MEETING DATE: September 30, 2013 AGENDA ITEM TYPE: Consent RECOMMENDATION: Authorize the City Manager to sign a Release and Reconveyance of Easement for public access for the West Edge Condos HRDC housing development and sign two new public access easements for the development; the first providing for mutual access with an adjoining property, and the second public access to a transit shelter. BACKGROUND: A public access easement was granted on the subject property on November 16, 2006 for the Bozeman Peaks Condos project. The boundary of the public access easement generally followed drive aisles approved during site plan review of said project. The property has since changed ownership, and the final phase of the development is under management of the HRDC. Under new ownership, changes were made to the previously issued final site plan to suite HRDC’s vision for the property and parking/drive aisle locations were reconfigured. The public access easement granted with the Bozeman Peaks Condos project in 2006 did not align with constructed parking/aisles of the HRDC project. The attached release and reconveyance of easement removes the existing public access easement from the property. A new public access easement is being provided, as attached, that provides for perpetuation of legal mutual access with the northern property that adjoins the site. Also provided, is a new public access easement for construction/operation of a transit shelter on the property. Engineering staff has reviewed the documents and finds them acceptable. UNRESOLVED ISSUES: None. ALTERNATIVES: As suggested by the City Commission.
