IT TO BE 'TIlE INTENTION OF 'TIlE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL
IMPROVEMENT DISTRICT TO BE KNOWN AS Special Improvement DISTRICT NO. 521 FOR
'TIlE PURPOSE OF CONSTRUCTION AND INSTALLATION OF WATER AND SANITARY SEWER MAINS
AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES MORE SPECIFICALLY DESCRIBED
AS FOLLOWS: A SIX INCH WATER LINE AND APPURTENANCES ON THE ENTIRE LENGTH OF
CIRCLE DRIVE AND ON A PORTION OF SPRING CREEK DRIVE AS LOCATED IN WESTRIDGE, A
I SUBDIVISION OF BOZEMAN, MONTANA.
THE CONSTRUCTION AND INSTALLATION OF THE WATER MAIN TO INCLUDE ALL TRENCH EX-
CAVATION AND BACKFILL, BEDDING MATERIAL, CAST IRON HATER MAIN, VALVE, FITTINGS,
HYDRANTS, SERVICE LINE STIlB, PAVING REPLACEMENT AND OTHER NECESSARY APPURTE-
NANCES . THE CONSTRUCTION AND INSTALLATION OF THE SANITARY SEWER MAINS SHALL
INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, INSTALLATION OF
SANITARY SEWER HAINS, NECESSARY WYES, MANHOLDES, SERVICE LINES AND OTHER
NECESSARY APPURTENANCES.
WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman,
Montana, a petition in due form of r.ertain owners of properties situated within the boundaries of
Special Improvement District No. 521 as hereinafter more specifically described,
asking that a spec-
ial improvement district be created for the purpose of constructing and installing watermains and
sanitary sewer lateral mains to provide water and sanitary sewers
to lots within the district.
HHEREAS , that at a regular meeting of the City Commission of the City of Bozeman,
state of
Montana, held on the 18th day of October, 1972, the aforesaid
petition was respectively considered

NO\\T THEREFORE, BE IT RESOLVED BY 'TIlE CITY COMMISSION OF THE CITY OF BOZEMAN:
Sec tion 1
Declaration of Intention
That it is herehy declared to be the intention of the City of Bozeman to create a special im-
provement district to he known and designated as Special Improvement District No.
521 of the City
of Bozeman for the purpose of constructing and installing watermains and sanitary sewer lateral
I mains, said project to include all appurtenant work for the construction and installation of water-
mains and sewerage system to provide water and sanitary sewers for all lots within the district.
Section 2
Boundaries
The boundaries of said Special Improvement district No. 521 are described as follows:
Beginning at the southwest corner of Westridge, a subdivision of a portion
of the northerly one half of the northwest quarter of Section 19, Township
2 South, Range 6 East of the Montana Principal Meridian, being a portion of
the City of Bozeman, Gallatin County, Montana; thence South 89006' East a
distance of 50.07 feet to the southwest corner of Lot 17 of Block 3 of said
Westridge Subdivision; thence continuing south 89006' East along the south-
erly line of said Westridge Subdivision a distance of 291.27 feet to the south-
east corner of Lot 15 of said Block 3; thence North 00048' East along the
easterly line of said Lot 15 a distance of 118.7 feet to the northeast corner
of said Lot 15; thence northeasterly across Spring Creek Drive to the south-
east corner of lot 10 of Block 4 of said Westridge Subdivision; thence North
00048' East along the east line of said Lot 10 a distance 110 feet to the
northeast corner of said Lot 10; thence North 24044' East along the south-
east line of Lot 11 of Block 4 a distance of 29.54 feet; thence North 00048'
east along the east line of said Lot 11 a distance of 79.22 feet to the
northeast corner of said Lot 11; thence continuing North 00048' East a dis-
tance of 20 feet to the Southeast corner of Lot 1 of said Block fl; thence
continuing North 00048' East along the east line of said Lot 1 a distance
of 59.0 feet to the southwest corner of Lot 2 of said Block 4; thence South
89012 ' east along the southerly lot lines of Lots 2 and 3 and a twenty foot
park access, being also the northerly line of South Park in said Westridge
Subdivision a distance of 143.10 feet to the southwest corner of Lot 4 of
said Block Lf; thence South 72033'20" East along the southerly lot line of
said Lot L~ a distance of 101.5 feet to the southeast corner of said Lot L};
I thence North 17058' East along the east lot line of said Lot 4 a distance of
143.53 feet to the northeast corner of said Lot 4; thence northeasterly across
Circle Drive to the southeast corner of Lot 11 of Block 5; thence
North 17058'
East alonr; the east line of said Lot 11 a distance of 125.9 feet to the north-
east corner of said Lot 11; thence North 76011'20" West along the northerly
lot lines of Lots 11, 12 and part of 13 a distance of 282.06 feet;

