PUBLIC ACCESS EASEMENT
TBP CONDOMINIUMS, 40 E Main St. Ste. 210, Bozeman, MT 59715,
GRANTOR(S), in consideration of$ 1.00 and for other and valuable considerations, receipt of
which is hereby acknowledged, grants to The City of Bozeman, a Municipal Corporation of the
State of Montana with offices at 121 N Rouse Avenue, Bozeman, MT 59715, GRANTEE, an
easement for a transit shelter for the use of the public on a 200 ft2 area of land situated in
Gallatin County, Montana, which is located on the following described property:
Lot 2, Minor Subdivision No. 340, according to the plat thereof, on file and of record in the
office of the Clerk and Recorder, Gallatin County, Montana, and located in the SW 1/4 of Sec,
10, T 25 R 5E, of PMM
The easement is more particularly described on the attached Exhibit A which by this reference
is made a part hereof.
The GRANTOR(S) agrees;
(1) To allow the construction and maintenance of a transit shelter. The easement must remain.
valid for as long as the property relies upon the transit availability provisions of Section
38.25.040 to satisfy required amounts of parking.
(2) To allow the City of Bozeman to make any and all inspections of the transit shelter thereto
as the City reasonably deems necessary.
(3)The consent of the City of Bozeman will be required for the release and reconveyance of this
easement.
The GRANTOR(S) warrant that they are lawfully seized and possessed of the real
property described above, that they have a lawful right to convey the property, or any part of it,
and that they will forever defend the title to this property against the claims of all persons.
The GRANTOR(S) further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTORS. The terms,
covenants and provisions of this easement shall extend to and be binding upon the heirs,
executors, administrators, personal representatives, successors and assigns of the parties
hereto.
