HomeMy WebLinkAboutAdministrative Order No. 2013-03 Military Leave ADMINISTRATIVE ORDER 2013—03 On July 11, 2004, then-Acting City Manager Ron Brey issued Administrative Order 2004-03 which extended the protections and benefits of M.C.A. §10-1-604 (2003) to employees of the City of Bozeman mobilized for military duty pursuant to Title 10 U.S.0 §12302. This administrative order was considered proper to provide the same paid military leave available for military training to those employees being deployed to Iraq or being mobilized pursuant to Title 10 U.S.0 §12302. The Montana Military Service Employment. Rights Act ("MMSERA") was passed by the 2005 Montana Legislature. MMSERA amended M.C.A. §10-1-604 to provide that eligible public employees must be given leave of absence with pay for"performing military service,"and defined "military service"to include both federally funded military duty and state active duty.. Due to the actions of the Montana Legislature in updating and clarifying employment protections for those members who serve in the Montana organized militia or the federal reserves, the basis and justification for Administrative Order 2004-03 no longer exists. IT IS THEREFORE ORDERED, as Executive Officer of the City of Bozeman, I hereby rescind Administrative Order 2004-03 issued on July 11, 2004. DATED this day of March, 2013. Chris A.
