MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF
BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT
TO BE KNOWN AS IPECIAL IMPROVEMENT DISTRICT NO. 531 FeR THE
I PURPOSE OF CONSTRUCTING AND INSTALLING IN ASPHALTIC CONCRETE TYPE
PAVING, INTEGRAL CONCRETE CURB AND GUTTERS, NECESSARY APPUR-
TENANCES THERETO, ALSO CONSTRUCTION AND INSTALLATION OF
JlBCESSARY STORM DRAINAGE PIPE INLETS, MANHOLES, DITCHES OR OTHER
APPURTENANCES TO STORM DRAINAGE ON CIRCLE DRIVE AND AroRTION
OF SPRING CREEK DRIVE IN WESTRIDGE, A SUBDIVISION OF A PORTION OF THE
NORTHERLY ONE HALF OF THE NORTHWEST QUARTER OF SECTION 19, TOWN-
SHIP 2 SOUTH, RANGE 6 EAST, M.P.M. AND BEING A PORTION OF THE
CITY OF BOZEMAN.
WHEREAS, there has been filed with the clerk of the City Commission of the city of
Bozeman, Montana, a petition in"due fonn of certain owners of properties situated on Circle
Drive and a portion of Spring Creek Drive in West ridge, as shown in the above caption,
asking that a special improvement district be created for the purpose of constructing and
installing an asphaltic concrete pavement project to include integral concrete curbs and
gutters, stonn drainage and other work incidental thereto; and
WHEREAS, at a regular meeting of the City Commission of the city of Bozeman held on
the 9th day of May, 1973, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
I Declaration of Intention
That it is hereby declared to be the intention of the city of Bozeman to create a
special improvement district to be known and design8~a4Q as ipecial Improvement District
No. 531 for the purpose of constructing and installing an asphaltic concrete pavement
project on Circle Drive and a portion of Spring Creek Drive in Westridge, a subdivision of a
portion of the northerly one-half of the Northwest Quarter of Section 19, Township 2
South, Range 6 East, M.P.M. and being a portion of the city of Bozeman, Montana. Said
pavement project t9 include construction and installation of integral concrete curbs
and gutters, storm drainage, and other work incidental thereto.
Section 2
Boundaries
That the boundaries of said Special Improvement District No. 531 are described as
follows:
Beginning at the southwest corner of Westridge, a subdivision of a portion of the
northerly one-half of the northwest quarter of Section 19, Township 2 South, Range
6 East of the Montana Principal Meridian, being a portion of the City of Bozeman,
Gallatin County, Montana; thence South 89.06' East a distance of 50.07 feet to
I the southwest corner of Lot 17 of Block 3 ~~ said Westridge Subdivision; being
the true point of beginning; thence continuing South 89006' East along the South-
erly line of said Westridge Subdivision a dist8nce of 291.27 feet to the southeast
corner ot lot 15 of aaid Block 3; thence North oou48' East along the east line of
said Lot 15 a distance of 118.7 feet to the northeast corner of said Lot 15; thence
northeasterly across Spring Creek Drive to the southeast corner of Lot 10 of Block
4 of said Westridge Subdivision, thence North 00~48' East along the east line of
said Lot 10 a distance of 110.00 feet to the northeast corner of Lot 10; thence
North 24044' East along the southeasterly lot line of Lot 11 of said Block 4 a
distance of 29.54 feet; thence North 00048' East along the east ~:of said Lot

westerly line of South Park in Westridge a distance of 79.0 feet to the northeast

line of said South Park a distance of 143.1 feet to the southwest corner
of Lot 4 of said Block 4; thence south 72833'20" East along the southerly
line of said Lot 4 and said line extended a distance of 109.52 feet to the
northeasterly corner of South Park; thence South 80a03' 20" East along the
southerly lot line of lot 5 of said Block 4 a distance of 46.62 feet to a
point on the south line of Lot 5 which is 54.18 feet at right angles to
the westerly lot line of said Lot 5; thence North 17" 58' West Parallel to ,;Ji I
and 54.18 feet distant easterly from said westerly line of Lot 5 a distance

