T'JHEREAS, at a regular session of the Cot'lmission of the City of 13oz('l1\an, State of Montana, heh1 on the 2qth ~ay of November, 1972, the snid Commission duly passed Commission Hesolution No. 1 'j'ii, declaring it to be the ;ntention of th0 said Commissi_on to create a Special Imp"ovement District to be known and designAted as Special Improvement District No. 519 of the said City for the purpose of conp,tr,\cting and installing an asphaltic concrete pavement project to include integral concrete curbs and gutter on l'Jest Hendenhall Street and \-Jest Lamme Street between Tenth Avenue North and Eleventh Avenue North lying in Springbrook Addition to the City of Bozeman, Montana, and to specially assess the cost and expense of makins said improvement against the property within said District under and by virtup of the provisions of the len"s of the state of Montana in such case Inade and provided, eDt1 said Commission Resolution No. 1554 is hereby referred to and made a purt hereof for further parti- ('ulars in respect to the boundaries of said Special Improvement District: No. 519, the estilr:atcd cost of said improvements Bnd the method of assessing the same against the property of said District; and \mEREAS, NO'I'TCE OF TIlE Pl\SSAGE of s<lid Comnission Resolution No. l'i 5/' \-18S dul y published, as required by la\,) , in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, Montana, and by sending a copy of such notice by U.S. Mail to each person, fjrm or corporation having property \,.,;thin the proposed District at his or its last known address, upon the same date tha t s11ch notice was first published as nforesaid, and due proof havinG been made of the publication and service of said notice; and I \\Tl-lEl'>EAS. \'7i thi n the time provided by la'-" and sAid publil>hed elUd served notice, 80 . 2 9'7, (1 f t 11 e property OI-lHers ?rotef; teel the creation of said proposed Special Improvement District No. 519, and the City Commission was in regular session on the 10th day of January, 1973, at one fifteen o'clock p.m of said day, at the Commission Chamber in the City Hall Building in said City of Bozeman, the same being the time and place designated in said notice for passing upon all protests, if any against the proposed work or against the creation or extent of said District, or both or either; tha t the City Commission did unanimously adopt said Resolution No. 1554 in spite of said protests, all in accordance <,.;ith the provisions of Section 11-2206, Revised Codes of Montana, 1947, as amended; and it further appearing that all of the proceedings for the creation of said District have b(>en la'",ful and regular; NOW, THEREFORE, BE IT RESOLVED BY THE COHMISSION OF THE CITY OF BOZEMAN: S ection 1 That said Special Improvement District No. 519 of the City of Bozeman, StatE' of 11ontana, be, and the same hereby is created for the purpose of making the improvements as in said Resolution of Intenti.on No. 1554 and hereinafter described. S ection 2 That the said special improvements be, and the same are hereby ordered to be made in said Spe- cial Improvement District No. 519 as follows: CONSTRUCTION AND INSTALLATION AN ASPHALTIC CONCRETE PAVING, CONCRETE INTEGRAL CURBS AND GUTTERS, NECESSARY APPURTENANCES THERETO, ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAINAGE PIPE, INLETS, MANHOLES, DITCHES, I AND ANY OTIlER APPURTENANCES TO THE STORM DRAINAGE SYSTEM ON WEST MENDEffiiALL STREET AND \\TEST LAMME STREET BETHEEN TENTH AVENUE NORTH AND ELEVENTH AVENUE NORTH LYI~G IN SrRINGBROOK ADDITION TO TIlE CITY OF BOZEMAN. Section 3 That the entire cost and expense of making the special i.mprovements herein referred to in said Special Improvement District No. 519 shall be paid by Special Improvement District Coupon Bonds, as authorized hy the lmvs of the State of Montana, uhich bonds shall be in denominations of one hundred c10llars ($100.00) each, and fractions or multiples thereof where necessary, to be issued and charge- able against a fund to be known as Special Improvement District No. 519 Fund", said bonds to be redeemable at the option of the City of Bozeman, Montana, whenever funds are availahle for that COMMISSION RESOLUTION NO. 1561 ....- ...__n ~.. -,_....~._._. - .-.....-..-.-...".-.-... ....- . ----.. 428 purpose from said Special Improvement District No. 519 Fund; said bonds shall draw interest at a rate not to exceed seven percent ( Tf,) per annum. which shall be chargeable as a part of the cost of said improvements and shall run From the date of the registration of said bonds until said bonds are paid. To pay said bonds. and the interest thereon. representing the cost of said improvemen t. a special assessment shall he levied against all of the lands within said Special Improvement District No. 519 as in said Resolution of Intention No. l55!.~ defined. See tion {~ I Said assessment and taxes shall be payable in twenty (20) annual installments 0xtending over a period of nineteen (19) years. \vith interest on deferred payments. but this provision shall not be construed to prevent full pa)~ent at any time. Section 5 That the City Engineer be. and he is hereby directed to prepare plans and specifications for the doinS of said work and the making 0 f said improvements. Section 6 That pursuant to the provisions and authority conferred by Section 11-2212, Revised codes of Nont<lna. 19/+ 7. said bonds may be sold to the highest and best bidder therefor for cash. and the proceeds of such sale used in making payment to the contractor. or contractors. for such work. and such payment may be made either from time to time on estimates made by the engineer in charge of such improvements for the city. or tlpon the entire completion of the improvements and the accept- ance thereof by the City Commission. Section 7 That llpon completion of plans Hnd specifications by the City Engineer for the doing of said 1;-lork and the making of sai,d improvements. the Clerk of the Ci.ty Commission of the City of Bozeman Montana. be, and is hereby directed to publish a notice inviting proposals for the making of said improvements on said Special Improve~ent District No. 519. which notice shall refer to the plans and specifications on file. by publishing such notice in two (2) issues of the Bozeman Daily Chron- icle, a daily newspaper printed and published in the City of Bozeman. not less than ten (10) days be fore the time such bids will be opened I PASSED AND ADOPTED BY THE COMMISSION OF THE CITY OF B07-EH/\N at a regular session thereof held on the 7th day of Fehruary. 1973. \HLLIA H E.
