"I till MONTANA, DECLARING IT TO BE THE INTENTION OF SAID CITY ~ - (.l ?..L. -----. -:;; COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE fI~ L' H KNOWN AND DESIGNATED AS SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 544 FOR THE PURPOSE OF OPERATING AND MAINTAINING A I STREET LIGHTING SYSTEM TO EIGHT SOUTH WILLSON AVENUE BETWEEN WEST BABCOCK STREET AND WEST OLIVE STREET, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHORITY OF AND IN CONFORMANCE WITH SECTIONS 11-2245 TO 11-2257, INCLUSIVE, OF THE REVISED CODES OF MONTANA, 1947 WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman a petition in due form of certain property owners on South Willson Avenue between West Babcock Street and West Olive Street asking that a special improvement lighting district be created for the purpose of operating and maintaining a lighting system to light the aforesaid streets, roads, and avenues in the City of Bozeman, Gallatin County, Montana; and, WHEREAS, at a regular meeting of the City Commission of the City of Bozeman. held on the 6th day of March, 1974, the aforesaid petition was respectively considered and granted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 It is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement Lighting District No. 544 of the City of Bozeman for the purpose of operating and maintaining a lighting system I to light South Willson AVEnue between West Babcock Street and West Olive Street. . Section 2 Boundaries The boundaries of said Special Improvement Lighting District No. 544 are described as follows: Beginning at the point of intersection of the north line of West Olive Street and the east line of South Willson Avenue, said point being also the southwest corner of Block A of Alderson's Add it ion; thence easterly along the north line of West Olive Street a distance of 1 foot; thence northerly, parallel to and 1 foot distant easterly from the east line of South Willson Avenue to a point on the south line of West Babcock Street; thence westerly along said south line of West Babcock Street a distance of 82 feet; thence southerly, parallel to and 1 foot distant westerly from the west line of South Willson Avenue, to a point on the north line of West Olive Street; thence easterly along said north line cfjf, West Olive Street to the point of beginning. Containing within the above described exterior boundaries the following lots, blocks, and tracts of land, to wit: The westerly 1 foot of Lots 11 through 20, inclusive , of Block A, and the easterly 1 foot of Lots I through 10. inclusive. of Block B, all in Alderson's Addition. Section 3 I Character of Improvements The character of improvements to be installed and paid for by the Montana Power Company is the rebuilding and upgrading of the existing street lighting. The City of Bozeman and the lighting district will transfer ownership fo the existing posts, fixtures, and circuit to the Montana Power Company for the aforesaid rebuilding and upgrading. Montana Power Company will abandon the existing series circuit and install a 240-volt underground circuit to each light. Power is to be supplied by an underground direct burial cable installation and will be equipped with necessary appliances for safe and proper operation of the system. Section 4 Estimated Costs of Maintenance and I Electricity and Method of Assessment The estimate of costs of maintaining said lighting system and supplying electrical current therefor is a total of $206.40 per year, of which total 75 percent is to be assessed against the property within the district on a ttmb foot basis and 25 percent is to be paid by the City of Bozeman. The cost of said improvement ~ to be assessed against the entire district, each lot or parcel of land within said district to be assessed for that part of the whole cost which its linear feet of frontage on the improvement bears to the total number of linear feet of frontage on the improvement in the entire district, exclusive of streets, avenues, alleys, and public places. The total number of assessable linear feet of frontage within the entire district is 600 linear feet, which is the number on which all protests will be received, considered, and determined. Section 5 Payment The proposed special improvement lighting district will be established for the purpose I of paying the operating and maintenance costs of such lights only, which said operation and maintenance will include the furnishing of electric current, all lamps as needed, and the maintenance of poles, cables, and other incidental items. The entire cost of installing such lights will be borne by the MOntana Power Company. Section 6 Protests and Notice The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 12th day of June, 1974, at the hour of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement Lighting District No. 544, the improvements proposed to be made pursuant thereto, and the extent and character thereof, of either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this resolution of intention. I NOTICE IS HEREBY GIVEN that on the 22nd day of May, 1974, at a regular session of the City Commission of the City of Bozeman, Commission Resolution No. 1673, entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF SAID CITY COMMISSION TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AND DESIGNATED AS SPECIAL IMPROVE- MENT LIGHTING DISTRICT NO. 544 FOR THE PURPOSE OF OPERATING AND MAINTAINING A STREET LIGHTING SYSTEM TO LIGHT SOUTH WILLSON AVENUE BETWEEN WEST BABCOCK STREET AND WEST OLIVE STREET, SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY, ALL UNDER THE AUTHOR.. That Wednesday, the 12th day of June, 1974, at 1:15 o'clock p.m., at the Commission Room of the City Hall Building, Bozeman, Montana, is designated by Resolution No. 1673 as the time when and the place where the City Commission of the City of Bozeman will hear and pass upon all protests that may be made against the making of such improvements, or the creation of said district. Protest must be made in writing and delivered to the Clerk of the City Commission within 15 days after date of the first publication of this notice. The general character of the improvements proposed to be made is the operation and I maintenance of a rebuilt and upgraded existing street lighting system, said rebuilding and upgrading of the present lighting system to be done and paid for by the Montana Power Company, upon those streets set forth and described in Resolution No. 1673. The estimated cost of maintaining said lighting system and supplying electrical current therefor is a total of $206.40 per year. For a description of the boundaries of said Special Improvement Lighting District No. 544, reference is hereby made to Resolution No. 1673 of the City Commission of the City of Bozeman. declaring the intention to create said district, which is on file in the office of the undersigned Clerk of said City Commission in the City Hall of said City of Bozeman, in the state of Montana, and open for inspection to all interested parties and the public generally.
