MENT DISTRICT NO. 545 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLA- TION OF A SANITARY SEWER LINE TO SERVE A PORTION OF THE BOZEMAN CREEK ANNEXATION TO THE CITY OF BOZEMAN, MONTANA, MORE SPECIFICALLY DESCRIBED I AS FOLLOWS: AN ElmHT INCH SANITARY SEWER AND NECESSARY APPURTENANCES ALONG THE NORTH LINE OF TRACTS 5B, 5C, 5D, 5E, AND SF AND SAID LINE EXTENDED WESTERLY TO THE EXISTING SANITARY SEWER IN TRACT 5, ALL IN THE BOZEMAN CREEK ANNEXATION TO BOZEMAN, MONTANA. THE CONSTRUCTION AND INSTALLATION OF SAID SANITARY SEWER IS TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, SEWER PIPE, MANHOLES, NECESSARY WYES, AND OTHER NECESSARY APPURTENANCES. WHEREAS, there has been filed with the City Commission a petition in due form of certain owners of properties situated within the boundaries of Special Improvement District No. 545 as hereinafter more specifically described asking that a special im- provement district be created for the purpose of constructing and installing a sanitary sewer line to serve said district; and, WHEREAS, at a regular meeting of the City Commission of the City of Bozeman, held on the 6th day of August, 1973, the aforesaid petition was respectively considered and granted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a special I improvement district to be known and designated as Special Improvement District No. 545 of the City of Bozeman for the purpose of constructing and installing a sanitary sewer main, said project to include all appurtenant work for the construction and installation of a sanitary sewer line to serve the area within the district. Section 2 Boundaries The boundaries of said Special Improvement District No. 545 are described as follows: Beginning at the North one-quarter corner of Section 18, Township 2 South, Range 6 East, M.P.M., Gallatin County, Montana; thence South on and along the west line of the Northeast one-quarter of said Section 18 a distance of 400.40 feet to the true point of beginning; thence North 89053'40" East a distance of 509.44 feet; thence South 35026' East a distance of 200.05 feet; thence South 89053'40" West a distance of 625.44 feet; thence North a distance of 163.0 feet to the true point of beginning. Contained within the above described exterior boundaries are the following lots, blocks, and tracts of land, to wit: Tracts 5B, 5C, 5D, 5E, and SF, all in the Bozeman Creek Annexation to the City of Bozeman. Sect ion 3 Character of Improvements The character of improvements is the construction of an eight inch sanitary sewer I I main, including trench excavation and backfill, bedding materials, sewer mains, manholes, wyes, and all other work appurtenant thereto. Section 4 Estimate of Cost The total estimated cost of the improvements within the district, including engineering, legal, and contingency, is $13,000.00, which includes $500.00 for repayment to Special Improvement District No. 426. "_.~m.. _. - I ~..___ ._. -'..~ .. -.. .. --", .. -"~ "...__.~. --"." ~r_ "-""r-_~.--__"""'''''''''''.~~~'''''''''''''''_r r~_.. ._,,,,_."'._~.,,-'_'.'_~m'_.'1\IPI' ""I ... m... 2GO Section 5 Method of Assessment The cost of such improvements is to be assessed against the entire district, each lot, block, or tract of land within the district to be assessed for that portion of the whole cost which its area bears to the entire district, exclusive of streets, avenues, alleys, and public places. The total actual assessable area within the district is I 92,492.72 square feet and is the area on which all protests will be received, considered, and determined. It is also the jigure on which all assessments will be calculated. Section 6 Paymen ts The payments will be made in 20 annual installments over a period of 19 years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 545, as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 ~here necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 545 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose in said Special ]mprovement District No. 545. Said bonds shall draw a simple interest from the date of their registration until called for payment, at a rate not to exceed seven percent per I annum, which interest shall be chargeable as part of the cost of construction and installa- tion of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title 11 of the Revised Codes of Montana, 1947, relating to special improvemeat::districts in cities and towns, and a!iIY amendments thereof or thereto. Section 7 ~sts and Notice The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 14th day of August, 1974, at the hour of 1:15 o'clock p.m. of said day, is t~ time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 545, the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk 6f the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this I resolution of intention.
