CRETE PAVING, INTEGRAL CONCRETE CURB AND GUTTERS, NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRATNAGE PIPE, DITCHES, INLETS, MANHOLES AND OTHER APPURTENANCES TO THE STOP~ I DRAINAGE SYSTEM ON NORTH 20TH ,WENUE FROM MAIN STREET TO TIlE NORTH LINE OF 'dEST BEALL STREET AND ON A PORTION OF WEST BEALL STREET BEGINNING AT THE \-JEST LINE OF NORTH 20TH AVENUE TO 1\ POINT 117 FEET HESTERLY THEREFROM. 1\fHEREAS, it has been determined by the City Commission of the City of Bozeman, Montana, that it is for the best interest of the City of Bozeman and the owners of property situated on North 20th Avenue from Main Street to the north line of West Beall Street and on a portion of West Beall Street that a special improvement district be created for the purpose of constructing and installa- tion of an asphalt concrete type pavement, together with integral concrete curbs and gutters and necessary appurtenances thereto, together h'ith necessary storm drainage facilities appurtenanct to suc.h paving; NOH, THEP..EFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Sec tion 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create n special im-- provement district to be known and designated as Special Improvement District No. 520 for the purpose of constructing and installing an asphalt concrete type pavement project on North 20th Avenue from Main Street to the north line of West Beall Street and on a portion of West Beall Street beginning at the west line of North 20th Avenue to a point 117 feet westerly therefrom, said pavement project to include construction and installation of integral concrete curbs and gutters and necessary appurtenances there to, together 1;7ith necessary storm drainage facilities appurtenant to such paving. It is also the figure on which all assessments will be figured. S ection G P ayments That the payments for said improvement shall be made in t\!7enty (20) annual installments ex- tending over a period of nineteen (19) years, but this shall not be construcd to prevent payment in full at: any regular payment date by any property ol-mer 17ho desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to bE' 0') ta inell from the sale of bonds of said Special Improvement District No. 520 as authorized by 1,1'." . Such bonds Hill be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary. to he issued and chargeable against a fund to be known and designated as Special Improvement District No. -520 Fund of the City of Bozeman. The bonds wi. 11 be redeemAble at the option of the City, singly or in multiples, and in the order 0 f their registr<1tion, whenever funds are availahle for that purpose in said Special Improvement Djstrct No. 520. Said bonds will draw a simple interest from the date of their registration until called for payment, at a rate not to ex- ceed seven percent (7"/,,) per annum, which interest shall he chargeable as a part of the cost of the construction and installation of said improvements. The bonds Ivill he issued <'md sold in accordance I \Vi th the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 191f 7, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 19/:7, relating to special improvement di.stricts in Cities and Towns and any amendments thereof or thereto. That Hednesday, the V,th day of Harch, 1973, at one-fifteen o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1563 as the time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of sllch improvements, or the creation of said district. Protests must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the construction of a pave- ment project with integral roncrete curbs and gutters, together with necessary storm drainage faei- li,ties appurtenant to such paving on North 20th Avenue from Main Street to the north line of Hest Beall Street and on a portion of (lest Beall Street beginning at the west line of North 20th Avenue to a point 117 feet westerly therefrom. The total estimated costs of the improvements within the district including engineering, legal and contingency is $91[,000.00. The total cost to be assessed to the prope-rty owners within the said Special Improvement District No. 520 is $67,000.00, the difference of $27,000.00 to be paid from H.B.!f2 Funds (G<1soline Tax Refund). For a description of the boundaries of said Special Improvement District No. 520 reference is hereby made to Rf'solution No. 1563 of the Commission of the City of Bozeman declaring the intention to create said district, \vhich is on file in the office of the undersigned Clerk of said ('i)mmission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested I parti,es and the publ Ie generally.
