THE CONSTRUCTION AND INSTALLATION OF SAID TRUNK SANITARY SEWER MAINS ARE MORE SPECIFICALLY DESCRIBED AS FOLLOWS: AN EIGHT (8) INCH SANITARY SEWER MAIN ON SOUTH I NENETEENTH AVENUE FROM TIlE PRESENT SEWER TO LINCOLN ROAD AND THE CON- STRUCTION AND INSTALLATION OF A TEN (10) INCH SEWER FROM soum NINE- TEENTH (19) AVENUE EASTERLY A DISTANCE OF TWO THOUSAND FOUR HUNDRED FIFTY FEET MORE OR LESS. TIlE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL ']RENCH EXCAVATION AND BACKFILL, BEDDING MATERIALS, INSTALLATION OF SEWER MAINS, NECESSARY WYES, MANHOLES AND OTHER APPURTENANCES. 00000000000000000000000000000 WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana. a petition in due form of certain owners of properties situated within the boundaries of Special Improvement District No. 516 as hereinafter more specifically described, asking that a spec- ial improvement district be created for the purpose of constructing and installing sanitary sewer lateral mains to provide sanitation disposal to the lots within the district. WHEREAS. that at a regular meeting of the City Commission of the City of Bo~man, State of Montana, held on the 16th day of August, 1972, the aforesaid petition was respectively considered and granted; NOW, THEREFORE. BE IT RESOLVED BY TIlE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 516 of the City of Bozeman, for the purpose of constructing and installing trunk sanitary sewer mains, said project to include all appurtenant work for the construction and installation of trunk sanitary sewer mains I to serve the property included within the district boundaries. Section 2 Boundaries The boundaries of said Special Improvement District No. 516 are described as follows: Beginning at the west one quarter corner of Section 13, Township 2 South, Range 5 East, said point being on the centerline of South Nineteenth Avenue; thence westerly a distance of fifty (50) feet to the West line of said South Nineteenth Avenue; thence northerly along the west line of South Nineteenth Avenue a distance of 860 feet; thence easterly a distance of 100 feet to a point on the east line of South Nineteenth Avenue; thence southerly along the east line of South Nineteenth Avenue a distance of 800 feet to the point of intersection with the north line of West Lincoln Road; thence easterly along said north line of West Lin- coln Road a distance of 2327.54 feet to a point; thence southerly a distance of 60 feet to the northeast corner of Lot 1 of Tract 1 of the Tai Lane Addition to the city of Bozeman; thence South 0001' East a distance of 251.0 feet; thence North 89019' East a distance of 308.7 feet; thence South 0006' East a distance of 1084.2 feet to the north line of Boylan Addition No.1; thence easterly along said north line a distance of 30 feet to the east line of said Boylan Addition No. I, Thence South 0006' East a distance of 45.0 feet to a point on the south line of Kagy Boulevard; thence South 0006' East a distance of 620.83 feet to the south- east corner of the Boylan Addition No. I to the City of Bozeman; thence westerly along the southline of said Boylan Addition No. 1 a distance of 1376 feet to the west line of said Boylan Addition No.1; thence norther- ly along said west line a distance of 666 feet to the north line of said Boylan Addition No.1; thence along said North line North 89028' East a distance of 697.3 feet; thence North 0035' East a distance of 1333.7 feet to a point on the south line of West Lincoln Road; thence westerly I along said south line of Lincoln Road a distance of 1577.77 feet to the northeast corner of the Remington Addition to the City of Bozeman; thence South 0025' West a distance of 1329.0 feet to the southeast corner of the Remington Addition; thence South 89051'20" West a distance of 415.37 feet; thence North 0025' East a distance of 880.3 feet; thence west 10 feet; thence North 0025' East a distance of 448.7 feet to the northwest corner of the Remington Addition; thence South 89051'20" West a distance of 50 feet to the point of beginning. Included within the above described exterior boundaries are the following lots, blocks and tracts of land, to-wit: Lots 1 thru 6 inclusive of Tract 1 of Tai Lane Addition, Tract I of the Boylan Addition Number 1 and Lots 1 thru 3 inclusive of the Remington Addition. COMMISSION RESOLUTION NO. 1532 363 Section 3 Character of Improvements The character of the improvement to be made is the installation and construction of eight (8) and ten (10) inch sanitary sewer trunk mains including excavation. backfill. bedding materials. pipe wyes, manholes and other appurtenant work thereto. Section 4 I Es tima te of Cos t The total estimated cost of the improvement to serve the district including engineering, legal and contingency is $58,000.00. Section 5 Method of Assessment WHE REAS , the City Commission of Bozeman resolves that the contemplated improvements under Special Improvement District No. 513 will directly benefit not only the adjoining property but the entire district. therefore the cost of such improvement is to be assessed against the entire dis- trict, each lot, tract or parcel of land within the district will be assessed for that portion of the whole cost. which its area bears to the area of the entire district exclusive of public streets. avenues and public places. The total actual assessable area within the entire district is 49.127 acres or 2,139,979.08 square feet. and is the area on which all protests will be received, con- sidered and determined. It is also the figure on which all assessments will be figured. Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years. but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 516, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where I necessary. to be issued and chargeable against a fund to be known and designated as Special Im- provement District No. 516 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City. singly or in multiples. and in the order of their registration. whenever funds are avail- able for the purpose of said Special Improvement District No. 516. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed seven percent (7%) per annum. which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the pro- visions of Title 11 of the Revised codes of Montana. 1947. relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman. to be held at the commiss- ion chamber, City Hall Building, Bozeman, Montana. on Wednesday, the 6th day of September. 1972. at the hour of 1:15 o'clock p.m. of said day. is the time and p1ac~ when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District 516, the improvements proposed to be made pursuant thereto and the extent and character thereof. or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required. of the adoption of this resolution of intention. NOTICE IS HEREBY GIVEN that on the 16th day of August, 1972, at a regular session of the I Commission of the City of Bozeman, Commission Resolution No. 1532 entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NUMBER 516 FOR THE PURPOSE OF CONSTRUCTION AND INSTALL- ATION OF TRUNK SANITARY SEWER MAINS AND APPURTENANCES TO SERVE THE LANDS INCLUDED WITHIN THE DISTRICT BOUNDARIES. That Wednesday, the 6th day of September, 1972, at 1:15 o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designatedby Resolution No. 1532 as the time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protest must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the construction and install- ation of sanitary sewer lateral mains, said project to include all appurtenant work for the con- struction and installation of sewerage system to provide sanitary sewers for all lots within the I district. The estimated cost of said improvements within the district including engineering, legal and contingency is $58,000.00. For a description of the boundaries of said Special Improvement District No. 516, reference is hereby made to Resolution No. 1532 of the Commission of the City of Bozeman declaring the inten- tion to create said district, which is on file in the office of the undersigned clerk of said Comm~ ission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public generally.