of Lots lIi, 15 and 16 a distance of 453.43 feet to the lot corner common to
Lots 1 and 16 of said Block 5; thence westerly at right angles to the
west
line of said Lot 16 a distance of ~7 feet more or less
to the west line of
Section 19, Township 2 South, Range 6 East; thence South 00013' West a dis-
tance of 766.56 feet to the point of heginning.
Contained within the above described exterior boundaries are the following

Section 3
Character
of Improvements
The c.haracter of the improvements to be made is
the installation and construction of six (6)
inch Hatermains and eight (8) inch sanitary sewer,
including trench excavation and backfill, hedding

stimate of Cost
The total estimated costs of the improvements within the district including engineering,
legal
and contingency is $57,000.00.
Sec tion 5
M
ethod of Assessment
The cost of such improvement is to be assessed against the entire district,
each lot, block,
tract or parcel of land within the district will be assessed for
that portion of the ,,,hole cas t,
which its area bears to the area of the entire district exclusive of streets,
avenues, alleys and
puhlic places. The total actual assessable area t"ithin the entire district is 275,058.78 square
feet. and is the area on which all protests will be received, considered
and determined. It is
also the figure on which all assessments will be figured.
Section ()
Payments
The payments for said improvements shall be made in twenty (20)
annual installments extending
over a period of nineteen (19) years, but this shall not be construed
to prevent payment in full
at any regular payment date by any property owner who desires to do so.
It is proposed to pay the
entire cost and expense of the construction and installation of said improvements with cash to be
obtained from the sale of bonds of said Special Improvement District No.
521, as all thorized by 1 at" .
Such honds will be in denominations of $100.00 each, and
fractions or multiples of $100.00 where I
necessnry, to be issued and chargeable against a fund to be 1mown and designa ted
as Special Improve-
ment District No. 521 Fund of the City of Bozeman. The bonds will be redeemable
at the option of
the City, singly or in multiples, and
in the order of their registrntion, whenever funds are avail-
able for the purpose of said Special Improvement District No. 521.
Said bonds shall draw a simple
interest from the date of their registration until called for paymen t,
at a rate not to exceed
seven percent (7%) per annum which interest shall be chargeable as part of the cost of construction
and installation of said improvements. The bonds will be issued and sold in accordance with the
provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 19lf 7 ,
and a 11 0 ther
applicable provisions of Title 11 of the Revised Codes of Montana, 191+7,
relating to special im-
provement districts in cities and to~"ns , and any amendments
thereof of thereto.

rotests and Notice
That the regular session of the City Commission of the City of Bozema,
to be held at the Comm-
ission Chamber, City Hall Building, Bozeman, Montana. on ~.Jednesday,
the 31st day of January, 1973,
at
the hour of 1:15 o'clock p.m. of said day, is
the time and place, when and where the City Commission
will hear and pass upon all protests duly and regularly made and filed against the creation of said
proposed Special ImprOVet11ent District 521, the improvements proposed
to be made pursuan t there to and
the ext'ent and character thereof, or either thereof;
and the Clerk of the City Commission, be,

That IVednesday, the 31st day of January 1973, at one fifteen o'clock p.m., at the Commission
Room of the City Ha]l, Bozeman, Montana, is designated by Resolution No. 1558
as the time when and
the place where the Commission of the City of Bozeman will hear and pass upon all protests that may
be made against the making of such improvements, or the creation of said district. Protest must be
made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after
date of the first publication of this notice.
The general character of the improvements proposed to be made is the construction and install-
ation of \17atermains and sani tary sewer lateral mains, said project to include all appur,tenant,work
for the construction and installati_on of watermains and seHerage system to provide \17ater and sanitary
sewers for all lots within the district.

in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all interested
parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Bontana,
19117.
