CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL ~(),lL__ IMPROVEMENT DISTRICT NO. 525 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A SANITARY SEWER TRUNK LINE TO SERVE A PORTION OF WESTRIDGE, A SUBDIVISION OF THE CITY OF BOZEMAN, I MONTANA, A PORTION OF FIGGINS" ADDITION TO BOZEMAN, MONTANA, AND A PORTION OF GRAF'S THIRD ADDITION TO BOZEMAN, MONTANA, AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A TEN (10) INCH SANITARY SEWER AND NECESSARY APPURTENANCES IN A PORTION OF THIRD AVENUE SOUTH, A PORTION OF WESTRIDGE DRIVE IN FIGGINS' ADDITION, AND IN LANGOHR AVENUE AND A PORTION OF SAID LANGOHR AVENUE EXTENDED IN FIGGINS' ADDITION TO BOZEMAN, MONTANA. THE CONSTRUCTION AND INSTALLATION OF SAID SANITARY TRUNK LINE SEWER TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, SEWER PIPE, MANHOLES, NECESSARY WYES AND OTHER NECESSARY APPURTENANCES. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners of properties situated within the boundaries of Special Improvement District No. 525 8S hereinafter more specifically described, asking that a special improvement district be created for the purpose of constructing and installing a sanitary sewer trunk line to serve lots within the district. WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on the 28th day of March, 1973, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention I That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 525 of the City of Bozeman for the purpose of constructing and installing a sanitary sewer trunk line, said project to include all trench excavation and backfill, bedding material, sewer pipe, manholes, necessary wyes and other necessary appurtenances. Section 2 Boundaries The boundaries of said Special Improvement District No. 525 are described as follows: Beginning at the northwest corner of Lot 7 of Block 1 of Westridge, a subdivision of a portion of the northerly one-half of the northwest one quarter of Section 19, Township 2 South, Range 6 East being a part of the City of Bozeman, Montana, said point lying South 89012' East 45 feet and South 00013' West 165 feet from the northwest 0 corner of Section 19, T2S, R6E; thence South 89 12' east along the north Lot lines of Lots 6 and 7 of Block 1 to the northeast corner of said Lot 6; thence South along the east lot line of said Lot 6 to the southeast corner of said Lot 6; thence southerly across Westridge Drive to the north- east corner of Lot 2 of Block 5 of said Westridge; thence South 00048' West along the east lot line of said Lot 2 to the southeast corner of said Lot 2; thence South 84015' West along the southerly lot lines of lots 1 and 2 of said Block I 5 a distance of 181.77 feet to the southwest corner of said Lot 1; thence south along the easterly line of South Third Avenue to the southwest corner of Lot 17 of Block 3, Westridge; thence South 89006' East along the common line between Westridge and Graf's Third Subdivision a distance of 961.09 feet to the northeast corner of said Grat's Third Subdivision; 0 thence South 10 13'30" West along the east line of said Graf's Third Subdivision to the south- east corner of Lot 9 of said subdivision; thence North 89006'00" West along the south lot line I of Lot 1 of Block 3 a distance of 91.71 feet to the southwest corner of said Lot 1; thence northwesterly across South Third Avenue to a point on the east line of Figgins' Addi tion to Bozeman, Montana, said point lying 365.6 feet South 00013' West of the southeast corner of Figgins' Addition of Blocks 1, 2 and a portion of 9 as now filed and recorded in County Clerk's Office, 0 Gallatin County, Montana; thence South 89 18'00" West parallel to and 365.6 feet distant southerly from the south line of Arnold Street of said Figgins' Addition, a distance of 204.44 feet more or less to a point on the westerly line of Langohr Street; thence north- erly along the westerly line of said Langohr Street to a point 268 feet distant southerly from the south line of Annold Street; thence 0 South 89 18' West a distance of 90 feet; thence northerly parallel to and 90 feet distant westerly from the west line of Langohr Street a distance of 268 feet to a point on the southerly line of Arnold Street; thence southwesterly along a curve to the left of 220 feet in radius with a delta angle of 310 a distance of 61.74 feet; thence North 31042'00" West across 0 Westridge Drive a distance of 60 feet; thence North 59 35'00" West along the westerly line of said platting a distance of 146.29 feet; thence North 30025'00" East along the boundary of said platting a I 0 distance of 327.66 feet; thence North 89 04'00" East a distance of 572.44 feet; thence South 00013'00" West a distance of 164.97 feet; thence North 89004'00" East a distance of 234.07 feet to the pre8ent westerly right of way line of South Third Avenue; thence North 0 08' West along said west right of way line a distance of 1482 fest more or less to the centerline of Kagy Boulevard; thence North 8& 11' East along said centerline a distance of 75 feet; thence