Irrevocable Offer of Dedication and Waiver of Right to Protest Creation of Special Improvement Districts

RECOMMENDATION: Authorize City Manager to sign Irrevocable Offer of Dedication
BACKGROUND: Attached is a copy (original to Stacy Ulmen), of the partially
executed Conditional Irrevocable Offer of Dedication for the above
referenced project. City staff has reviewed the documents and found them
to be acceptable.
The Conditional Irrevocable Offer of Dedication was conditioned
as part of the mastersite plan to allow for concurrent construction of the
site and public infrastructure. This requirement is outlined in UDC
Section 38.39.030.C.
With the conditional approval of the application the applicant was
required to record a waiver of right to protest the creation of special
improvement districts. This document is a standard requirement for any
large scale developments that have the potential to impact any public
infrastructure that may need to create a special improvement district or
other alternative funding source. In this case the waiver is for future
improvements to West Kagy Boulevard. This document does not require
the City Manager’s signature but is being bundled together with the

irrevocable offer of dedication to assure to documents are recorded
together.
