A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMANt MONTANAtCREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 556 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF OPERATING AND MAINTAINING A LIGHTING DISTRICT TO LIGHT THE NORTH-SOUTH ALLEY IN BLOCK ONE OF THE BRUNTON-PALFFY RE- ARRANGEMENT OF A PORTION OF DURSTON SUBDIVISIONt SAID LIGHTING SYSTEM TO BE IN- I STALLED AND PAID FOR BY THE MONTANA POWER COMPANY UNDER AUTHORITY OF AND IN CON- FORMANCE WITH SECTION 11-2245 TO 11-2257 INCLUSIVE OF THE REVISED CODES OF MONTANAt 1947. WHEREAS, at a regular session of the City Commission of the City of Bozemant held on the 30th day of July, 1975tthe said City Commission duly passed Commission Resolution No. l743t declaring it to be the intention of the said City Commission to create a special improvement district to be known and designated as Special Improvement diotrict to be known and dCEign.:ltod a8 Special I1Rprovcmcnt District No. 556 of the said City for the pur- pose of operating and maintaining a lighting district to light the North-South Alley in Block One of the Brunton-Palffy Subdivision, and to specially assess the entire cost and expense of making said improvements against the Montana Power Company; and the maintenance cost against the property within said district under and by virtue of the provisions of the law of the State of Montana in such caSe made and provided, and said Commission Resolution No. 1743 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvements District No. 556, the estimated cost of said maintenance of said improvements and method of assessing the same against the property of said district; and, I WHEREASt notice of the passage of said Commission Resolution No. 1743 was duly publishedt as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozemant Montana, and by sending a copy of such notice by U. S. mail to each persont firm, or corporation having property within the proposed district at his or its last known addresst upon the same date that such notice was first published as aforesaidt and due proof having been made of the publication and service of said notice; andt WHEREAS, within the time provided by law and said published and served noticet there Were not sufficient protests against the creation of said proposed Special Improvement District No. 556t and the City Commission was in regular session on the 20th day of Augustt 1975t at 1:15 o'clock p.m. of said daYt at the Commission Chamber in the City Hall Building in the said City of Bozeman, Montanat the same being the time and place designated in said notice for passing upon all protests, if anYt against the proposed work or against the creation or extent of said districtt or both or either; and it further appearing that all of the proceedings for the creation of said district have been lawful and regular. NOWt THEREFOREt BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: I Section 1 That the said Special Improvement District No. 556 of the City of Bozeman be, and the same is hereby created for the purpose of making the improvements as in said Commission Resolution No. 1743 and hereinafter described. '""",'T' -.' ~ --.,....., - - .. ~~):~ Special Improvement District No. 556 as follows: OPERATING AND MAINTAINING A LIGHTING DISTRICT TO LIGHT THE NORTH-SOUTH ALLEY IN BLOCK ONE OF THE BRUNTON-PALFFY REARRANGEMENT OF A PORTION OF DURSTON SUB- DIVISION. SAID LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COMPANY UNDER AUTHORITY OF AND IN CONFORMANCE WITH SECTION 11-2245 TO 11-2257 INCLUSIVE OF THE REVISED CODES OF MONTANA. 1947. I Section 3 That the entire cost and expense of maintaining the improvements herein referred to in said Special Improvement Lighting District No. 556. shall be assessed against the entire district, each lot or parcel of land within such district to be assessed for that part of the total assessment which its area bears to the total area within the district. The total area within the district is 199.220.37 square feet and is the area on which all pro- tests will be received, considered, and determined, and on which all assessments will be calculated. Section 4 That any and all existing lighting districts within the same boundaries and serving the same areas are hereby declared abandoned and terminated. . PASSED AND ADOPTED by the City Commission of the City of Bozeman at a regular session thereof held on the 30th day of July. 1975. .
