HHEREAS, The City Council and the Commission of the City of Bozeman have heretofore duly and regularly passed council and Commission Resolutions creating street sprinkling districts within the I City of Bozeman and defining the boundaries thereof and providing for the asseSSment of the cost of sprinlclinf, the same as set forth in Resolutions hereinafter referred to; and HHEREAS , the streets ~"ithin the boundaries of said Street Sprinkling Districts have been sprink- led during the year 1972, as contemplated in said Resolution, in accordance wi. th the terms and cond i- bans thereof; and l'ffiEREi\S , the street sprinkling districts and the resolutions creating the same, the total front- age of the property within said district to be assessed, the total cost of said sprinkling within said districts and the proportion thereof charBeable to the property therein is hereinafter set forth. NOH, THEREFORE, pursuant to the provisions of Section 11-2252 to 11-2267, inclusive, R.C.M., 1%7, the TIozeman Hunicipal Code and said Council and Commission Resolution creating said street sprinkling districts. BE IT P~SOLVED AND IT IS HEREBY ORDERED BY THE COI1MISSION OF THE CITY OF BOZE~~N, STATE OF MONTANA. S e c ti on 1: That for the year 1972, the City of Bozeman has waived the sprinkling assessment of all street sprinkling districts except street sprinkling District No's. 1, 2, 3, and 6,.; for the year 1972, the City of Bozeman has defrayed the cost of $7,548.40 of sprinkling streets in the several streets sprinkling districts pursuant to resolution creating the S8me, and seventy-five percent (75%) of the entire cost thereof $5,6Gl.31 exclusive of the cost of sprinkling parks and public areas, the total number of linear feet of property to be assessed, and the rate per linear foot, is as follows: Sprinkling District No. 1, created by Council Resolution No. 42LI'~, Hain Street between Halle,ce and Fourth Avenue snd Bozeman, Grand, Hillson, Tracy, Black and Rouse i\venues, One-Half (~) block of each side of Main Street a total frontage of 9355.90 feet, the I sum of S2,!~37.82 being 75% of the entire amount, or at an approxinate rate per front foot of side street frontage of $0.2659092123. Sprinkling District No. ? created by Council Resolution No. 995, Babcock Street from ~, east property line of South Rouse Avenue to West property line of South Fourth Avenue, including one-half (~) block on Rouse, Bozeman, Black, Tracy, Willson and Grand Avenue from Babcock Street to South property line of Olive S reet and Third Avenue, between Babcock and Main Street, a total frontage of 7221.20 feet, the SUm of $1,281.32 being 75% of the entire amount or at an approximate rate per front foot of main or side street frontage of $0.1774386539. Sprinkling District No. 3, created by Council Resolution No. 996, Mendenhall Street from the East property line of North Rouse Avenue to the West property line of North ThiT.d Avenue, including one-half (~) Block on Rouse, Bozeman, Black, Tracy, Willson and Grand Avenues South from Mendenhall Street, and North Third Avenue, be tw(~en Men- denhall Street and Main Street a total frontage of 6359.58 feet, the sum of $1,O!f7.32, being 75% of the entire amount, or at an approximate rate per front foot of main or side street frontage of $0.16&6331235. Sprinkling District No. I, created by Council Resolution No. 997, West Main Street . , from the West property line of vacated Fourth Avenue to the West property line of South Eighth Avenue, a total frontage of 2661.00 feet, the sum of $344.85 being 7':)"/0 of the entire Rr:lolmt, or at an approximate rate per front foot of main and side street frontage of $0.317493423. Section 4: That the Clerk of the Con~ission be, and she is hereby ordered and directed to pub- lish in the Bozeman D~ily Chronicle, a daily newspaper printed and published in the said Ci.ty of Bozeman a notice signed by the Clerk of the Commission, and stating that a resolution levying a special assessment of taxes to defray seventy-five (75'%,) of the cost of sprinkling streets in the I said street sprinkling districts for the year 1972. is on file in the office of the Clerk of the Commission subject to inspection for a period of (i ve (5) days; that said Notice shall state the time and place at \.Jhich objections will be heard by the Commission to the final adoption of this resolution. NOTICE IS HEIlliBY GIVEN, that at a regular session of the Commission of the City of Bozeman, held on tlH~ 20th day of September 1972, Commission Resolution No. 1542 was duly passed and adopted; that said Commission Resolution No. 1542 levies and assesses a special assessment of taxes upon all the property in street sprinkling districts of said City of Bozeman to defray seventy-five percent (7501.,) of the cost of sprinkling streets within said Street sprinkling districts for the year 1972. That said Street sprinkling districts, and the Resolution creating the same and the amount of the assessments are as follows: Street Sprinkling District No. 1 created by Resolution No. 424~, in the amount of $2,487.82. Street Sprinkling District No. 2 created by Resolution No. 995, in the amount of $1;281.32. Street Sprinkling District No. 3 created by Resolution No. 996, in the amount of $1;047.32. Street Sprinkling District No.4 created by Resolution No. 997. in the amount of $ 8!fLf. 85. That said Resolution No. 1542 is now on file in the office of the Clerk of the City Commiss ion of said City of Bozeman subject to inspection of all persons interested for a period of five days; that Wednesday the 27th day of September, 1972 , at 1:15 o'clock p.m. of said day at a regular session of the Commission of the City of Bozeman, Commission Room, City H1111 Building, has been designated I as the time and place Hhen and ",here said Commission will hear and pass upon any and all object10ns that may be made to the final adoption of said Commission Resolution No. 1542 and the levying of sa td assessmen t; and that said Resolution will be finally passed and adopted at said reBular session of said Commission. subject to such corrections and amendments as may be made upon objections made and filed within five days limit as provided by law.
