FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF
AND IN CONFORMANCE WITH SECTIONS 11-2245 TO 11-2257, INCLUSIVE,
OF THE REVISED CODES OF MONTANA, 1947.
WHEREAS, there has been filed with the Clerk of the City Commission of the City of
Bozeman a petition in due form of certain property owners on South Willson Avenue between West
Olive Street and West Cleveland Street and on West Cleveland Street between South Willson Avenue
and South Sixth Avenue asking that a special improvement lighting district be created for the
purpose of operating and maintaining a lighting system to light the foregoing streets, roads, and
avenues in the City of Bozeman, Gallatin County, Montana; and,
WHEREAS, at a regular meeting of the City Commission of the Cky of Bozeman, held on the
6th day of March, 1974, the aforesaid petition was respectively considered and granted.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
It is hereby declared to be the intention of the City of Bozeman to create a special im-
provement district to be known and designated as Special Improvement Lighting District No. 540
of the City of Bozeman for the purpose of operating and maintaining a lighting system to light

South Willson Avenue between West Olive Street and West Cleveland Street and to light West
Cleveland Street between South Willson Avenue and South Sixth Avenue.
Section 2
Boundaries
The boundaries of said Special Improvement Lighting District No. 540 are described as follows:
Beginning at the point of intersection of the south line of West
Cleveland Street and the east line of South Sixth Avenue, said
point being also the northwest corner of Block 19 of the Capitol
Hill Addition to the City of Bozeman; thence southerly along said
east line of South Sixth Avenue a distance of 1 foot; thence
easterly, parallel to and 1 foot distant southerly from the south
line of West Cleveland Street, to a point on the east line of
South Willson Avenue; thence northerly along said east line of South
Willson Avenue a distance of 61 feet to the southwest corner
of Block 7 of the Butte Addition to the City of Bozeman; thence
easterly along the south line of said Block 7 a distance of 1
foot; thence northerly, parallel to and I foot distant easterly
from the east line of South Willson Avenue. to a point on the
south line of West Olive Street; thence westerly along said
south line of West Olive Street a distance of 82 feet to a point
1 foot distant westerly of the west line of South Willson Avenue;
thence southerly, parallel to and 1 foot distant westerly from
the west line of South Willson Avenue, to a point 1 foot
north of the north line of West Cleveland Street; thence westerly.

parallel to and 1 foot northerly from the north line of West
Cleveland Street. to a point on the east line of South Sixth
Avenue; thence southerly along said east line of South Sixth
Avenue to the point of beginning.
Containing within the above described exterior boundaries the
following lots, blocks, and tracts of land. to wit:
The northerly 1 foot of Lots 1 and 24 of Block 19; the northerly
1 foot of Lots 1 and 24 of Block 18; the northerly 1 foot of Lot
1 of Block 17; and the southerly 1 foot of Lot 12 of Block 16.
all in the Capitol Hill Addition.

Character'iDf Improvements
The character of improvements to be installed and paid for by the Montana Power Company is the
I rebuilding and upgrading of the existing Street lighting. The City of Bozeman and the lighting
district will transfer ownersidp ot the existing posts, fixtures. and circuit to tne Montana Power
Company for the aforesaid rebuilding and upgrading. Montana Power Compauy will auaudo.. I.he
existing series circuit and install a 240-volt underground circuit to each light.
Also supplied will
be necessary ballasts or any necessary conversion equipment to install 100 watt mercury vapor lamps.
Power is to be supplied by an underground direct burial cable installation and will be equipped
with necessary appliances for safe and proper operation of the system.

Estimated Costs of Maintenance and
Electricity and Method of Assessment
The estimate of costs of maintaining said lighting system and supplying electrical current
therefor is a total of $2.600.64 per year. of which total 75 percent is to be assessed against the
property within the district on a front-foot basis and 25 percent is to be paid by the City of
Bozeman.
The costs of operation and maintenance of said improvements are to be assessed against the
entire district, each lot or parcel of land within such district to be assessed for that
part of
I the total assessment which its linear feet of frontage on the improvement bears to the total number
of linear feet of frontage on the improvement in the entire district, exclusive of streets, avenues,
alleys, and public places.
The total number of assessable linear feet of frontage within the entire district is 7.656.37
linear feet, which is the number on which all protests will be received, considered, and determined.

Payment
The proposed special improvement lighting district will be established for the purpose of

paying the operating and maintenance costs of such lights only, which said operation and main-
tenance will include the furnishing of electric current, all lamps as needed and the maintenance
of poles, cables, and other incidental items. The entire cost of installation of such lights
will be borne by the Montana Power Company.
Section 6
Protests and Notice

The regular session of the City Commission of the City of Bozeman, to be held at the Com-
mission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 8th day of May,
1974, at
the hour of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission
will hear and pass upon all protests duly and regularly made and filed against the creation of said
proposed Special Improvement Lighting District No. 540, the improvement proposed to be made pursuant
thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Com-
mission be, and she is hereby directed to give notice in the manner and for the time as by law
required, of the adoption of this resolution of intention.
PASSED AND ADOPTED by the City Commission of the City of Bozeman at a regular session
thereof held on the 10th day of April, 1974.

City Hall Building, Bozeman, Montana, is designated by Resolution No.
1662 as the time when and the
place where the City Commission of the City of Bozeman will hear and pass upon all protests that may
be made against the making of such improvements, or the creation of said district. Protest
must be
made in writing and delivered to the Clerk of the City Commission within 15 days after date of the
first publication of this notice.
The general character of the improvements proposed to be made is the operation and maintenance
of a street lighting system, to be installed and paid for by the Montana Power Company, upon those

The estimated cost of maintaining said lighting system and supplying electrical current therefor
is a total of $2,600.64 per year.
For a description of the boundaries of said Special Improvement Lighting District No. 540,
reference is hereby made to Resolution No. 1662 of the City Commission of the City of Bozeman,
I declaring the intention to create said district, which is on file in the office of the undersigned
Clerk of said City Commission in the City Hall of said City of Bozeman, in the State
of Montana,
and open for inspection to all interested parties and the public generally.
This notice is given pursuant to the provisions of Section 11-2204, Revised Codes of Montana,
1947.
