HomeMy WebLinkAbout13- City and Bozeman Police Protective Association c� Memorandum of Agreement between the City of Bozeman and the Bozeman Police Protective Association k r7 ilk_ The following Memorandum of Agreement is made this day of 2013, between the City of Bozeman (the "Employer") and the Bozeman Police Protective Association (the"Association"). In the spirit of mutual cooperation and the fulfillment of common interests, the City and Association desire to enter into this MCA to provide the terms and conditions for the adjustment of shift hours and the establishment of an additional patrol shift. The parties hereby agree as follows: 1. Recitals. a. The addition of the Patrol Early Mid-Shift is to provide more consistent patrol coverage and to align hours to benefit police operations. b. The modification of the hours of the Patrol Day-Shift and Patrol Night-Shift will provide hours that are more conducive to family commitments and sleep patterns without significant adverse impact to police coverage. c. The Patrol Early Mid-Shift falls outside the definition of "Day Shift" as described in Article 12, Section F(6) and would be subject to shift differential pay if all other section requirements are met. d. This mutually agreed change of hours of regularly scheduled shifts is consistent with contract language as found in Article 5, Section C(2). e. To provide for a thorough examination of the effectiveness of the proposed changes, the modified hours and additional shift should be in place for a minimum of two(2) bid rotations. 2. Amendment to Collective Bargaining Agreement. a. Section C, Article 5 of the CBA shall be amended to read as follows: "C. Regularly Schedule Shifts: 1. The Bozeman Police Department o e� rates feeegnizes €eur( five 5 regularly scheduled shifts: a. Patrol Day-Shift(744 7:00 a.m.—k30 5:00 p.m.) Memorandum of Agreement RE:Adjustment to Shifts(Section C:,Article%) Page 1 of 2 b. Patrol Early Mid-Shift(12:00 p.m.— 10:00 pm.) c. Patrol Mid-Shift (5:00 p.m.—3:00 a.m.) d. Patrol Night-Shift(940 9:00 p.m.—740 7:00 a.m.) e. Non-Patrol Day-Shift(7:00 a.m.—5:00 p.m.) 2. The employer may change the hours of regularly scheduled shifts if the Association agrees. 3. The regularly scheduled shift may be modified for individual Association members for a specified period where there is a demonstrated need. Such modified work schedule must be approved by the Chief of Police, or designee, and the Association member, and shall not be precedent setting. 4. The Employer may move an Association member on probation between regularly scheduled shifts to enhance individual training and development without approval of the Association or the Association member." 3. Miscellaneous. a. The above amendment to the CBA shall be effective and the shift changes implemented on October 1, 2013. This agreement shall be in effect through September 30, 2014 unless mutually terminated by written agreement of the parties. b. This agreement shall remain in effect after October 1, 2014 and thereafter unless a written notice to revoke this Agreement is presented by either party. c. In the event that this Agreement is revoked, either mutually or singly, the parties agree the original language of Article 5, Section C of the CBA will control. d. This MOA will supplement and amend the existing CBA. e. The undersigned represent they have the legal authority to, and hereby do, bind their organizations.
