighty-hundredths (535.80) feet to the point of curvature of a 40 curve to the left with a central angle of 30018' and a radius of one thousand four hundred eighty-two and five tenths (1482.5) feet; thence southerly west along said curve being along the westerly right of way line, a distance of two hundred forty-seven and eighty~five-hundredths (247.85) feet to a point of intersection with the northsouth one sixteenth line, being the westerly line of the East one half of the Northeast one quarter of said section Twenty-four (24). thence southerly along one sixteenth line , being along the right of way of the railway to a point of which is twenty-five (25) feet at right angles to the centerline of the rail- road track; thence southwesterly along the westerly right of away curve of said railway being along a 40 curve to the left with a centeral angel of 30018' and a radius of one thousand four hundred fifty-seven and five- tenths (1457.5) feet a distance of four hundred forty-six and two-hund- redths (446.02) feet to the point of tangency of the said 40 curve; thence continuing along the westerly right of way line and bearing of South 0007' West a distance of one thousand four hundred forty-three and one-tenth I (1443.1) feet to a point of intersection with the east west one quarter line of said Section Twenty-four (24); thence North 8j018' Ea~t along said one quarter line a distance of one thousand three hundred ninety- seven and fifty-two-hundredths (1397.52) feet to the east one',quarter corner of said Section Twenty-four (24); thence North 0013' East along the easterly line of said Section Twenty-four (24) a distance of two thousand four hundred eighty-six and fifty-four-hundredths (2486.54) feet to the true point of beginning. To be known and designated as Figgins Addition to the'City of Bozeman, Gallatin County, Montana, and containing within the above described exterior boundaries 79.775 acres consisting of 5.202 acres more or less of COMMISSION RESOLUTION NO. 1522. - - __.._____. __. .__._.u_____ --...-- 337 Chicago, Milwaukee, St. Paul & Pacific Railway right of way land and 74.573 acres of private land owned by Annie May Figgins, a married woman; Eugene Graf, Jr., and Genevieve S. Graf, husband and wife; and the Montana National Bank of Bozeman as trustee and record title holder. WHEREAS, it will be for the best interest of the City of Bozeman and the inhab- itantsthereof aNd of the inhabitants of the contiguous tracts hereinbefore described I to extend the boundaries of the City of Bozeman so as to include the said contiguous tracts hereinbefore described within the corporate limits of the said City of Bozeman. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section l. That pursuant to the provisions of Section 11-403, Revised Codes of Montana, 1947, it is hereby declared to be to the best interest of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so as to include the contiguous tracts hereinbefore described within the boundaries and corporate limits of the City of Bozeman, Montana. PASSED AND ADOPTED by the Commission of the City of Bozeman, Monana, at a regular session held on the 12th day of July, 1972. Mayor ATTEST: I NOTICE IN RE COMMISSION RESOLUTION NO, 1522 OF THE CITY OF BOZEMAN, MONTANA, STATING THE INTENTION OF THE CITY COMMISSION TO EXTEND THE BOUNDARIES OF SAID CITY OF BOZEMAN TO EMBRACE AND INCLUDE A CERTAIN TRACT OF LAND ADJOINING SAID CITY. NOTICE IS HEREBY GIVEN that on the 12th day of July, 1972 , at a regular meeting of the city commission of the City of Bozeman, the said Commission duly and regularly <J passed and adopted Commission Resolution No. 1522 entitled: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE TO THE BEST INTEREST OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY - 6F BOZEMAN SO AS ~O"INCLUDE THE SAID CONTIGUOUS TRACT OF LAND WITHIN THE CORPORATE LIMITS THEREOF. Expressions of approval or disapproval by resident freeholders of the territorries proposed to be embraced must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than twenty (20) days COMMISSION RESOLUTION NO. 1522. --.---.----.--..-----. ----~---- -'-. 338 after the date of the first publication of this notice.
