E(/H COMMISSION RESOLUTION NO. 1633 ~:-"!'i_ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA. TO CREATE A SPECIAL D1PROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 536 FOR THE PUR- POSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE TYPE PAVING, INTEGRAL CONCRETE CURB AND GUTTERS, NECESSARY APPURTEN- I ANCES THERETO, ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAINAGE PIPE INLETS, MABHOLEG, DITCHES OR OTHER APPUR- TENANCES TO STORM DRAINAGE ON A PORTION OF llEST OAK STREET BETWEEN NORTH FIFTH AVENUE Aim NORTH SEVENTH AVENUE IN WESTLAKE'S SECOND SUBDIVISION, WESTLAKE'S FOURTH SUBDIVISION AND ~~STLAKE'S MmEXATION. WHEREAS, there has been filed with the Clerk of the City Commission of The City of Bozeman, Montana, a petition in due form of certain owners of properties situated on a portion of West Oak Street, as shown in the above caption, asking that a special improvement district be created for the purpose of constructing and installing an asphaltic concrete pavement project to include integral concrete curbs and gutters, storm drainage and other work incidental thereto; and, WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 11th day of October, 1913, the aforesaid petition was respectively considered and granted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY cm1MISSION OF THE CITY OF BOZEMAN: Section 1: peclaration of-1iltenti~ That it is hereby declared to be the intention of The City of Bozeman to create a special improve- ment district to be known and designated as Special Improvement District No. 536 for the purpose of constructing and installing an asphaltic concrete pavement project on a portion of West Ow~ Street in I Westlake's Annexation, Westlake's Second Subdivision, and a portion of Westlake's Fourth Subdivision, located in the East Half of Section 1, Township 2 South, Range 5 East, M.P.H., and being a portion of the city of Bozeman, Montana. Said pavement project to include construction and installation of integral concrete curbs and gutters, storm drainage, and other work incidental thereto. Section 2 .....--.....-,-- ;?~j.~- That the boundaries of said Special Improvement District No. 536 are described as follows: Beginning at the East one-quarter corner of Section 1, Township 2 South, Hange 5 East. M.P.H.; thence North 89Ol1'44.4f! West a distance of 492.81 feet to the true point of beginning; thence continuing Horth 89011'44.41! Hest a distance of 593.06 feet; thence North 1016'30" East a distance of 208 feet; thence North 88000' oaf! West a distance of 211 feet to a point on the centerline of Horth Seventh Avenue; thence along said centerline of North Seventh Avenue, South 0015' West a distance of 388 feet; thence South 89052'54" East a distance of 211 feet; thence South 89011'44.4" East a distance of 593.06 feet; thence North a distance of 111.5 feet to the true point of beginning. Contained within the above described exterior boundaries are the following lots, blocks, and tracts of land, to wit: The South 163 feet of Westlake's fi~nexation; Lot 1 of Block 1 of Westlake's Second Subdivision; the North 132.5 feet of Lot 1 of Block 4, VTestlake's Fourth Subdivision. I Sect..!2.u 9E_~.!1cter of .Jmpro~ts Construction of a pavement project with integral concrete curbs and gutters, storm drainage and necessary appurtenances to said construction on a portion of VTest Oak Street in Westlake's Annexation, Westlake's Second Gubdivision, and Westlake's Fourth Subdivision, located in the East Half of Section I, Township 2 South, Range 5 East, M.P.VI.. and being a portion of the city of Bozeman, Montana. Section 4 I Estimate of Cost The preliminary estimate of cost is $62,000.00, including all street excavation, all materials, installation costs, and engineering and incidentals. Section 5 Method of Assessment The cost of such improvement is to be assessed against the entire district; each lot or parcel of land within such district will be assessed for that part of the whole cost, which its area bears to the area of the entire district, exclusive of streets, avenues, alleys and public places; and, further, each square foot of land within the district lying within 25 feet of the line of the street on which the improvements herein provided for are made, shall bear double the amount of the costs of such improvements per square foot of such land that each square foot of any other land within the district shall bear. The total assessable area within the district is 136,224.20 square feet, and is the area on which all protests will be received, considered, and determined. It is also the area on which all assessments will be figured. Section 6 I Payments The payments for said improvements shall be rJ.ade in 20 annual installments extending over a period of 19 years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 536, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of ~;100.00 where necessary. to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 536 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose on said Special Improvement District No. 536. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed seven percent (1%) per annum, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2211, Revised Codes of Montana, 1941, and all other applicable provisions of Title 11 of the Revised Codes of Mon- tana, 1941, relating to special improvement districts in cities and towns, and any amendments thereof I or thereto. Protest must be made in writing and delivered to the Clerk of the City Commission within fifteen (15) days after date of the first publication of this notice. 'rhe general character of the improvements proposed to be made is the construction and installation of an asphaltic concrete pavement project to include integral concrete curb and putters, storm drainage, and other work incidental thereto. The estimated cost of said improvements within the district, including engineering, legal and contingency is $62,000. I For a description of the boundaries of said Special Improvement District No. 536, reference is hereby made to Resolution No. 1633 of the City Commission of The City of Bozeman declaring the in- tention to create said district, which is on file in the office of the undersigned Clerk of said City Commission in the City Hall of said city of Bozeman, state of 11ontana, and open for inspection to all interested parties and the public generally.
