STREET FROM 15TH AVENUE TO ALLEY BETWEEN 17TH AND 18TH AVENUES. SAID STREET
LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY
ALL UNDER AUTHORITY OF AND IN CONFORMITY WITH SECTIONS 11-2245 to 11-2257 IN-
CLUSIVE. OF THE REVISED CODES OF MONTANA, 1947.
WHEREAS, there has been filed with the Clerk of the Commission of the city of Bozeman. Montana.
a petition in due form of certain property owners between Main and Beall Streets and Durston Road.
asking that a Special Improvement Lighting District be created for the purpose of operatiog and
maintaining a street lighting system to light the heretofore mentioned streets and avenues in the city
of Bozeman. Gallatin County. Montana.
WHEREAS. at a regular meeting of the City Commission of the city of Bozeman held on the 4th
day of April. 1973. the aforesaid petition was respectively considered and granted;
NOW. THEREFORE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
That it is hereby declared to be the intention of the city of Bozeman to create a Special Im-
provement District to be known and designated as Special Improvement Lighting District No. 508 of the
city of Bozeman. for the purpose of operating and maintaining a street lighting system to light North
I 15th Avenue between Main Street and Durston Road. North 16th Avenue between Beall Street and Durston
Road. North 17th Avenue between Beall Street and Durston Road. Beall Street between North 15th Avenue
and the alley west of North 17th Avenue and Durston Road between North 15th Avenue and North 17th
Avenue.
Section 2
Boundaries
The boundaries of said Special Improvement Lighting District are described as follows:
Beginning at the northwest corner of Sectio8 12. Township 2 South. Range 5 East of
Montana Principal Meridain; thence North 89 53'38" East along the Northerly line of
said Section 12. said line being also the centerline of West Durston Road a distance
of 480.93 feet to the true point of beginning; being a point of intersection of the
centerline of Durston Road and the projected centerline of the alley of Block B of
Graf's Third Rearrangement of Block 6 of Kirks Second Subdivision. Thence southerly
along the centerline of the alley of Block B of Graf's Third aearrangement of Block
6 the Kirk's Second Subdivision a distance of 980.67 feet to a point on the north line
of West Beall Street; thence continuing southerly along the southerly extension of
said alley centerline a distance of 136.47 feet to a point; thence easterly. parallel
to and a distance of 76.47 feet southerly from the south line of West Beall Street a
distance of 590.59 feet to a point on the west line of Lot 1. Block 3. Kirk's Second
Subdivision; thence southerly along said west lot line a distance of 19.03 feet to
the southwest corner of said Lot J; thence northeasterly along the southeasterly lot
line of said Lot 1 a distance of 97.45 feet to a point; thence southerly. parallel
to and a distance of 140 feet westerly from tbe west line of North 15th Avenue. a
I distance of 718.37 feet to a point; thence easterly, parallel to and a distance of
175 feet northerly from the nortb line of West Main Street, a distance of 340.18
feet to a point on the east lot line of Lot 3 of Cleveland Subdivision; thence
northerly along the easterly line of said subdivision a distance of 746.25 feet to
the northeast corner of Lot 12 of said subdivision; thence northwesterly a distance
of 39.40 feet more or less to a point on the north line of the 30 feet access road
running east and west at the north end of Cleveland Subdivision. said point being
114.76 feet east of the east line of North 15th Avenue; thence northerly, parallel
to and 114.76 feet easterly from the east line of North 15th Avenue a distance of
643.43 feet to the southeast corner of Lot 7, Durston's Third Subdivision; thence
northerly along the easterly line of said Durston's Third Subdivision a distance of
649.82 feet to the northeast corner of Lot 1 of said subdivision; thence northerly a

distance of 60 feet to a point on the north line of West Durston Road; thence westerly
along the north line of West Durston Road a 4istance of 259.89 feet to the southeast
corner of Tract 7 of Homesites Addition; thence northerly along the easterly line of
said Tract 7 a distance of 87.65 feet to a point; thence westerly, parallel to and
a distance of 87.65 feet northerly from the north line of West Durston Road a dis-
tance of 601 feet to a point on the centerline of North 17th Avenue; thence southerly
along said centerline of North 17th Avenue a distance of 117.65 feet to the centerline
of West Durston &oad; thence westerly along said centerline of West Durston Road a
distance of 140.01 feet to the true point of beginning.

Contained within the above described exterior boundaries the following lots, blocks
and tracts of land, to wit:
Lots 18 through 33 inclusive of Block B; Lots 17 through 32 inclusive of Block C,
all in Graf' Third Rearrangement of Block 6 of Kirk's Second Subdivision.
Lots 1 through 16 inclusive of Block C of Graf's Second Rearrangement of Block 6 of
Kirk's Second Subdivision. Lots 1 through 24 inclusive of Jaffe's Rearrangement of
Block 5 of Kirk's Second subdivision.
Lots 1 through 5 inclusive of Kirkwood Baptist Church Rearrangement of Block 4 of
Kirk's Second Subdivision.
Lots 1 through 7 inclusive of Durston's Third Subdivision.
Lots 4 through 12 inclusive and the north 50 feet of Lot 3 of Cleveland Subdivision.
Lot 1, North 76.47 feet of Lot 2 and North 76.47 feet of Lot 3, all in rearrangement
of Block 3, Kirk's Second Subdivision.
South 87.65 feet of Tracts SA, 5B, 5C, 6 and 7, all in Homesites AdditiQn.
Tract of land 120.57 feet by 76.47 feet in northeast corner of Block 2, Kirk' Second
Subdivision.
Tract of land described as that portion of the east 140 feet of the West Main Sbopping
Center lying North of a line parallel to and 175 feet northerly from the north line of
West Main Street.
Tract of land 114.76 feet by 643.43 feet lying adjacent to and east of North 15th Avenue
located north of Cleveland Subdivision and south of Durston's Third Subdivision.

