MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT NORTH 15TH AVENUE FROM MAIN STREET TO DURSTON ROAD, 16TH AVENUE FROM BEALL STREET TO DURSTON ROAD, 17TH AVENUE FROM BEALL STREET TO DURSTON ROAD, DURSTON ROAD FROM 15TH I AVENUE TO 17TH AVENUE AND BEALL STREET FROM 15TH AVENUE TO ALLEY BETWEEN 17TH AND 18TH AVENUES, SAID STREET LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY ALL UNDER AUTHORITY OF AND IN CONFORMITY WITH SECTIONS 11-2245 to 11-2257 INCLUSIVE, OF THE REVISED CODES OF MONTANA. 1947. WHEREAS. at a regular session of the Commission of the city of Bozeman, state of Montana. held on the 11th day of April. 1973, the said Commission duly passed Commission Resolution No. 1570 declaring it to be the intention of the said Commission to create a special improvement district to be known and designated as Special Improvement District No. 508 of the said city for the purpose of operating and main- taining a street lighting system to light North 15th Avenue from Main Street to Durston Road. 16th Avenue from Beall Street to Durston Road, 17th Avenue from Beall Street to Durston Road, Durston Road from 15th Avenue to 17th Avenue and Beall Street from 15th Avenue to Alley between 17th and 18th Avenues, said lighting system to be installed and paid for by the Montana Power Company, all under tbe authority of and in conformity with Sections 11-2245 and 11-2257 inclusive, of the Revised Codes of Montana, 1947, which said Resolution of Intention is of record and on file in the office of the Clerk of said City Commission and open to the inspection of the public, and is hereby I referred to for further particulars; and WHEREAS, due proof bas been made that service of notice of the adoption of said Resolution No. 1570 was duly made and given as by law provi4ed; and WHEREAS, at the time and place fixed in said Resolution No. 1570 for the making and filing of protests against the creation of said proposed Special Improvement Lighting District No. 508, to wit, at the hour of 1:15 o'clock p.m. on Wednesday, the 2nd day of May, 1973. being a regular meeting time of said City Commission, at the Commission Chamber in the City Hall Building of the city of Bozeman, there were not sufficient protests made or filed against the creation of said Special Improvement Lighting District No. 508, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: SECTION 1 That there be. and there is hereby created a special improvement district of the city of Bozeman to be known and designed as Special Improvement Lighting District No. 508, for the purpose of installing and maintaining a lighting system to light NOrth 15th I Avenue from Main Street to Durston Road, 16th Avenue from Beall Street to Durston Road, 17th Avenue from Beall Street to Durston Road, Durston Road from 15th Avenue to 17th Avenue and Beall Street frOm 15th Avenue to alley between 17th and 18th Avenues, aaid street lighting system to be installed and paid for by the Montana Power Company, all under the authority of and in conformity with Sections 11-2245 to 11-2257 inclusive, of the Revised Codes of Montana, 1947, pursuant to and in conformity with Commission Resolution ---...--.....-- -....-----.----.-- .....----..- - 456 No. 1570 of the Commission of the City of Bozeman, passed and adopted on the 11th day of April, 1973, which said Commission Resolution No. 1570 declares it to be the intention of said City Commission to create said Special Improvement Lighting District No. 508 for the purposes aforesaid, and which said Commission Resolution No. 1570 is of record and on file in the office of the Clerk of said City Commission in the City Hall Building, I Bozeman, and is open to the inspection of the public, and is hereby referred to for further particulars. Section 2 That said Commission Resolution No. 1570 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 508, the estimated cost of said improvements and the method of assessing the same against the property of said District. Section 3 The character of the improvement to be installed and paid for by the Montana Power Company is the erection and installation of forty-two (42) 175 watt (7,000 lumens) type III Mercury Vapor Luminaires mounted on 30 feet high steel poles. All lights to be served by underground conductors. The system shall be equipped with the necessary appliances for the safe and proper operation of the system. Section 4 The proposed Special Improvement Lighting District will be established for the purpose of paying the operating and maintenance cost of such lights only, which said I operation and maintenance will include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables, and other incidental items. The entire installation cost of such lights will be borne by the Montana Power Company. The portion of the cost of maintenance and electrical current payable by the city of Bozeman will be paid directly by the city of Bozeman and the portion to be assessed against the property within the district will be assessed and paid annually as provided by law.
