HomeMy WebLinkAboutAdministrative Order No. 2013-01 Delegation of Authority regarding appointment, suspension, and removal of city employees and administrative offiers ADMINISTRATIVE GIRDER 2013 —01 Delegation of authority under Section 3.04(1) of the City Charter regarding appointment, suspension, and removal of city employees and administrative officers and review of disciplinary actions and repealing Administrative Order 2009-08 Pursuant to Section 3.04(1) of the City of Bozeman Charter, the City Manager has the authority to: Appoint and suspend or remove all city employees and appointive administrative officers provided for by or under this charter, except as otherwise provided by law, this charter, or personnel rules adopted pursuant to this charter. The city manager may authorize any administrative officer subject to the manager's direction and supervision to exercise these powers with respect to subordinates in that officer's department, office or agency. Pursuant to Administrative Order 2002-01, the City Manager delegated to the department directors the authority to appoint, hire, discipline, and fire its officers and employees but restricted the department directors from further delegating such responsibilities. Pursuant to Administrative Order 2009-08, the City Manager authorized department directors to delegate the authority to issue written reprimands to their immediate subordinate supervisors. It is hereby Ordered that effective immediately: 1. Administrative Order 2002-01 remains in effect to the extent the same does not conflict with this Order. Administrative Order 2009-08 is hereby repealed. 2. A department director may delegate to subordinate supervisors the authority to appoint, suspend, or remove an employee under the supervisor's authority. The City Manager must authorize such delegation in writing. This delegation of authority does not abrogate the City Manager's authority to exercise his/her authority to appoint, suspend, or remove. The City Manager may withhold any or all of this authority ftom Administrative Order 201.3-01 Page I of 2 a department director. Either the City Manager or a department director may withhold this authority from the director's subordinate. 3. The Human Resources Division must be consulted prior to the issuance of any formal disciplinary action other than counseling. Failure to consult with the Human Resources Division does not invalidate or void a disciplinary action. 4. Department directors must be notified in advance of any action regarding appointment, suspension, or removal taken by a properly authorized supervisor within their department. 5. All provisions of this Administrative Order are hereby adopted and shall become the official policy and procedure of the City of Bozeman. 6. This Order shall be forwarded to the Library Director, the Parking Manager, and the Municipal Court. Each agency is hereby requested that if such delegations are made the requirements of this Order are followed. DATED this 14 day of January, 2013. Chris A.
