City Manager Authority: The City Manager has the authority to appoint, hire, discipline, and fire City personnel. However, through Administrative Order 2002 -01, the City Manager has delegated this authority to the Department Directors, with the requirement that the Department Directors must exercise this authority in accordance with City policy and must not further delegate the authority to hire, discipline or fire. Department Directors may, in turn, delegate the authority to issue written reprimands to their immediate subordinates. However, these individuals must exercise this authority in accordance with City policy and must not delegate it further. This delegation of authority does not abrogate the City Manager's authority to exercise his /her authority to appoint, hire, discipline and fire. The City Manager reserves the right to withhold any or all of this authority from any Department director. II. Disciplinary Policy: The City of Bozeman's .Handbook Section X, Disciplinary Action, reads, in part, as follows: "Disciplinary Policy Employees who break City and /or departmental rules, or who violate other Employee Misconduct provisions may be subject to disciplinary action. The specific type of disciplinary action to be taken will be determined by the circum- stances of each situation. An employee may be terminated for serious or repeated violations... Progressive Discipline Policy The City of Bozeman's progressive discipline policy includes five (5) separate and distinct actions. These include: 1. Written Reprimand 2. Disciplinary Probation 3. Suspension, with or without pay 4. Demotion 5. Termination..." III. Role of Human Resources in Disciplinary Actions The Human Resources Division is responsible for assisting supervisors in administering discipline in accordance with collective bargaining agreements, applicable state and federal law, and City policies and procedures. The Human Resources Division is also responsible for reviewing disciplinary actions to ensure the appropriate levels of consistency and uniformity throughout the City. Finally, the Human Resources Division is available to provide supervisors with assistance in dealing with employee problems prior to the commencement of formal disciplinary action. It is hereby ordered that, effective immediately: Department Directors may delegate the authority to issue written reprimands to their immediate subordinate supervisors. These individuals must also exercise this authority in accordance with City policy and must not delegate it further. 2. The Human Resources Director must be consulted prior to the issuance of any formal disciplinary action listed in Section 1I. However, failure to consult with Human Resources does not invalidate or void the disciplinary action taken. 3. Department Heads must be notified in advance of any disciplinary action taken by their immediate subordinate supervisors. 4. All provisions of this Administrative Order are hereby adopted and shall become the official policy and procedure of the City of Bozeman. DATED this 13 day of October, 2009. Chris A.
