RTR Holdings 11 GRANTOR,in consideration of$ 1.00 and for other and
LL valuable considerations,receipt of which is acknowledged,grants to The City of Bozeman,a
municipal corporation of the State of Montana,with offices at 121 North Rouse Avenue,
Bozeman,Montana 59715,GRANTEE,its successors and assigns,a perpetual street and utility
easement for the use of the public,in,through,and across a strip of land situated in Gallatin
Nye
County,Montana, (see exhibit A) feet wide to be located on the following described real
property:
Tract B of COS 2661,excepting Parcel 2 of Document 2311126,,located in the SW 1/4 of
Section 13,US,R5E,and in the NW V4 of Section 24,T2S,R5E,PMM,Gallatin Couonty,
Montana.
The easement is more particularly described on the attached Exhibit(s) A which
by this reference is made a part hereof.
The GRANTOR states that he possesses the real property described above and that he has
a lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the
rights and privileges herein granted without any interruption by the GRANTOR.
The terms,covenants,and provisions of this easement shall extend to and be binding
upon the heirs,executors,administrators,personal representatives,successors,and assigns of the
parties hereto.

A 15 ft, wide public street and utility easement located in the SWY4 of Section 13,
Township 2 South, Range 5 East, P.M,M., Gallatin County, Montano on Tract B of
Certificate of Survey No. 2661, being parallel to and 15 ft. south of the following
described line:
Beginning at the northwest corner of Tract I of Certificate of Survey No. 2661A,
thence along the southerly right-of-way of Kagy Boulevard S89'44'10"W, 682,18 ft.,
more or less, to a point on the east right-of-way of S, 19th Avenue.
ALSO,
A 15 ft. wide public street and utility easement located in the SW)'4 of Section 13,
Township 2 South, Range 5 East, P.M.M., Gallatin County, Montana on Tract B of

A public street and utility easement located in the NWY4 of Section 24, Township 2
South, Range 5 East, P.M.M., Gallatin County, Montana on Tract B of Certificate of
Survey No. 2661, being more particularly described as follows:
Beginning at the point of intersection of the NY6 line of said Section 24 and the east
right—of—way of S. 19th Avenue, from which the NWY6 corner of said Section 24 bears
N89°31'26"E, 1323.21 ft.; thence along sold east right—of—way N00°33'15"W, 2.59 ft.;
thence leaving said right--of—way S89°33'38"E, 9.99 ft.; thence S00°33'11"E, 2.43 ft. to
a point on said NY6 line; thence along said NY6 line S89°31°26"W, 9.99 ft. to the point
of beginning.
Easement Description for S. 11th Avenue
A 45 ft. wide public street and utility easement located in the SWY4 of Section 13 and

Montana on Tract B of Certificate of Survey No. 2661, being parallel to and 45 ft.
west of the following described line:
Beginning at a point on the N—S midsection line of said Section 13, thence along said
N—S midsection line S00°09'03"W, 665.67 ft. to the SJ'4 corner of said Section 13;
thence S00°33'09"W, 413.18 ft.; thence S00'32'09"W, 901.69 ft, to the C—N/1/16 corner

A 90 ft. wide public street and utility easement located in the SWY4 of Section 13 and

following described centerline;
Beginning at the Y4 corner common to said Sections 13 and 24; thence along the

the east right—of—way line of S. 19th Avenue.
