WHEREAS, the City Oammission of the City of Bozeman, Montana, has determined that it is in the best interest of the City of Bozeman and the owners of properties within the area between West Beall Street and Durston Road, and between North Eleventh Avenue and North Eighteenth Avenue that a special improvement district be created for the purpose of constructing and installing a trunk storm drainage system together with necessary fill material and other work incidental theretoj and WHEREAS, at a regular meeting of the City COmmission of the City of Bozeman, held on the 17th day of July, 1974, the aforesaid improvements were considered and discussedj NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 546 of the City of Bozeman for the purpose of constructing and installing a trunk I storm drainage system along Durston Road between North Eleventh Avenue and North Eighteenth Avenue. Section 2 Boundaries The boundaries of said Special Improvement District No. 546 are described as follows: Beginning at a point on the centerline of Durston Road, which point bears North 89053'38" East a distance of three hundred sixty and ninety-two hundredtm (360.92) feet from the northwest corner of Section 12, Township 2 South, Range 5 East of M.P.M.; thence along the centerline of Durston Road, North 89053'38" East a distance of eight hundred sixty and eighty- one hundredths(860.81) feet to the north 1/16 corner of the NWl/4 of said Section 12; thence continuing along the centerline of Durston Road, South 88B59 , East a distance of one thousand three hundred twenty-three and seventy-four hundredths (1323.74) feet to the north 1/4 corner of said Section 12j thence South 1006' West a distance of one thousand three hundred nine and eighty-six hundredths (1309.86) feet to the east 1/16 corner of the NWl/4 of said Section 12j thence west along the center 1/16 line of said NW1/4 of Section 12, North 89036'30" West a distance of one thousand three hundred thirty-four and four hundredths (1334.04) feet to the center 1/16 corner of the NW1/4 of said Section 12: thence South 89016'07" West along the south line and south line extended of West Beall Street a distance of eight hundred sixty and fifteen hundredths (860.15) feet; thence along the centerline and centerline extended of the north- south alley between North Seventeenth and North Eighteenth Avenues, North 00025'38" East a distance of one thousand two hundred thirty-five and seventy-three hundredths (1235.73) feetj thence westerly a distance of I ten (10) feet to the southeast corner of Lot 1 of Block B of Graf's First Rearrangement of Block 6 of Kirk's Second Subdivision; thence westerly along the south line of said Lot 1 distance of one hundred ten and one hundredth (110.01) feet to the southwest corner of said Lot lj thence North 00025'38" East a distance of ninety-five (95) feet to the point of beginning. Containing within the above described exterior boundaries the following lots, blocks, and tracts of land, to wit: Lot 1, Block B, Graf's First Rearrangement of Block 6 of Kirk's Second Subdivision. Section 3 Character of Improvements The character of improvements is the construction and installation of a trunk storm drainage system together with necessary fill material along the south side of Durston Road between No~th Eleventh Avenue and Nortb Eighteenth Avenue in the City of Bozeman. Section 4 Estimate of Cost The preliminary estimate of costs of the improvements within the district is $58,000.00, including all construction costs, material costs, engineering, legal, and contingencies. Section 5 Method of Assessment The cost of the improvements within the district is to he assessed against the entire district, each lot or parcel of land within such district to be assessed for that portion of the whole cost which its area bears to the area of the entire district, exclusive of I streets, avenues, and alleys. The total number of assessable square feet within the district is 2,565,381.06 square feet. This is the number on which all protests will be received, considered, and deter- mined, and on which all assessments will be calculated. Section 6 Extended District The City Commission of the City of Bozeman does hereby find that the contemplated work and improvements are, in the opinion of the City Commission, of more than local or ordinary public benefit and that the cost and expense of such improvements shall be chargeable on an extended district and the City Commission does hereby declare that the above described district and all lots included therein will be benefited by the contem- plated improvements and that said district and all lots and tracts therein shall be assessed to pay the costs and expenses thereof. Section 7 Payments The payments for said improvements shall be made in 10 annual installments over I a period of 9 years, hut this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. That Wednesday, the 14th day of August, 1974, at 1:15 o'clock p.m., at the Commission Room of the City Hall, Bozeman, Montana, is designated by Resolution No. 1689 as the time when and the place where the Ctty Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protest must be made in writing and delivered to the Clerk of the City Commission within 15 days after date of the first publication of this notice. The general character of improvements is the construction and installation of a trunk storm drainage system together with necessary fill material along the south side of Durston Road between North Eleventh Avenue and Bo'tltb Eighteenth Avenue in the City of Bozeman. For a description of the boundaries of said Special Improvement District No. 546, reference is hereby made to Resolution No. 1689 of the City Commission of the City of Bozeman, declaring the intention to create said district, which is on file in the office of the undersigned Clerk of the said City Commission in the City Hall of said City of Bozeman, Montana, and open for inspection to all interested parties and the public generally.
