DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM- PROVEMENT DISTRICT NO. 519 FOR THE PURPOSE OF CONSTRUCTION AND IN- STALLING AN ASPHALTIC CONCRETE PAVINGt CONCRETE INTEGRAL CURBS AND GUTTERSt NECESSARY APPURTENANCES THERETOt ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAINAGE PIPEt INLETS t MANHOLES, I DITCHES AND ANY OTHER APPURTENANCES TO THE STORM DRAINAGE SYSTEM ON WEST MENDENHALL STREET AND WEST LAMME STREET BETWEEN TENTH AVE- NUE NORTH AND ELEVENTH AVENUE NORTH LYING IN SPRINGBROOK ADDITION TO THE CITY OF BOZEMAN, MONTANA. HHE REAS , there has been filed \.Jith the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated on West Mendenhall Street and Lamme Street between Tenth Avenue North and Eleventh Avenue North lying in Springbrook Addition to the City of Bozeman, Montana, asking that a special improvement district be created for the purpose of constructing and installing an asphaltic concrete pavement project to include integral concrete curbs and gutter, and other work incidental thereto; and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 29th day of Novembert 1972, the aforesaid petition was respectively considered and granted; NOW, THEREFORE , BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create an extended special improvement district to be known and designated as Special Improvement District No. 519 for the purpose of constructing and installing an asphaltic concrete pavement project on West Mendenhall Street and West Lamme Street between Tenth Avenue North and Eleventh Avenue North lying in Spring- brook addition to the City of Bozeman, Montana. Said pavement project to include construction and installation of integral concrete curbs and gutters and other work incidental thereto. I Section 2 Boundaries. That the boundaries of said Special Improvement District Number 519 are described as follows: Beginning at the southwest corner of Lot 14 of Block 4 of Springbrook Addition to Bozeman, Montana; thence easterly along the south lot line of said Lot 14 across the north south alley of said Block 4 and along the south lot line of Lot 6 of said Block 4 and said lot line exten- ded easterly to the point of intersection with the center line of North Tenth Avenue; thence northerly along the centerline of said North Tenth Avenue a distance of 720 feet; thence at right angles westerly a distance of 30 feet to the northeast corner of Lot 3 of Block 12 of said Springbrook Addition; thence westerly along the north lot line of said Lot 3 across the north south alley and along the north line of Lot 14 of said Block 12 and said line exextended to a point 30 feet westerly of the west line of said Block 12; thence southerly parall- el to and 30 feet distant westerly from the west lines of Block 12, 4 and 5 of said Springhrook Addition a diRtance of 720 feet; thence easterly a distance of 30 feet to the point of beginning. Containing within the above described exterior boundaries the foll- owing lots and blocks, to wit: Lots 1 through 6 inclusive and Lots 14 through 19 inclusive of Block 4; Lots 1 through 24 inclusive of Block 5 and Lots 3 through 14 in- clusive of Block l2t all in Springbrook Addition to Bozeman, Montana. Section 3 Character of Improvements Construction of an asphaltic concrete pavement project with concrete integral curbs and gutters together with storm drainage and all necessary appurtenances on that portion of West Mendenhall I Street and West Lamme Street lying between North Tenth Avenue and North Eleventh Avenue in Spring- brook addition. Sec tion l~ Estimate of Cost The total estimated costs of the improvements within the district, including engineering, legal and contingency is $25,000.00. Section 5 Method of Assessment The cost of such improvements is to be assessed against the entire district, each lot or parcel COMMISSION RESOLUTION No. 155(+ 409 of land within such district will be assessed for that part of the whole cost which its area bears to the area of the entire district, exclusive of streets, avenue, alleys and public places; and further, each square foot of land within the district lying within 25 feet of the line of the street or avenue on which the improvements herein provided for are made, shall bear double the amoun t 0 f the costs of such improvement per square foot of such land that each square foot of any other land within the distri.ct shall bear. I See tion 6 Extended District The City Commission of the City of Bozeman does hereby find that the contemplated work and im- provements are, in the opinion of the City Commission, of more than local or ordinary public benefit and that the cost and expense of such improvements shall be chargeable on an extended district and the City Commission does hereby declare that the above described district and all lots included there- in will be benefited by the contemplated improvements and that said district and all lot included therein shall be assessed to pay the costs and expenses thereof. Section 7 Payments That the payments for said improvements shall be made in twenty (20) annual installments ex- tending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 519, as authorized by 1<'n". Such bonds will be in denominations of $100.00 each, and fractions of multiples of $100.00 Hhere necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 519 Fund of the City of Bozeman. The bonds \-7111 be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for that purpose in said Special Improvement District No. 519. Said bonds Hill draw a simple interest from the date of their registration until called for payment, at a rate not to ex- I ceed seven percent (7%) per annum, ~hich interest shall be chargeable as a part of the cost of cons- truction and installation of said improvements. The bonds will be issued and sold in accord ance ~ith the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 19ft7, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and tm"ns, and any amendments thereof or thereto. Section 8 Protests and Notice That the regular session of the Ci.ty Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 31st day of January 1973, at the hour of one fifteen o'clock p.m.of said day, is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 519, the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereo~ and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. That Wednesday, the 31st day of January, 1973, at one-fifteen o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1554 as the time and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the construction of a pave- ment project with integral concrete curbs and gutters, together with necessary appurtenances there- to on West Mendenhall Street and \.Jest Lamme Street between Tenth Avenue North and Eleventh Avenue North lying in Springbrook Addition. The estimated cost of said improvements within the district, including engineering, legal and contingency is $25,000.00. I For a description of the boundaries of said Special Improvement District No. 519 reference is hereby made to Resolution No. l551~ of the Commission of the Ci ty of Bozeman declaring the intention to create said district, which is on file in the office of the undersigned Clerk of said Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested parties and the public generally.