Character of Improvements
The character of the improvements to be installed and paid for by the Montana Power Company is
the erection and installation of Forty-two (42) 175 Watt (7,000 lumens) type 111 Mercury Vapor
Luminaires mounted on 30 feet high steel poles. All lights to be served by underground conductors.
the system shall be equipped with the necessary appliances for the safe and proper operation of the
system.
Section 4
Estimate of Cost of Maintenance and
Electrical Current and Method of Assessment
An estimate of the cost of maintaing such lighting system and supplying current therefor is
Four and 86/100 dollars (4.86) per unit month for each unit or the total sum of Two Thousand Four
Hundred Forth-nine and 44/100 Dollars ($2,449.44) per year, of which total seventy-five percent (75X)
or One Thousand Eight Hundred Thirty-seven and 08/100 Dollars ($1,837.08) plus an' administration
charge of Eighty-eight Cents ($0.88) per unit or a total charge of One Thousand Eight Hundred Seventy-
four and 04/100 Dollars ($l,874.04)to be assessed against the property within the district on the I
square foot basis and twenty-five percent (251) of Two Thousand Four Hundred Forty-nine and 44/100
Dollars ($2,449.44) or a total of Six Hundred Twelve and 36/100 Dollars ($612.36) is to be paid by
the city of Bozeman, Montana.
The cost of such improvement is to be assessed against the entire district, each lot or parcel of
land within such district will be assessed for that part of the whole cost which its area bears to the
total area within the district. The estimated rate of assessment per square foot of the property within

the district is $.001433879511 per square foot.
Section 5
Actual Area of District
The total area of the property within said proposed Special Improvement Lighting District No.
I 508 is 1,306,971.74 square feet, which is the area on which all protests will be received, con-
sidered and determine.
Section 6
Payment
The proposed Special Improvement Lighting District will be established for the purpose of paying
the operating and maintenance cost of such lights only, which said operation and maintenance will
include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables,
and other incidental items. The entire cost of installation of such lights will be borne by the
Montana Power Company.
Section 7
Protests and Notice
That the regular session of the City Commission of the City of Bozeman, to be held at the
Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 2nd day of May, 1973,
at the hQur of one fifteen o'clock p.m. of said day, are the time and place when and where the City
Commission will hear and pass upon all protests duly and regularly made and filed against the creation
of said proposed Special Improvement Lighting District No. 508, the improvement porposed to be made
I pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City
Commission be, and she is hereby directed to give notice in the manner and for the time as by law
required, of theadoption of this Resolution of Intention.
Adopted by the Commission of the City of Bozeman, Montana, at a regular and stated session of
said Commission held on the 11th day of April, 1973.

That Wednesday, the 2nd day of May. 1973, at one fifteen o'clock p.m. at tbe Commission Room of
the City Hall. Bozeman. Montana, is designated by said Resolution No. 1570 as tbe time and place for

bearing objections to tbe action proposed to be taken by said resolution, and wben and wbere any and
all persons wbose property is witbin said proposed Special Improvement Lighting District No. 508
may appear and sbow cause, if any they have, against said proposed improvement. Objections must
be made in writing and filed with the Clerk of tbe City Commission not later than fifteen (15) days
after the date of tbe first publication of this notice.
Tbat tbe general character of the improvement to be made in said Special Improvement Lighting
District No. 508 is tbe erection and installation of forth-two (42) 175 watt (7.000 lumens) type

An approximate and preliminary estimate of the cost of maintaining such lighting system and
supplying current therefor is $4.86 per unit month or the sum of $2.449.44 per year of which total
75%. or $1,837.08 is to be assessed against the property within the district on a square foot basis.
and 25%, or $612.36 is to be paid by the city of Bozeman. The estimated rate of assessment per year
per square foot of the property within the district is $.001433879511 per square foot.
The proposed Special Improvement Lighting District will be established for the purpose of paying I
the operating and maintenance cost of such lights only, which said operation and maintenance will
include the furnishing of electric current, all lamps as needed and the maintenance of poles, cables,
and other incidental items. The entire cost of the installation of sucb lights will be borne by the
Montana Power Company.
For a description of the boundaries of said Special Improvement Lighting District No. 508
reference is hereby made to Resolution No. 1570 of the Commission of the City of Bozeman declaring
the intention to create said District, which is on file in the office of the undersigned Clerk of said
Commission in the City Hall of said City of Bozeman, State of Montana, and open for inspection to all
interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana, 1947.
