SUBJECT: A text amendment to Article 38.11, Urban Mixed Use district, to revise
the development standards of the district affecting required mixed use standards, required yards, reducing required building heights and stories
within the district, building performance standards, and park/public
spaces. Revisions will apply to all locations designated as Urban Mixed
Use district. File Z-13164.

AGENDA ITEM TYPE: Action –Legislative
RECOMMENDATION: That the City Commission approve application Z-13164 with the staff
recommended changes to the text and direct preparation of an implementing ordinance.
RECOMMENDED MOTION: “Having reviewed the application materials, considered
public comment, and considered all of the information presented, I hereby adopt the findings presented in the staff report for application Z-13164 and move to approve the text amendment and direct staff to bring back an implementing ordinance.”

BACKGROUND: A text amendment has been submitted to revise the Urban Mixed Use zoning
district, Article 38.11, BMC. The application was received on July 3, 2013. The application was
placed on hold in early September to allow the applicant an opportunity to submit revised
materials to respond to concerns of staff. New materials were received on September 16, 2013. The Recreation and Parks Advisory Board subdivision review committee considered the
application on September 20, 2013 and recommended against the initial application language
submitted by the applicant.
Community Development staff analyzed the newly proposed language and recommended a number of changes to the text. The Zoning Commission considered the item on October 1, 2013
and recommended favorably with modifications as recommended by staff. The applicant at the
Zoning Commission meeting withdrew the element of the application addressing private streets,
Section 38.11.070.I, BMC. A revised staff report incorporating all actions and discussion to date
is attached to this memo.

No public comment has been received to date on this application.
UNRESOLVED ISSUES: Does the City Commission find that the proposed modifications to
the Urban Mixed Use district, Article 38.11, BMC, result in a superior set of standards for the district and community?
ALTERNATIVES:
1. Approve the application with the recommended Staff modifications;
2. Approve the application with revisions to the recommended staff modified text;
3. Approve the application as submitted by the applicant. 4. Deny the application based on the Commission’s findings of non-compliance with the
applicable zoning criteria contained within the staff report;
5. Open and continue the public hearing on the application, with specific direction to Staff
or the applicant to supply additional information or to address specific items.