corner of said tot 14; thence South 18"19' East along the westerly line of said
Lot 14 a distance of 2.09 feet; thence along a curve to the left of 397.16
feet in radius through Lots 15, 16, 17, 18 and a ~~rtion ~9 to a point of
intersection with the west line of said Lot 19 at a point 19.85 feet southerly
of the northwest corner of said Lot 19; thence South along the west lines of
Lots 19, 20, and 21 of said lot line projected a distance of 232.83 feet
to a point of intersection with the north line of Spring Creek Drive projected
westerly; thence westerly at right angles a distance of 50 feet more or less
to the westerly line of Section 19; thence southerly at right angles along
said section line a distance of 66 feet; thence at right angles in an easterly
direction a distance of 50 feet more or less to a point of intersection with
the west line of Lot 17 if projected northerly; thence South along the west
line of said Lot 17 a distance of U7.77 feet to the southwest corner of said
Lot 17, being the true point of beginning.:
Containing within the above described exterior boundaries the following lots
and blocks: All of lots 15, 16, 17 of Block 3. All of Lots 1, 2, 3, 4 and
a portion of 5, and all of ~ots 10 an~ ~~ pt Block 4. All of Lots 11, 12, 13
14 and a portion of Lots 15, 16, 17, 18 and 19, also all of lots 20 and 21
of Block 5, aU in Westridge, a subdivision of the city of Bozeman. I
Section 3
Character of Improvements
Construction of a pavement project with integral concrete curbs and gutters, storm
drainage and necessary appurtenances',to said construction on Circle Drive and a portion of
Spring Creek Drive in Westridge, a subdivision of a portion of the northerly one-half of
the Northwest Quarter of Section 19, Township 2 South, Range 6 East, M.P.M., and being a
portion of the City of Bozeman, Montana, said pavement project to include construction of
a gravel sub base, an asphaltic concrete type base and surface course, all necessary exca-
vation and other appurtenant work thereto.
Section 4
Estimate of Cost
The preliminary estimate of cost is $88,goo.00, including all street excavation, aU
materials, installation costs and engineering and incidentals.
Section 5
Method of Assessment
The cost of such improvement is to be assessed against the entire district, each lot or I
parcel of land within such district will be assessed for that part of the whole cost, which
its area bears to the area of the entire district, exclusive of streets, avenues, alleys and
public places; and further each square foot of land with the district lying within 25 feet
of the line of the street on which the improvements herein provided for are made, shall bear
double the amount of the costs of such improvements per square foot of such land that each
square foot of any other land within the district shall bear.

Section 6
Payments
That the payments for said improvements shall be made in twenty (20) annual
installments extending over a period of nineteen (19) years, but this shall not beconstrued
I to prevent payment in full at any regular payment date by any property owner who desires
to do 50. It is proposed to pay the entire cost and expense of the construction and install-
ation of said improvements with caShto be obtained from the sale of bonds of said Special
Improvement District No. 531, as authorized by law. Such bonds will be in denominations
of $100.00 eaeh, and fractions or multiples of $100.00 where necessary, to be issued and
chargeable against a fund to be known and designated as Special Improvement District No. 531
Fund of the City of Bozeman. The bonds will be redeemable at the option of the city,
singly or in multiples, and in the order of their registration, whenever funds are available
for the purpose in said Special Improvement District No. 531. Said bonds will draw a
simple interest from the date of their registration until called for payment, at a rate not
to exceed seven percent (7%) per annum, which interest shall be chargeable as a part of
the cost of construction and installation of said improvements. The bonds will be issued
and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised
Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised
Codes of Montana, 1947, relating to special improvement districts in cities and towns, and
any amendments thereof or thereto.
I Sec tion 7
Due to the fact that 100% of the real property owners in this special improvement
district have petitioned for and consented to the formation of said Special Improvement
District No. 531, there can be no protests and no notice is necessary according to the
provisions of Section 11-2201 (4) (c), Revised Codes of Montana, 1947, as amended.
ADOPTED BY THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, at a regular session
of said Commission held on the 16th day of May, 1973.
