SPECIFICALL Y AS FOLLOWS: AN EIGHT INCH LATERAL SANITARY SEWER TO SERVE THE ~ - TAl LANE ADDITION, A PORTION OF BOYLAN ADDITION AND TO PROVIDE SANITARY SEWER SERVICE TO THE MONTANA STATE UNIVERSITY STADIUM. I THE CONSTRUCTION AND INSTALLATION TO INCLUDE ALL TRENCH EXCAVATION AND BACK- FILL, BEDDING MATERIALS, INSTALLATION OF SEWER MAINS, NECESSARY WYES, MAN- HOLES AND OTHER APPURTENANCES. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated within the boundaries of Special Improvement District No. 51S as hereinafter more specifically described, asking that a special improvement district be created for the purpose of constructing and installing sanitary sewer lateral mains to provide sanitation disposal to the lots within the district. WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman, State of Montana. held on the 9th day of August. 1972, the aforesaid petition was respectively considered and granted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: ~ection 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bo~eman to create a special im- provement district to be known and designated as Special Improvement District No. SlS of the City of Bozeman for the purpose of constructing and installing a sanitary sewer lateral to serve the property included within the district boundaries. Section 2 Boundaries The boundaries of said Special Improvement District Number S15 are described as follows: I Beginning at a point on the west line of South Eleventh Avenue, said point being west a distance of thirty (30) feet and South 0006' East a distance of two hundred fifty-one (251.0) feet from the center of Section Thirteen, Township Two South, Range Five East of Montana Principal Meridian; thence South 0006' East along the west line of South Eleventh Avenue a distance of one thousand eighty-four and 2/10 (1,084.2) fee t ; thence North 89028' East a distance of thirty (30.0) feet to the northeast corner of the Boylan Addition No. 1 to the City of Bozeman; thence South 0006' East a distance of forty-five (45.0) feet to a point on the south line of Kagy Boulevard; thence easterly along said south line of Kagy Boulevard a distance of two hundred eighty-four and 99/100 (284.99) feet to a point; thence South 0006' East a distance of six hundred twenty and 83/100 (620.83) feet to a point; thence westerly a distance of two hundred eighty-four and 99/100 (284.99) feet more or less to the southeast corner of the Boylan Addition No. 1 to the City of Bozeman; thence westerly along the south line of said Boylan Addition No.1 a distance of six hundred forty-eight and 5/10 (648.5) feet to a point; thence northerly a distance of six hundred sixty-six (666) feet more or less to the southwest corner of the Tai Lane Addition to the City of Bozeman; thence North 0035' East a distance of one thousand three hund- red thirty-three and 7/10 (1,333.7) feet to the northwest corner of said Tai Lane Addition; thence northerly across Lincoln Road a distance of sixty (60.0) feet to a point on the north line of said Lincoln Road; thence North 89019' East along said north line of Lincoln Road a distance of three hund- red twenty-four and 4/10 (324.4) feet to a point; thence southerly across Lincoln Road a distance of sixty (60) feet to the northeast corner of Lot 1 of the Tai Lane Addition; thence South 0001' West a distance of two hundred fifty-one (251.0) feet; thence North 89019' East a distance of three hundred eight and 7/10 (308.7) feet to the point of beginning; Contained within the above described exterior boundaries are the following lots, block and tracts of land, to wit: I Lots 1 through 6 inclusive of the Tai Lane Addition, the east portion of Tract 1 of the Boylan Addition No.1, and a portion of the west one half of the northwest one quarter of the southeast one quarter of Section 13, said tract being property of Montana State University. Sec tion 3 Character of Improvements The character of improvements to be made is the installation and construction of eight (8) inch lateral sanitary sewer trunk mains including excavation, backfill, bedding materials, pipe, wyes, manholes and other appurtenant work thereto. Section 4 Estimate of Cost COMMISSION IESOLUTION NO. 1530 --... (;,J!~8 . , r"" tJV The total estimated cost of the improvemen~ to serve the district including engineering, legal and contingency is $26,000.00. Sec tion 5 Method of Assessment WHE REAS , the City Commission of Bozeman resolves that the contemplated improvements under Special Improvement District No. 515 will directly benefit not only the adjoining property but the entire d is tric t, therefore the cost of such improvement is to be assessed against the entire district, each I lot, tract or parcel of land within the district will be assessed for that portion of the whole cost, which its area bears to the area of the entire district exclusive of public streets~ avenues and public places. The total actual assessable area within the entire district is 30.897 acres or 1,345,839.12 square feet, and is the area on which all protests will be received, considered and determined. It is also the figure on which all assessment will be figured. Section 6 Payments The payments for said improvement shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 515, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improve- ment District No. 515 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose of said Special Improvement District No. 515. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed seven percent (7%) per annum, which interest shall be chargeable as part of the cost of construction and installa- tion of said improvements. The bonds will be issued and sold in accordance with the provisions of Title II of the Revised Codes of Montana, 1947, relating to special improvement districts in Cities I and towns, and any amendments thereof or thereto. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman, to be held at the Comm- ission chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 30th day of August, 1972, at the hour of 1:15 o'clock p.m. of said day, is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the Creation of said proposed Special Improvement District No. 515, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof, and the Clerk of the City Commission, be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. That Wednesday, the 30th day of August, 1972, at one-fifteen o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1530 as the time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protest must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the construction and install- ation of sanitary sewer lateral mains, said project to include all appurtenant work for the con- struction and installation of sewerage system to provide sanitary sewers for all lots within the district. The estimated cost of said improvements within the district including engineering, legal and contingency is $26,000.00. For a description of the boundaries of said Special Improvement District No. 515, reference is hereby made to Resolution No. 1530 of the Commission of the City of Bozeman, Montana, declaring the intention to create said district, which is on file in the office of the undersigned clerk of the said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public generally.