South 0 08' East along the easterly right of way line of South Third Avenue a distance of 1317.81 feet more or less to the south line of Section 18, T2S, R6E; thence North 89012' West along said south section line a distance of 15 feet; thence South a distance of 165 feet; thence South 89012' East a distance of 15 feet to the true point of beginning. Containing within the above described exterior boundaries the following lots, blocks and tracts of land, to wit: Lots 6 and 7 of Block 1 of Westridge. Lots 1 and 2 of Block 5 of Westridge. Lots 1 through 15 inclusive of Block 1, Grafls Third Addition. Lots 1 through 10 of Block 2 of Graf's Third P~dition. Lots 1, 2, 3, 4, 5 of Block 3, Grafls Third Addition. Block 1 of Tract "A" Graf's Third Addition. An unplatted tract of land lying east of Colter Avenue 3601 x2001 (future lots 1 through 4 inclusive of future Block 6) of Grafls Third Addition. An unplatted tract of land (104.97 I 104.44 x 365.6) in Figgins' 2 Annexation lying between Third Avenue South and Langohr Avenue and lying south of Arnold Street. An unplatted tract of land 268' x 90' lying south of Arnold Street and I west of Langohr Avenue in Figgins' Annexation. All of Lots 1 through 57 inclusive of Block 1. All of Lots 1 through 13 inclusive of Block 2. All of Lot 1, Block 9, all in Figgins' Addition, a plat of Blocks 1, 2 and aportion of Block 9 to Bozeman, Montana. Section 3 Character of Improvements The character of the improvements to be made in the construction and installation of a ten(lO) inch sanitary sewer main, including trench excavation and back fill, bedding materials, sewer mains, COMMISSION RESOLUTION NO. 1581 --...----...- 479 manholes. wyes and other appurtenant work thereto. Section 4 Estimate of Cost The total estimated cost of the improvements within the district including engineering. legal and contingency is $61.000.00. Included in the total cost to the district is a reimbursement in I the amount of '5.420.00 to Special Improvement District No. 511 as a pro-rated cost of a portion of the interceptor sewer within District no. 5llo Section 5 Method of Assessment The cost of such improvement is to be assessed against the entire district. each lot. block. tract or parcel of land within the district will be assessed for that portion of the whole cost which its area bears to the area of the entire district exclusive of streets. avenues. alleys and public places. The total actual assessable area within the district is 1.678.940.31 square feet and is the area on which all protest will be received. considered and determined. It is also the figure on which all assessments will be figured. Section 6 Payments That the payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years. but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with I cash to be obtained from'the sale of bonds of said Special Improvement District No. 525. as authorized by law. Such bonds will be in denominations of $100.00 each. and fractions or multiples of $100.00 where necessary. to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 525 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City. singly or in multiples. and in the order of their registration. whenever funds are available for that purpose in said Special Improvement District No. 525. Said bonds will draw a simple interest from the date of their registration until called for payment. at a rate not to exceed seven percent (7%) per annum. which interest shall be chargeable as a part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11~2232 and Section 11-2271. Revised Codes of Montana. 1947. and all other applicable provisions of Title 11 of the Revised Codes of Montana. 1947. relating to special improvement districts in cities and towns. and any amendments thereof or thereto. Section 7 Protests and Notice That the regular session of the City Commission of the City of Bozeman. to be held at the I Commission Chamber. City Hall Building. Bozeman. Montana. on Wednesday. the 27th day of June. 1973. at the hour of one fifteen o'clock p.m. of said day. are the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 525. the improvement proposed to be made pursuant thereto and the extent and character thereof. or either thereof; and the Clerk of the City Commission be. and she is hereby directed to give notice in the manner and for the time as by law required. of the adoption of this Resolution of Intention. Montana. is designated by Resolution No. 1581 as the time when and the place where the Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protest must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. The general character of the improvements proposed to be made is the construction and instal- lation of a ten (10) inch sanitary sewer main. including trench excavation and backfill. bedding materials. sewer mains. manholes. wyes and other appurtenant work thereto. The estimated cost of said improvements within the district including engineering, legal and contingency is $61.000.00.
